RE: CITIZENS' COMPLAINTS
I accompanied the Mayor today on a short visit to a couple of neighborhoods where
they are concerned with a couple of specific problems. They are as follows:
1. The residents at 4700 - 3rd Street N. E., the family of Donald J. Hodgeman,
are having some settling problems. Please review with the resident the
problems they are having with their home, and check the boulevard areas
to see that whatever construction in the area the City initiated has been
properly completed. Please use your discretion in this area,. and if you
are unable to show that this is the responsibility of the City, please,
if possible, make recommendations to the citizen on steps she can take in
improving their problem. The Hodgeman residence phone number is 560-6858.
2. A traffic problem has been brought to the Mayor's attention at the inter-
section of 45th and 2nd Street in the City of Fridley. One of the residents
of the area, Mr. Frank Kozlak, 4512 -2nd Street, phone number 560-6637, has
passed this information on to the Mayor. The suggestion I received concerning
its solution is to place a stop sign at the intersection where the City of
Fridley has jurisdiction. These would be the northeast and northwest corners.
This suggestion is that these be placed for six months in order to see if
the problem can be taken care of in this manner. Please review the material
and again make your recommendations.

Please be advised that since July 21, 1988, I have received calls from six
homeowners who own banes in the vacinity of the 5300 block of Horizon Drive,
requesting that I inspect their house foundations because of apparent
differencial settlements. Prior to these calls we had inspected 5 other
foundations during 1987 arra 1976 that were in this general area.
There appears to be a pattern of things that probably have caused these -
settlements to occur or are present at each location:
1. They have all occured during long dry spells (1976, 1987 & 1988) .
2. All have had mature trees growing in the general vacinity of the failure.
3. Yard and street settlement has also occured in front of those homes that had
mature trees in the front yard near the failure.
4. All those that have had soil tests done have had a layer of moisture
receptive or active soil at or below the footing elevation.
5. All homeowners have been advised to contact a soils engineer to test arra
report their findings and to suggest the method of correction.
6. All of the hones were built in the mid 1950's.
The cost of repair will depend upon the extent of the failures. We estimate the
cost of such repair to range between a minimum of $500.0 to a maximum of
$20,000.00 or possibly higher. One home repaired in June, 1987 paid an
estimated $3,000.00 to a contractor to replace the back wall (32 feet) of their
basement. That repair consisted of the following: temporarily supporting the
structure on post arra timbers; removing the back foundation wall and footing;
digging down through approximately six feet of clay or silt to granular gravel
at three locations (each hole was about 4' x 2') ; pouring each hole full of
concrete; pouring a reinforced concrete grade beam over the top of the new pads
to form a new footing; laying up a new block wall; and setting the house back
down.

and we will be happy to review our files. We do have individual records on each
reported problem.
Its possible that there could be more failures that have not been called in for
our review.

SUBJECT: Settlement Complaint: 4700 3rd Street
I have talked to Mr. Hodgman at 4700 3rd Street a number of times this past year. He is in the
process of purchasing the home from his parents and is claiming that the house has settled over
the years as a result of the City's sanitary sewer system. He makes his claim from information
received from the address file which indicated there was a broken sanitary pipe and as a result,
he claims the soil is under -mined and the house is settling.
In 1972, the Hodgman's made a complaint regarding settlement of their boulevard along 47th
Street. This was checked and was determined to be a result of frost heave and poor construction
of the retaining wall on the property.
In 1974, a complaint was made that the house was settling. An inspection was made, boring
samples were taken along the boulevard and no problems were found.
In 1978, the sanitary sewer line was TV'd and a broken pipe was found along 47th. This broken
section was 69 feet west of the Hodgman's property and had no material affect on their residence.
This pipe has been repaired.
In 1986, there was considerable water damage to the structure and a permit was drawn and repair
work initiated.
In 1988, this residence was reviewed in conjunction with the settlement of the homes in the 53rd
and Horizon Drive area. It was identified at that time that most of these problems were associated
with homes built in the early '50's that had large mature trees that apparently were drawing
moisture from the soil in the drought period, resulting in soil consolidation and house settlement.
Mr. Hodgman continues to claim that the home has settled as a result of the City sewer system.
We have no information to substantiate his claim as the system is in tact and functioning.

In response to the referenced problems, please note the

1) Reviewed the settlement complaint area in the field with
the sewer department personnel. It.gave no indication of storm sewer
settlement and all the piping and structures are in good condition.
Minor maintenance to the structures is required (has nothing to do
with the settlement problem). The roadway is tight and sound and
there is no indication of subsurface damage due to settlement. We
performed auger soil borings in the boulevard adjacent to the
referenced property and again, there was no evidence of settlement
(that is, no voids discovered in the boring procedure). We could
find no reason for further City involvement. The property owner
was contacted and we related all the information to her and in-
formed her of the necessary procedure to follow if further action
was desired on her part. That procedure would be -to file a claim
against the City which would entail the property owner acquiring
soil borings of her own private property. She indicated she would
think about it and determine what she would want to do.
2) In order to determine if stop signs were warranted at the
intersection of 45th Avenue adn 2nd Street, the Engineering Division
made traffic counts. The traffic counts indicated no high volume of
traffic in either director. A review of the records in the Public
Safety Department indicated no accidents occurred in this area with-
in the past two years. Therefore, with the record of no traffic
accidents and a low volume of•traffic (approximately 225 average daily
vehicles on 2nd Street and approximately 200 average daily vehicles
on 45th Avenue) no stop sign installation is ;:arranted.

Flease be advised that since July 21, 1988, I have received calls from six
homeowners who own hares in the vacinity of the 5300 block of Horizon Drive,
requesting that I inspect their house foundations because of apparent
differencial settlements. Prior to these calls we had inspected 5 other
foundations during 1987 and 1976 that were in this general area.
There appears to be a pattern of things that probably have caused these
settlements to occur or are present at each location:
1. They have all occured during long dry spells (1976, 1987 & 1988).
2. All have had mature trees growing in the general vacinity of the failure.
3. Yard and street settlement has also occured in front of those homes that had
mature trees in the front yard near the failure.
4. All those that have had soil tests done have had a layer of moisture
receptive or active soil at or below the footing elevation.
5. All homeaAmers have been advised to contact a soils engineer to test and
report their findings and to suggest the method of correction.
6. All of the homes were built in the mid 1950's.
The cost of repair will depend upon the extent of the failures. We estimate the
cost of such repair to range between a minimum of $500.00 to a maximum of
$20,000.00 or possibly higher. One home repaired in June, 1987 paid an
estimated $3,000.00 to a contractor to replace the back wall (32 feet) of their
basement. That repair consisted of the following: temporarily supporting the
structure on post and timbers; removing the back foundation wall and footing;
digging davn through approximately six feet of clay or silt to granular gravel
at three locations (each hole was about 4'x 2') ; pouring each hole full of
concrete; pouring a reinforced concrete grade beam over the top of the new pads
to form a new footing; laying up a new block wall; and setting the house back
dog, n.
A cccposit map is being maintained that shows the reported nates and addresses
of all reported problems.
If anyone wants more information on this subject, Fuse cor_ttact our department
and we will be happy to review our files. We do have iniividual records on each
reported problem.
Its possible that there could be more failures that have not been called in for
our review.
