Councilman Liebl suggested that the building permit state that this is not the proper zoning. The City Attorney said that in effect the Council would be waiving the pro- vision that you cannot expand on non -conforming use when they authorized the building.permit for the garage. He pointed out that if Mr. Bistodeau wanted to sell for commercial purposes he ran the risk of possibly not getting the money back that he has spent on the garage. Mr. Bistodeau said that he realized this, but he planned on living there and needed this garage. MOTION by Councilman Harris to authorize the building permit for a garage with the stipulation that the owner understands this is a non -conforming use. Seconded by Councilman Liebl. Mr. Bistodeau acknowledged that he understood this. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously. • RECEIVING PRELIMINARY PLANS A14D COSH' ESTIt3ATES - ADDITION TO CITY GARAGE: The Acting City Manager introduced Mr. Patch, the architect, to the Council.. Mr. Brunsell said that Mr. Patch has taken the requests submitted by the Parks and Recreation Department and the Public Works Department and has drawn up three proposals for adding onto the City garage in different ways. The size of the addition has been cut from the original request. The Acting City Manager showed the Council the three plans and explained what would be included. Councilman Liebl asked if it would be the same type of construction as previously, and what the cost would be. Mr. Patch said that it would match the construction of the existing building and that the preliminary cost estimate was $16 per square foot. Councilman Liebl asked if the building would be complete at $16 per foot. Mr. Patch said yes. Mr. Dick Harris asked if this price would include landscaping, blacktcpp�ng and all the other requirements the Council asks of other builders, or would they be running hose from fire hydrants as they did before. He said that the City paid $14 a square foot for the original building and had not gotten all the floor poured. Dir. Harris felt that the new.addition should be cheaper than $16. The Council reminded him that these were just preliminary cost estimates, and that the City does everything by bids, and it will be awarded to the lowest responsible bidder. Councilman Kelshaw asked if these plans would go before the Building Standards - Design Control Committee. Mayor Kirkham said that the original building plans had gone to the Board, but this would be just matching the original. The Acting City Manager said that the 1971 budget provides for the pre- liminary plans. They have brought it before the Council to get approval of the concept so that final plans can be drawn and bids let this year, if the Council desires, so that it can be built in 1972. Councilman Liebl asked the City Engineer if all the concrete has been poured in every stall in the present garage. The City Engineer said yes. CONSIDERATION OF REMODELING OF THE COURT FACILITY AND THE LEASE WITH ANOKA COUNTY: The City Manager explained the various types of improvements that would be made to the portion of the Civic Center which is leased to the County for the Municipal Court functions. He said the improvements must be approved by the City and the recommendation of the Administration would be to not require the County to restore the area to its previous condition. He said the Administration recommendations would be to: 1. %approve the improvements of remodeling the court facilities, that the City would pay for the improvements at the termination of the lease, and the County not be required to restore the area to its original condition. 2. That the lease that was agreed to in 1969 be updated and negotiated with the County for an increase in rental funds. He said the average cost for rental of facilities of this type would be in the range of $5 per square foot, and he believed this rental should be increased to this amount. The City Manager said he had talked to the people in the Administrative offices at the County and also to the County Commission Chairman, Mr. Al Kordiak, and they seemed to be in agreement with the amount. K; mentioned, this area is being rented to a public body and the City should try to be fair. Mayor .Liebl asked how much the office space was being - rented for currently. The City Manager said this wouldrange from $4 per square foot to :$6 per square foot. He said he felt the rented portion was fairly nice and his recommendation would be that this rent for $5. Councilman Utter said 25¢ of each of the County tax dollars comes from Fridley. He agreed that the rent should be raised to the $5 per square foot. Councilman. Utter stated the planned remodeling will not be visible from the exterior of the office area and would include mostly painting and redecorating.
