I am familiar with this project and I don't know if this should be handled by you or through our League of MN Cities
insurance carrier. Your name had been given to them because they asked for the name of the City's attorney.
Here is some background on the street first.
The utilities (water and sewer) were installed in 1954 and the original street within the next few years. The utility
connections were stubbed out past the edge of the street, but not all the way to the right-of-way line. In 1978, the street
was upgraded to include widening and the addition of curb and gutter. As a result the utility stubs ended about even with
the edge of the new concrete curb. We have encountered this situation at several locations in the neighborhood.
What happened this past spring.
We gave copies of the as-builts to the contractor and also marked the approximate location of the services on the
curb. The sewer service lined up with a large chinese elm tree in the boulevard. The tree was somewhat storm
damaged but still alive and healthy. The contractor asked if the City would take the tree down since it was in the way to
connect to the sewer service. I explained that we would take it down but he would have to wait for our tree contractor to
come in and that this could take up to two weeks. He asked if we would allow him to take it down because he did not
want to wait and I gave him permission to do so with the understanding that he would be responsible for the costs, not the
City. After the tree was down, he began to excavate for the sanitary sewer connection. The contractor did not excavate
into the street looking for the service connection. When it was not immediately found, he asked permission to install a
new tap on the sewer main since the stubbed connection did not line up with the sewer service exiting the house anyway,
again I allowed it.
The City did the street patch using our own crews and had the curb and gutter repaired under our annual contract.
The 36.1 sq. yard street patch would normally have cost $1233.33 and the 15 it curb repair would have cost $202.50.
At no time was there a separate representative for the homeowner present during our discussions. All discussions
were between the contractor and myself or my Inspector. The tree was a boulevard tree and therefore the property of the
City, not the homeowner. In other instances where there was no service connections available and the homeowner has
had to have new taps installed, we have waived the connection assessment fee. I offered to refund the original sewer
connection assessment of $860.58 for this lot when the homeowner first approached me with the bill from her contractor,
but she felt that was not enough and asked for the name of the City attorney instead. That was the last I heard on the
matter.

Per Section 1402, 1997 Uniform Building Code, requires that a weather resistive
barrier be placed over exterior sheathing to protect the interior wall covering.
Exceptions for this provision would be if sheathing is an approved weatherproof
