MOTION by Councilman Wright to concur with the Building Board and grant a Building Permit to Mr. Eilers and Mr. Weikle for modifications of the Texaco Service Station at 61st and University. B ALS MTIaTG MUMSm SEEMM 7. 1%6 The City manager read the motion by the Board of Appeals to recommend toot the variance be granted. Mr. Ceroll was not present at the Council Meeting, Councilman Sheridan asked if there was a lot survey submitted with the request. The City Manager said that there was no survey with the request. Councilman Wright said that there should be, especially when you got down to one foot. MOON by Councilman Sheridan to direct the Administration to advise the applicant that the Council finds it necessary that a survey of his lot and the location of the addition shown on the survey be submitted, plum a letter from the abutting property owner showing so objection. Seconded by Council- man Wright. Councilman Wright said he did not know bone this got by the Building inspector as the Building Inspector has very carefully been telling everyone that a Certificate of Survey is required especially when there is a waiver. Be suggested that a memorandum be sent to the Board of Appeals indicating the Council's policy with respect to a Certificate of Survey so the people will be informed from them as well as the Building Inspector. Mayor Kirkham asked the City Manager to send a memorandum to the Board of Appeals. VOTE upon the Motions Upon a voice vote, there being no naps, Mayor Kirkham declared the motion carried, s REGULAR COUNCIL i TXNG® NO 7, 1966 PAGE 11 through street rather than a cul de sac for emergency vehicles such as £irk, trucks, and the court will decide if there is a benefit. The City Attorney asked if we were in agreement that it must be completed. He suggested that if there was sufficient agreement, they could proceed and leave open the question of the assessment. Mr. Sexter said that he was in no mood to borrow money to put in reserve to complete the street. He said he had had trouble with the sewer and water which bad been an additional expense to him of $2500. He said be did not mind paying his share, but when the street was put in to benefit more people, his expense should not be so high. He said he seoliaed that everything is runaing,higher now, but this was high because he was donating his free -and then buying the street down by Lynne Drive. The City Attorney said that this will either be resolved between Mr. Soutar and the Council, their attorneys, or by.the court. Be suggested they go ahead with an escrow agreement and hold it in abeyance until it is resolved, and in this way they could get the project done. Councilman Wright said that perhaps the Council could go so far as to State that this action would not prejudice wither Sexter or the City on the basis of the assessment. The City Manager said that the City would need five consecutive warm days of 55 degrees or better to get this done. Ms. Frank Rogers a resident who lives on the corner of Polk and Lynda Drive said that the people have been promised a street would be put in by the City Attorney. The City Manager said there was no reason to expect it Mould not be put in, Mr. Rogers said that the money from his property is in escrow and this has been going on for two years. Mayor Kirkham said he was doubtful that it could be done now. )ft. Rogers asked how the vehicles are going to get in on Heckmann in the Spring. The Council said there was a possibility that some kind of a base could be put down. Mr. Baxter said that if it was just a matt6r of the escrow money, he will consult with his attorney, and he imagined they could put it In. Councilman Wright said he was sure the Council will want a street, and they will put one in as sada as possible. He said that this will not be prejudicial to the assessment. The City Manager said that one resident had heard a rumor that the City would not plow this in the winter. He said the City normelly does not plow unfinished streets, but in this case the curb is in and it is a normal width street so they will plow. He said also that the street name signs will go in as soon as signs are received by the Public Works Department. Councilman Wright said that possibly the Public Works Department and City Engineer could see if some kind of surfacing base could be put in for Spring. The Council also discussed stop signs coming off of Polk Street. M=an by Councilman Wright that Polk Street have boulevard stop signs at Lynda Drive, both on the north and south sides. Seconded by Councilman Samuelson. Upon a voice vote, there being no nays, Mayor Kirkham declared the motion carried. P Councilman Wright said that Councilman Samuelson was the only one he had not talked to about the requested variance for Mr. Ceroll. He said this was a close variance, 1.60, but there was a high 8 foot hedge on the neighboring property. • REGUTAR COUNCIL XMIXGe NOVEMER 7, 1966 PACE 12 Be said there Baas a letter from the neighbors giving their approval, but he had not brought it to the meeting. The Council looked at a letter received from Mr. Doyle Mullin stating he had no objection to the variance requested by Mr. John St. Aubin. MOTION by Councilman Wright to receive the communication from Mr. Doyle Mullin. Seconded by Councilman Samuelson. Upon a voice vote, then® beidg no nays, Mayor Kirkham declared the motion carried. St. Aubin, 1217 Hathaway Lane Northeast for ver of side yard requirement from 5 feet to 2 feet to permit construction of an attached garage, and to grant the requested variance to Mr. Doyle Ceroll, 4651 - 3rd Street Northeast, for a waiver of side yard requirement from 5 feet to 1t, feet to permit construction of a detached garage. Seconded by Councilman on Samuels. Upon a voice vote, there being no nays, Mayor Kirkham declared the motion carried. SALT URZAMA ('PABA 10/17/66)1 7be City Manager said he had received some research information from Diamond Crystal Salt Company, although they had not submitted a bid. Among the material. was a report from the 5t. Paul Superintendent of Public Works which listed some r of the drawbacks of the rust inhibitor. Among other doings, it leaves a greasy residue on the street, it has a certain aunt of toxicity and they recommend employees use face masks. Filling.stations and parking ramps complain that it is hard to clean the windows and that it congeals on the floor like jelly. MOTION by Councilman Samuelson the Council award the bid to Cargill, Incorporated for the regular salt at a price of $9.80 per ton delivered. Seconded by Council- man Wright.
