Fridley, MN 5543 CITY COUNCIL November 21, 1985 ACTION TAKEN NOTICE On November 18, 1985, the Fridley City Council officially approved your request for a special use permit, SP #85-12, to allow a different commercial use in an S-1 zoning district (special zoning district for Hyde Park) located on Lots 27 and 28, Block 12, Hyde Park, the same being 5973 --=:3rd Street N.E. with the following stipulations: 1. Make exterior improvements to building, as per plan, by May 1, 1986. 2. Petitioner to lease a portion of Lot 29, approximately 1,604 square feet, from the City as per plot plan. The lease arrangement to include a provision of $1.00 per year for a period of three years after which time the City can terminate the •lease with a one-year notice. (City attorney to draft lease) 3. Provide parking area as per plot plan by City with concrete curbing and asphalt paving by July 1, 1986. 4. Provide landscaping as per plot plan by City by August 1, 1986. 5. Provide a sound insulated chamber for compressor prior to occupancy. 6. Provide a site improvement performance bond in the amount of $5,000 prior to issuance of a building permit. 7. Expansion of the proposed business including the addition of a printing press or building additions will require a special use permit review. 8. Employee parking needs should not exceed eight stalls at any one time, unless additional parking is made available. 9. This special use permit for the proposed business only. BY ADERIAN SMITH• Mr. Flora, Public Works Director, stated this proposal is to allow a printing plant at 5973 - 3rd Avenue. He stated the business previously at this location was The Energy Shed. Mr. Flora stated the property is in an S-1 zone in the Hyde Park area. Mr. Flora stated the petitioner agrees to make substantial site improvements, and the Planning Commission recommended approval with nine stipulations, which he outlined. Councilman Goodspeed stated the stipulation that the City should sell land to S-1 zoned property was in violation of the spirit of the S-1 zoning in that these businesses shouldn't expand. Councilman Fitzpatrick stated he agreed with Councilman Goodspeed on expansion of non -conforming uses which they would have if the petitioner were to buy the City land. He stated if the petitioner were to purchase this land, he believed it would affect a number of the stipulations. He stated the question he had was if the petitioner, Mr. Smith, wishes to purchase this City property. Mr. Smith stated he did not. Mr. Qureshi, City Manager, asked Mr. Smith how many parking spaces he needed in order to conduct his business. Mr. Smith stated six to eight cars would be there cn any given day. Mr. Qureshi asked Mr. Smith how he intended to provide the parking. Mr. Qureshi stated the question really is if this is an improvement to the building. He stated, if it is, he felt there should be curbing to make it look presentable. Councilman Schneider stated if City land is used, it precludes anything being built on the slip -off. Mr. Flora stated there has been some discussion before the Planning Commission about the City closing off the Sl ip-of f . Councilman Fitzpatrick stated there were statements to the effect that the purpose of the S-1 zoning was to return the area to residential. Mr. Smith stated he was in agreement with the stipulations made by the Planning Commission and would work with the City regarding the parking and landscaping. Mr. Flora stated staff can work with Mr. Smith to bring the property closer into code compliance, without him acquiring additional property frau the City. Councilman Goodspeed stated he did not want additional land given or sold to the petitioner, but he would not be opposed to his leasing it.
