Mr. Oliver Erickson and Mr. Dean Brunkow were present.
Mr. Erickson said that because they wanted to hurry this request along,l-they.._
were appearing at this meeting and this item would go before the Appeals Commission
on September 30th and could go to Council on October 6th..
Mr. Brunkow said there was a small house on this property now, which would be
torn down. This would be replaced with a double bungalow. He said that although
this property was zoned R-3, the property was not large enough for a.triple bungalow.
Chairman Harris said that according to the Code you can build'dciuble bungalows
in R-3 zoning.
Mr. Erickson said this was a corner lot and it was approximately 72 x 136 feet,
so it probably d4,dn't meet the R-3 requirements at the time it was zoned 9-3.: He
said the seven years he was on the Planning Commission there were probably errors
made in zoning, and probably this Planning Commission could correct them. He said
this property was about 200 square feet short of meeting the R-3 requirements.
Mr. Olson said that in the R-3 section of the code, it states in_Sedtion:-.�
205.073 that one and two family dwelling units will be subject to the provisions
in R-1 and R-2 districts respectively, therefore only one variance was necessary
to construct this double bungalow. It met all the other requirements of R-2 zoning.
Mr. Olson said the reason they were going a little backwards with this request
was because the mortgage commitment had a very limited time value on it. -He said
this would be a two story double bungalow. He said there would be a 3 car garage
built where the existing small structure was now located on the survey. He said
they were not trying to by-pass the Appeals Commission, because he knew they were
the authority on making recommendations on variances. He said they were just going
this route to get them to the Council sooner.
Mrs. Walhberg asked what was next door to this property. Mr. Olson said he
thought it was an 8-plex. Mrs. Wahiberg said there would be no way that any additional.
property could be obtained.then.
MOTION by Bergman, seconded by Peterson, that the Planning Commission recommend
to the Appeals Commission approval of the variance to reduce the lot area from 10,000
square feet to 9,781 square feet, to allow the construction of a double bungalow at

Mr. Mattson stated the administration was concerned with the orientation of the
houses around the cul-de-sac as far as privacy but that this has been cleared.up.

vote, there being no nays, the motion carried.
Mr. Brunkow was present to present his request. A copy of the lot survey showing
the proposed dwelling location and a house plan were shown to the Board. Mrs. Robert
Fischer, 248 - 58th Avenue N.E. was present to hear the presentation.
Mr. Brunkow said he is proposing a double bungalow (side by'side units) on the corner
of 23Z Street and 58th Avenue. He said there is a small house existing on the property
that his mother lives in which will be torn down. He said the land is zoned R-3
but the land is not large enough for a tri-plex. Mrs. Fischer asked if the units
will be rented out and Mr. Brunkow said his mother will live in one unit and he will
live in the other.
Mr. Brunkow added he plans to build a triple garage where the existing house is
now located. Mrs. Fischer questioned a triple garage and Mr. Brunkow said the
Code says it has to be a triple garage and he does have two cars.
Chairwoman Wahlberg noted that the proposed location meets the City Code. She said
the request before the Board is to reduce the lot area from 10,000 square feet to
9,781 square feet.
Mrs. Fischer questioned the driveway location for ttie garage. Mr. Brunkow said the
driveway is now right along the common property line but the new driveway will be
approximately 10 feet from the line.
Mr. Plemel asked Mrs. Fischer where her garage was located. Mrs. Fischer said her
garage islocated next to the common property line and the driveways.are now side
by side. Mr. Plemel noted that this will provide a good separation between her
.house and the proposed double bungalow. a
Chairwoman Wahlberg asked Mrs. Fischer if she had any objection to the variance and
Mrs. Fischer said she couldn't see any at this time.
Chairwoman Wahlberg noted there is an 8-plex to the south of this property so in a
since Mr. Brunkow is land locked as he can't purchase any other property to meet
the Code requirement. She added that as she understands it, when this land was
rezoned to R-3, it didn't meet the Code for square footage as the adjacent property
was already built on and this land was just left over.
Mr. Plemel.stated this looks like it will be a very nice addition to the neighborhood.
He asked Mr. Brunkow when the existing house was built and Mr.. Brunkow said it was
built in 1958.

