The above entitled matter came before the City Council of the City of Fridley
and was heard on the 8 day of December , 19_26_, on a
petition for a variance pursuant to the City of Fridley's Zoning Ordinance,
for the following described property:
To reduce the side yard setback on the street side of a corner lot frau 25
feet to 17.5 feet to allow the construction of a detached accessory building
on Lot 30, Block 23, Hyde Park Addition, the same being 5881 - 2nd Street N.E.
IT IS ORDERED that a variance be granted as upon the following conditions or

Mr. Flora, Public Works Director, stated the property is located on the
_ corner of 59th Avenue and 2-3,/2 Street. He stated a variance is requested
to reduce the side yard setback on the street side of a corner lot f rom 25
feet to 17.5 feet to allow the construction of a detached accessory
building.
W. Flora stated this property was located in Hyde Park zoning which states
that any use that exists now can remain as such. He stated even if it is
destroyed, it can be rebuilt on the lot at the sane setbacks and if you add
onto the house, present normal R-1 setbacks must be met. He stated since
the lot is only 42 feet wide, there was no way the petitioner. could build a
garage that faces 59th Avenue and provide a 25 foot setback.
Mr. Flora stated since this is the first variance request the Appeals
Omission has considered frau the Hyde Park area, they felt it should be
forwarded to the QDuncil so they are aware of this action. He stated the
Appeals Commission recommended approval of the variance with two
stipulations covering a hardsurfaced driveway and outside storage to be
placed inside the new structure upon its completion.

Mr. Flora, Public Works Director, stated this is a request for a variance to
reduce the parking stall width frau 10 to 9 feet for the 358 unit apartment
complex proposed by University Avenue Associates. He stated the petitioner
feels this site is unique and they have agreed to setbacks and easements on
all four sides of the parcel and have several acres of wetlands which must
conform to standards of the Army Corp of Engineers. He stated they are
proposing 247 covered parking spaces and 482 open spaces for a total of 729
spaces. He stated 712 spaces are required by the Code. Mr. Flora stated
the petitioner feels, by providing a nine foot parking stall, they could
improve the amenities.

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.21.5, D, 3b requires that an attached or detached accessory
building which opens onto the side street shall be setback at least 25
feet.
Public purpose served by this requirement is to allow for off-street
parking without encroaching on the public right of way and also the
aesthetic consideration of the neighborhood to reduce the building
"line of sight" encroachhment into the neighbor's front yard.
B. STATED HARDSHIP:
"The hardship is the size of the lot."
C. AMINISTRATIVE STAFF REVIEW:
This corner lot is 42 feet wide. It has a small house on it without a
basement. The only storage space they have is a small utility shed.
The property is zoned S-1 (Hyde Park). The lot once had a garage
located in about the same area as where they would like to build the
new one.
If the Appeals Commission approves this request, the staff would
recommend that the driveway be hard surfaced and that all the outside
storage be placed inside the new structure following its completion.
Also, because the lot is in the S-1 district, we will pass your
decision on to City Council for further consideration.

REGARDING: November 25, 1986 Appeals Items
Minutes from the last Appeals Gommission will not be formally approved by the
Planning Commission until December 10, 1986. The two items discussed include
a single family variance in Hyde Park and a parking stall size variance for
North Park Estates. Both items were unanimously recommended for approval.
The Hyde Park variance does not require Council approval due to unanimous
approval. However, the Appeals Commission recommends council review the
matter due to the historical concern for Hyde Park development.
Staff felt Council would prefer to review the North Park Estates variance
along with the rezoning and plat requests for the same project, both
scheduled for December 8, 1986 Council meeting. The Planning Commission is
aware that a stall width variance was to be processed through the Appeals
Commission.
Due to the unique circumstances we suggest that Council review both variances
at the December 8, 1986 meeting, prior to Planning Commission approval of the
minutes.

