Fridley, MN 55432 Dear Mr. Klostreich: ** SENT CERTIFIED MAIL Gro. As you are aware, recently the City of Fridley conducted an inspection of the rental property you own at the above address. During the course of the inspection several serious code violations were discovered. Attached for your information are the inspection reports which describe these code violations. As you can see, the reports indicate that the property has deteriorated to a point where significant structural, plumbing, electrical and mechanical repairs are necessary. It should also be noted that under the Fridley Zoning Code your property is considered non -conforming due to the small lot size, inadequate building setbacks, small building floor area, and insufficient surface parking. City Code places stringent requirements on non -conforming properties which are going to be upgraded or improved. Specifically, Section 205.04.03.B, "...allows the upgrading of non -conforming structures to a safe condition, provided the necessary repairs do not exceed 50% of the fair market value of the structure." Further, the cost involved may be quite high and could likely trigger the non -conforming compliance issues cited above. Approval of variances for these issues could be difficult to obtain given past City Council policy. In light of these facts, I am writing to determine your interest in selling this property to the City. If you are interested in pursuing this option we would need to have the property appraised and be able to reach agreement on a price. The purchase of the property would also have to be approved by the Fridley Housing and Redevelopment Authority. Code Section 205.22.07.F states that "Every exterior wall, foundation and roof of any building or structure shall be reasonably watertight, weathertight and rodentproof and shall be kept in a good state of maintenance and repair. Exterior walls shall be maintained free from extensive dilapidation due to cracks, tears, or breaks of deteriorated plaster, stucco, brick, wood or other material that gives evidence of long neglect." Based on this Code information we have observed that variances will be required for: lot area; lot width; building setbacks; minimum floor area; surface of parking spaces. As the inspection photographs and reports indicate,this structure is not in compliance with the maintenance portion of the Code. Code Section 205.04.03 B gives clear authority to allow upgrading of a nonconforming structure providing the repairs do not constitute more than 500 of the fair market value of the structure. RECOMMENDATION: Staff recommends research to determine the value of the upgrading costs necessary to make the property at 6000 2nd Street comply with all minimum code standards. Once the improvement values are known, the total improvement cost should be compared against the value of the property. If costs exceed the 50o fair market value of the structure, staff recommends acquisition and demolition of the structure. Presently this single family dwelling is being occupied by an adult family. Living conditions are being kept in a healthy environment and this report does not reflect any conditions caused by the occupants. The present state of this single family dwelling is disrepair because of age and deterioration and other causes which are; 1) Foundation - concrete blocks show displacement (no frost footing). 2) Pier post - not properly supported - earth, no footing, age. 3) Beam support - deteriorated (age, sagging) . 4) Floor joist - deteriorating because of age. 5) Foundation is open to the weather in some areas allowing harborage of animals. 6) Flooring is deteriorating in some areas and allowing water heater to lean. 7) Water closet waste pipe is not properly supported because of sagging flooring and supporting members. 8) The exterior siding of the dwelling has been fractured (holes and cracks). 9) The windows have been caulked; unable to open if needed for rescue purposes or ventilation. 10) Roofing - materials insufficient. 11) Insulation in floor joist - loose. 12) Insulation in rim joist - none. 13) Rewire or disconnect wiring in garage areas as per National Electrical Code. To conclude this report and for the safety of the occupants of the single family dwelling, the owner shall include reports as submitted and comply with corrections to make this structure a safe and healthy environment and meet Chapter 220, Residential Rental Property Maintenance and Licensing Code.