Board to refer to the excerpt of the Planning Commission minutes concerning
this item that they had all received. She added the Planning Commission was
a little reluctant but did agree to act on this item to speed things up and it
was approved by them. She added that if the Appeals Commission approved this
request it would go to the Council on October 6, 1975..
Mr. Plemel added he is all in favor of speeding the processing time along.

Chairwoman Wahlberg informed the Board that the Planning Commission is in the
process -of drawing up a junk car ordinance which will be helpful'in cleaning -
up some of the lots in Fridley. She also informed the Board that the Planning
Commission had discussed the Appeals Commission's recommendations on the
alternate procedure for processing variance applications on residential property.
She said this would be on the Council agenda for the October 6, 1975 meeting so
the Board should be hearing something on it soon.
Chairwoman Wahlberg said the Planning Commission Chairman had asked that all
commissions start to review the Zoning Code and Sign Ordinance and any
recommendations on either Code should be brought to the attention of the Planning
Commission as these Codes would be gone over by the Planning Commission after
January 1, 1976.

RECEIVING LETTER FROM FRANK'S TRIS REMOVAL SE=RVICE
Councilman Starrralt stated that a letter frorr Frank's Tree Ren?oval SLrvice had
been delivered to his hone that morning: Mr.. Frank Szyanski had promised to be
at the Council ileeting tonight, but he t•ras not present.
Mayor Nee said that he had asked Dan Huff to be at the meeting also,. and vie could
call on him for an explanatloil of the disposition of the tree removal program.
Mr. Huff said t[iat they were finishing up the year with about 50 trees to still be
removed. We ►•sere contemplating a more permanent type of contract, but in the
meantiiire vie accumulated these 50 trees, so we had to contract these out riallt array.
As, we erere obtaining quotes, we decided to get: quotes ori a precise basis. 1•Je did
not have time to go into advertising for a permanent contractor. We will look into
this for next year.
The only drawback we could sec' with a permanent contractor is that the contractors
could be negative unless we had an escape clause in it. The one contractor vie
contacted iii Fridley has several contracts in several cities, and if a tree disease
hits a lot of trees at once, they would not be able to have all of the trees dorm
in 10 clays, so they ►•could rant an escape clause. The other problem is the changing
prices. There are alternatives in going both ways. The thing vie would want to do
is find a good contractor and stay with him.

Mayor Nre asked, in rogard to the State subsidy, coordinated with the City for
the tree removal prcr;r•am, is it correct that it shall not exceed 50% of cost
removal or shall noC exceed $50.00 and shall not exceed local subsidy.
Tie City Hanager said the local subsidy will be 50"x. The property owner ►•rill
not pay anythinp.
Mr. fluff confirmed l.hat the Maximum the State would pay would be $50.00 per
tree and no more than ?.5Y of'the total cost.
He further explained that we could still assess the property otmer. If we had
a 25 subsidy and the State, 25;: subsidy that matched ours, and 50% was left, we
VIOL) lci*do the work and assess that other 50'0 to the owner, plus administrative
costs.
A good proximity of total Vcorl, done in Fridley this year is $100,000. If we ►cant
to go to a subsidy ne>:t year, we have to estimate $25,000 because if we do riot

cont ngeii(y fund. We would have to make _i.t available to people whether it would
be ii, the first. part of the year or the 1 st part of the year.

Pan Savelkoul was. present and explaincd his request for an extension was to allow
them more time to tcork Out a program that mould be within their pocket. After
receiving bids and estimates, the original program was not ►;cithin their means, and
they ►•could have to adopt another approach. lie said they are no -t sitting on the
project, and are doi.n, things in. the spirit of the Resolution, and are up -grading
the landscaping. lie further explained they ►•ce.re also making improvements tcithin
the establishaiCnt, and these are all justifiable. They have spent $10,000 in this

City Staff with total compliance of the City requirements at this time. He Would
