In response to your questions regarding responsibility of trees in easements, such trees are basically
the responsibility of the underlying property owner. Easements convey certain rights to the grantee,
such as an ingress/egress easement or a utility easement that allows placement and access to
utilities in a certain location. Easements do not transfer the responsibility of anything else within
that area to the recipient of the easement those responsibilities remain with the property owner.
In the case of a tree that hangs over a property line and/or outside of an easement it is generally
accepted that the branches, leaves, etc., become the responsibility of the owner of the property
onto which they have crossed. Essentially, once it crosses the line onto your side, it is yours to
deal with. 1 highly recommend you consult with an attorney on this prior to doing anything as my
opinion has no legal bearing.
