Her purpose in calling was concern over the apparent deflection in the north wall of her basement. On a subsequent field inspection, we observed that the north wall of the basement has a definite 3 to 6 inch deflection inward, at the top, near the middle of the structure. The south wall has some deflection in it also, however it is not as severe. It is apparent that the connection between the foundation and the floor system of the house is failing. This situation is very serious and must be corrected immediately. I do want to be aware of what you intend to do to resolve this problem and you may reach me at 571-3450. Fridley, Minnesota 55432 OUR INSURED: ECONOMY BLACKTOP OUR CLAIM NO. 8168890 DATE OF LOSS: 6/10/82 YOUR CLIENT: MARY KOPP This letter will serve to summarize our conversation of March 24, 1983. We feel that there was no negligence on the part of our insured as he bid on a blacktop driveway job and did the work per the instructions of Mary Kopp. She had wanted the blacktop next to her house and our insured had no reason to believe that a wood foundation would not hold the blacktop driveway. As I indicated to you, wood foundations are becoming more and more prevalent as the price of concrete goes up and they would not be built if they could not withstand external pressures such as blacktop driveways. Both Dennis Mollich of Master Home Repair and our insured took a look at the outside grounds around the house. They both came to the independent conclusion that the builder had backfilled the property incorrectly. He should have used regular dirt fill which would have provided a more solid foundation. Instead he used left over garbage from his construction such as nails, wood pieces, stone and rocks and anything that he had which would have saved him the cost of paying for the load of dirt. If you were to inspect the ground around the house as we did, you will see that the front sidewalk is not level as it is sinking. The wood foundation where it meets the ground has settled and there are two different colors there where it was painted originally and where the ground has sunk below showing a different original color. Mr. Mollich also felt that the house was not constructed correctly in that there should have been an upper sill plate placed over the bottom wood foundation where it meets the foundation of the floor to give it better support. He stated that there was only a 2 by 4 sill plate which wasn't secured properly and there should have been a 2 by 6 or 2 by 8 sill plate used to give it better support. Mailing address: P.O. The HUD Inspector also should have gone one step further after he had drawn his conclusions about the damaged wall to find out why a wood foundation had given place with the asphalt driveway next to it. He should have taken it one step further and realized that if this wood foundation gave then logically any other wood foundation with an asphalt driveway next to it would also give and that there must be something wrong in the construction of the house. They probably were just called out to find the cause of the bowing of the wall and anyone could tell that the asphalt driveway was an obvious cause. A building inspector who was alert would have tried to go further than that to find out if there were other factors involved besides the driveway. In conclusion you should look to the building contractor for damages for the work he had done. We feel that our insured did not do anything wrong as he had only bid on the job and was doing what he had been told to do. The building inspector should have looked at the job before Mrs. Kopp decided to have it done to make sure that all was in order. I will fawait to hear from you in this matter. We again inspected the wall after it had been repaired by removing the fill from the outside, pushing the wall back to plumb and renailing the wall to the floor system. Please note that the letter does not state that the repair was approved by us. The reason we could not state such is that the repair was not done in the manner we discussed. Please recall that we suggested that a 2 x 4 plate be placed on top of the existing 2 x 6 double top plate,that it be bolted to the existing plate and that joist hangers.be installed connecting the joist to the plate system. This then would be an acceptable connection system. Also, the finished grade on the backfill must slope away from the foundation to provide drainage and prevent hydrostatic pressure on the wall.
