Planning Commission and grant special use permit, SP =05 with the
stipulation that the petitioner meet the elevations fthe flood plain area
and the berming requirement as stated by the Cit gineer. Seconded by
Councilman Schneider.
Mr. Malone, the petitioner, stated the ng Commission never mentioned
the requirement for a 15 foot earth rm.
Mr. Flora stated certain r is must be met if you are building in the
flood plain area to satis rat regulations.
Mr. Qureshi, City ger, stated the special use permit could be approved
with the stipu ions and if something can't be worked out with the
petitioner, would be necessary to casae back to the Council.
UPON A ICE VOTE TAKEN ON THE ABOVE MOTION, all voting aye, and Mayor Nee
decl ed the motion carried unanimously.
Nair. Flora, Public Works Director, stated this is a request for a Spedal use
permit in order to construct a second accessory garage to the rear of this
property. He stated there currently is an attached garage to the dwelling
and the owner wishes to add a 528 square feet addition and all setback
requirements will be met.
Mr. Flora stated the Planning Commission recommended approval with the
stipulation that the driveway to the new structure be paved.
MOTION by Councilman Fitzpatrick to concur with the recommendation of the
Planning Commission and grant special use permit, SP #84-06 with the
stipulation that the driveway to the new structure be paved. Seconded by
Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee declared
