Dear Mr. Valen:
I am writing this letter as a follow-up to our phone conversation
of May 25, 1994 regarding the partially vacated alley in Block 12
of the Plymouth Addition adjacent to your client's residence at
4644 2nd Street, Fridley. As we discussed, the south 360 feet of
the alley was vacated by the City in 1963. The north lot line of
your client's property coincides with the 360 feet. North of
this, the alley is still held by the City for use by the public
as a means of access.
The neighbor to the north has impeded your client's access to his
property by placing a barricade and trailer in the alley. As the
alley is still held by the City, the neighbor does not have the
right to use the alley as they wish. The City could request that
the neighbor remove the items in the alley. Please refer to the
enclosed memo from our City Attorney regarding a similar case.
I hope this letter clarifies the City's position in regards to
the alley. Please note, however, that it has been the City's
policy not to improve or maintain any of its platted alleys.

RE: Public and Private Rights in Alley Easements
DATE: August 9, 1991
I an writing this memorandum in response to our telephone
conversation of August 4, 1991. It is partially in response to
questions raised by councilman Fitzpatrick, and also for general
information for members of the planning department.
The facts, as I understand them, in the proposed alley vacation
involving Mr. Meisner are as follows:
1. The alley in question was created by a dedication on a
plat.
2. The city has not opened or established or maintained an
alloy on the easement.
3. Mr. Meisner has been using the alley easement for
access to his property.
4. Other adjacent property owners have used the alley for
access to their properties for a number of years, the
exact number is not known at this time.
5. The city has a petition of adjacent property owners
asking to have the alley vacated.
When the City accepts a plat, it obtains an easement for streets,
alleys, parks and other public areas that are dedicated in the
plat. The City holds the easement in trust for the general
public: for the purposes indicated in the plat. in the instant
case the plat showed a dedication for a public alley. The City
thus holds an easement for the purpose of establishing an alley
at that location.
The Minnesota Supreme court in the case of JillAgg of M$-dfo dvs.
Wilson, 230 N.W.2d 458, stated as follows:
"It has set a law in Minnesota that, when a street is
dedicated by a plat, a City may choose its own time to
occupy, open and use the street. Until the City does
so, suah property may be used by the abutting
landowner. Such use is not regarded as hostile and

will not operate as an abandonment of a public atrnat
by, the city."
in the above situation the City has not chosen to open or
establish the alley less according to the decision in the Medford
case the adjoining property owners can use the alley for private
purposes until such as the city determines that it wants to
establish, improve and maintain an alley on the easement. As I
understand the facts, the City has not yet made a determination
to open and establish an alley on the easement in question.
There are other methods of establishing streets and alleys that
somewhat complicate the question in this case. An alley can be
established by common law dedication or as a prescriptive
easement.
Common law dedication requires (1) an intent on the part of tha
owner to dedicate land to public use; (2) an action by the owner
indicative of the intention, and; (3) acceptance by the public.
In this case it would appear.that the owner of the property, at
the; time of filing the plat intended that a part of the.plat be
dedicated as an alley and by filing the plat indicated such
intartt,ion.
Public acceptance of a roadway may be established by a
vomparatively small number of persons. See nDauShert_y va. SoWer$,
68 N.w.2d 866. it is,possible that this alley has become a public
roadway by common law dedication. From the information that I
have it appears that the alley has been accepted and used by
various property owners.
The right to use an alley may also be created by a prescriptive
easement. see Quiet vs. Fuller, 220 N.w.2d 296. The analyses of
prescriptive easement is similar to adverse possession but with
some difference. Creation of a prescriptive easement must be
hostile, under a claim of right, actual, open, continuous, and
exclusive. The prescriptive period is 15 years. The use of an
alley for over 20 years has been held to give rise to a right-of-
way by prescription, pryer vs. Kistler, 136 N.W. 750. It would
appear that no single property oviner has acquired a prescriptive
right to use the alley in as much as it appears that the general
public was using the alley. Therefore the property owners use
was not exclusive conclusion. it would be helpful to obtain
additional information regarding the extent of use of the alley
and the period of time that it was used by adjacent property
owners. subject to obtaining that additional information it is
my preliminary opinion that an alley has been created by common
law dedication. If that remains the conclusion then property
owners adjacent to the alley, including Mr. Meisner would be
entitled to damages if the alley were vacated.
The platting Of property in Minnesota is regulated by statute,
Minn. stat. 55o5.01 provides as follows:

"Plats of land may be made in accordance with the provisions
of this chapter, and, when so made and recorded, every
donation to the public or any person or corporation noted
thereon shall operate to convey the fee of all land so
donated, for the uses and purposes named or intended, with
the same effect, upon the donor and his heirs, and in favor
of the donee, as though such land were conveyed by warranty
deed. Laird donated for any public use in any municipality
shall be held in the corporate name in trust for the
purposes set forth or intended.
The filing of the plat pursuant to 5505.01 operates as a
conveyance to the public of such estate or interest in the
streets as is necessary to accomplish the purpose of the
dedication and no acceptance by the governing body is
necessary.

In 1963, the City vacated the north part of an alley right-of-way
located between 46th & 47th Avenues and between Main. and 2nd
Streets. It is my understanding that the City placed a barricade
denoting the start of this vacation at the north end of 4644 - 2nd
Street. (I have attached a copy of the relevant half -section map
showing the location of this alley for your review.)
Mr. Don Frank, owner of the above -referenced property, has recently
requested that the City move this barricade approximately 20 feet
to the south. This would enable him to access his rear yard from
the unvacated section of this alley right-of-way.
Unless you have concerns about this request, please call.Mr. Frank
at 571-5607 to make arrangements to move this barricade as soon as
possible. Mr. Frank works nights and is available afternoons if
you wish to discuss this matter. He would like to be present when

As you may recall, I have spoken with you recently regarding the
partial alley vacation adjacent to your residence. I have reviewed
this concern with other City staff and would like to provide the
following response regarding the City's proposed action and area
homeowners' rights/responsibilities.
1. The City will take action as soon as possible to remove the
existing barricade which denotes the start of the alley
vacation.
2. It is expected that the unvacated alley right-of-way will be
kept clear of storage of vehicles and equipment. (The City
will take necessary action to remove such storage, if
necessary).
3. The homeowners at 4644 2nd Street N.E. shall have clear access
from the unvacated portion of alley right-of-way to the six
foot portion of their property as deeded in the original alley
vacation. (These homeowners shall not use any portion of
adjacent private properties in attempting to access their rear
yard from the unvacated alley).
Hopefully, this clarifies the City's interest and expectations in
addressing this matter.