(buncilman Fitzpatrick stated he felt it would set a preoedefit for multiple
developments, if this variance were granted.
Ms. Fisher, legal counsel for the petitioner, stated iVthey were to provide
ten foot parking stalls, they would only have 690 s `des in comparison to
712 which is required by the code. She stated in or/r to comply with the
Code, they would lose some open space. Ms. Fishestated she felt there
were some unique circumstances in the physica characteristics of this
property, if there was concern about setting a ecedent. She stated the
most important is the fact that easements were ;given on all four sides of
this parcel. She stated the 60 foot easemp'nt on the north was heavily
negotiated, as the developer's plans had onlf considered a 30 foot easement.
She stated the same is true for the 20 foof util ity easement on the east
which doesn't benefit the property. Ms. Fisher stated in the EAW review
process, they were made aware they had �/�o obtain a permit from the Army
corps of Engineers to retain a portionRbf the wetlands on the property. Ms.
Fisher stated it is important to reta /h some flexibility in regard to the
existing parking spaces, in case they are required to relocate some of the
parking on the south. She stated they feel there are practical difficulties
associated with conforming to the de requirements for the width of the
parking stalls.
councilman Fitzpatrick stated,£ he was a potential tenant, he felt one of
the chief amenities would be,,a ten foot parking stall.
Ms. Fisher stated their co0sultant has indicated their experience throughout
the United States is theyseldom design ten foot stalls. She stated they
felt, even for coircercii development, nine foot stalls are adequate and
usually design 8-],/2 f"ot parking stalls. Ms. Fisher stated there was
discussion at the Appals Commission meeting regarding striping 12 foot
spaces for recreation vehicles and they have indicated to staff they would
strip 65 areas for recreational vehicles.
Mayor Nee asked the petitioner could use the north easement for parking
until such time s it is needed for a road. Ms. Fisher stated the original
proposal was t provide a 30 foot easement and parking possibly could have
been worked o- , however, with the 60 foot easement, she didn't feel parking
would be of ' ch benefit because it wouldn't be in close proximity to the
units.
Mr. Qure i stated the 60 feet was requested for future access and it was
hoped rest of the right-of-way which may be needed could be obtained

Mr. Clark stated this property was located on the corner of 59th Ave. and
2 1/2 St. The proposed garage would be 22 ft. in depth, a little wi.der than
a normal garage, but the petitioner needs as much space as possible for storage
because they have a small house with no basement.
The garage would be located 3 ft. off the back property line and approx.
1712 ft. off the north property line. There is a 15 ft. boulevard between
the curb and the property line so there would be 30+ feet from the curb itself
so there would be plenty of room to park a vehicle in the driveway without
encroaching on the street. He stated there was a garage in
this sane location, but it blew away in 1965 and was never rebuilt.
Mr. Clark stated this was in Hyde Park zoning which states:that any use that

Mr. Clark stated Staff was recommending a stipulation that a hardsurfaced
driveway be put in, and he believed the petitioner had agreed to that.
He stated the petitioner has a lot of outside storage now, and hopefully,
this garage would solve that problem.
Mr. Clark stated he had discussed this request with Mr. Jock Robertson,
Community Development Director, and they agreed that this variance rquest
should go to City Council so the Council was aware of this action. Even if
the Appeals Commission approves the variance request and there is no neighbor-
hood objection, they feel the City Council should be notified. This was the
first variance the Appeals Commission or the City Council has had from the
Hyde Park area.
Mr. Eugene Hagberg stated that, as Mr. Clark had stated, everything that is
presently outside will be stored inside the new garage.
MOTION BY MS. SAVAGE, SECONDED BY MR. BARNA, TO CLOSE THE PUBLIC HEARING.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON BETZOLD DECLARED THE PUBLIC
HEARING CLOSED AT 7:50 P.M.
Mr. Barna stated that with the small size of this house on a slab with no
basement and no garage on a 42 ft. lot, he could sympathize with the petitioner.
The 171Z ft. off the lot line left plenty of room to park in the driveway and
cause no visibility problems to the street. He would be in favor of granting
the variance.
Ms. Savage stated she agreed. This was a very small house and there was
obviously a need for a garage for storage space. She would be in favor of
granting the variance.
Mr. Betzold stated he was in agreement with what had been said by both

complex. The City has asked them to dedicate certain ease ents and
establish setbacks on all four sides:

On December 8, 1986 the Fridley City Council officially approved your request
for a Variance, VAR #86-31, to reduce the side yard setback on the street
side of a corner lot from 25 feet to 17.5 feet to allow the construction of a
detached accessory building on Lot 30, Block 23, Hyde Park, the same being
5881 - 2nd Street N.E. with the following stipulations:

1. The driveway be hardsurfaced.
2. - All outside storage to be placed inside the new structure following its
completion.
