MOTION by Mrs. Gerou, seconded by Mr. Barna, to approve the minutes as written and corrected, of August 11, 1981. AIZIN_ ISTRATIVE STAFF REVIEW: The existing detached garage is 161 x 20•, is 3.2 feet from the side lot line, and the front of the garage is in line with the back of the dwelling. The adjoining house to the north is 18.1 feet from the common lot line and has a detached garage on the north side of the lot. The applicant proposes to add onto both sides and the back of the garage making a 20' x 26' garage that will be approximately 1 foot from the common lot line, three feet from the dwelling, with an additional six . feet added onto the back. If the Board approves this request, we recommend that there be no openings in the north wall and that it be sheetrocked on the inside. Also, that the roof overhang be limited to 12 inches maximum. Mr. Joseph J. Mike, 4916 Third -Street N.E. was present. Mr. Clark showed the commission some drawings and a letter in favor of the addition from Mr. Mike's neighbors at 4928 -3rd Street N.E. Chairwoman Gabel read the letter from Arnold and Irma Peterson. MOTION by Mrs. Gerou, seconded by Mr. Barna, to receive the letter into the records. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRWOMAN GABEL DECLARED THE MOTION CARRIED UNANIMOUSLY. Chairwoman Gabel asked if Mr. Mike was going to have to disturb the big tree and how much space there would be between the house and garage. Mr. Mike said he would not have to go near the tree and there would be three feet between the house and the new garage. He also explained that they own two vehicles. and they have a real problem with storage and he does not want to leave a vehicle out in the winter. He said if the variance is approved, he will then talk to a contractor and might possibly start early next spring. Chairwoman Gabel explained to him that the variance is good for one year and, if it is not done within that time, he would have to come back for an extension of time. Mr. Mike said he would definitely build in one year and the contractor would at least 90 percent of the work. Chairwoman Gabel asked if he was going to open up the driveway. Mr. Mike said he is going to widen the driveway to the opening of the curb and leave the curb as it is and that the siding will be exactly the same as the house. Chairwoman Gabel asked if he would have any problems with the stipulations such as no openings on the north side, 5/8" fire -proof sheet - rock and the 12" overhang. Mr. Mike said he did not have any problems with the stipulations. Mr. Clark said if he wanted, he could have a wire -glass window on the north side. Chairwoman Gabel said she did not see any problems as there would still be 19 feet between structures and his neighbors could add on without any problems. MOTION by Mrs. Gerou, seconded by Mr. Barna, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRWOMAN GABEL DECLARED THE PUBLIC HEARING CLOSED AT 7:42 P.M. Appeals Commission Meeting - August 251 1981 Page 3 MOTION by Mr. Sarna, seconded by Mrs. Gerou, to approve the variance request to reduce the side yard setback from 3 feet to one feet frcam side lot line, to allow an addition to an existing garage to expand from one and one-half stalls to two stalls, on Block 3, Lot 20, Carlson's Summit Manor South Addition, the same being 4916 - 3rd Street, N.E., Fridley, Minnesota, 55432, with the stipulations that there be no openings in the north wall, except for a wire -glass window, that it be a 5/8" sheetrock fire wall on the inside, and that the roof overhang be limited to 12 inches maximum. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRWOMAN GABEL DECLARED THE PUBLIC HEARING OPEN AT 7:44 P.M. Chairwoman Gabel read the Staff Report: ADMINISTRATIVE STAFF REPORT 4040 Marshall Street N.E. (Same as 4040 East River Road N.E.) A. Pi,BLIC PURPOSE SERVED BY REQUIREMENT: Section 205.134, 4A, requires a front yard depth of not less than 35 feet for all pereitted buildings. Public purpose served by this requirement is to provide adequate open space areas around industrial structures for aethetic and firefighting purposes. Section 205.134, 4C, requires a minimum rear yard setback of 25 feet. Public purpose served by this requirement is to provide adequate open space areas around industrial structures for aesthetic and firefighting purposes. Section 205.134, 4B, requires a minimum side yard width of 20 feet. Public purpose served by this requirement is to provide for aesthetically pleasing open green divider areas, maintain clear access for firefighting equipment, and reduce conflagration of fire. B. STATED HARDSHIP: "We want to add an addition to an existing building with substandard setbacks. This was partially caused by the property taken for East River Road development." Appeals Commission Meeting-'August�25; 1981 Pie 4 _....r.. - C. ADMINISTRATIVE STAFF REVIEW: This is an old converted service station. Much of its present parking and hard surfaced area lie within the right of way of East River Road. It appears that if the City grants these variances, the owner has agreed to dress up the premises with the removal of same of the blacktop and put in some green areas and landscaping. If the Board recommends approval, we suggest that they stipulate that the owner work with the City Planning Department to establish a landscape plan and improvement schedule. Mr. Roy Taylor, 9890 gighway 651 Mr. Dennis DeMars, 8340 East River Road, and Mr. Larry Machee, were present. Mr. DeMars showed the commission the plans of the area. Chairwoman Gabel asked about the big yellow steel structure and Mr. DeMars explained that is where they are going to put up their sign and it will be covered soon. She then asked about the other sign -type structure and Mr. DeMars said that will be taken down. He also said the gas pump islands are going to be planters. Chairwoman Gabel asked if they will still have the drive-thru access and Mr. DeMars said no, the city wants to block that. Mr. Barna stated they don't want thru-traffic coming in and turning around. Mr. Barna asked if their trucks will be turning around at the south end of the building. Mr. DeMars said yes, and they will mark off space for parking but they do not have a lot of walk-in business, it is done mostly over the phone and at the job site. Chairwoman Gabel asked what are they going to do to improve the appear- ance of the building. Mr. DeMars said it is going to be a solid -block building and they will be putting flowers in front of it and there is going to be graphics in front of the building. Mr. Taylor said, until recently, they could not get a permit for putting up a sign because it was a non -conforming area. Chairwoman Gabel asked how it was non -conforming. Mr. Taylor said it was because no one moved into the building within 90 days after the North Star station moved out. Mr. Taylor said they had to be there a certain length of time before they could do anything else. Mr. Clark said the Minneapolis Water Works is behind the building and the Metro- politan Sewer Board is to the south. Chairwoman Gabel noted that they have not heard from any of those people. Mr. DeMars said they abandoned the alley and he took half of it, about 12 feet and there is also a road there that is hardly used. Mr. Clark said actually they are all existing variances and Mr. Barna said the only thing they would be doing is extending the rear yard. Chairwoman Gabel noted that it would be plenty of parking for that type of business. Mr. Clark stated they have been working with Mr. Boardman on this. Chairwoman Gabel asked when they would be starting. Mr. Taylor said they would start as soon as they get the variances and before the cold season sets in, to prevent additional construction costs. Mr. Taylor said they store things in the back and the old light stand will be taken down. Chairwoman Gabel asked if they had any problems with the landscaping. Mr. DeMars said they will be working with Mr. Boardman closely on this and, now that they can afford to do something, the area will look nice. Mr. Barna asked about the graphics on the building.
