Mr. Flora, Public Works Director, stated this lot is the last lot on
Jackson Street and is a deadend street with a cul-de-sac. He stated the
petitioner is requesting a special use permit for construction of a second
Wage,
Mr. Flora stated the original plan was for the petitioner to convert the
existing garage into living space, however, he now requests the use of
both garages for storage purposes.
Mr. Flora stated the Planning_ Commission leas recommended aproval of this
special use permit to allow the construction of a second accessory
building.
MOTION by Counclman Schneider: to concur with the recommendation of the
Planning Commission and grant special use permit's, SP #82-08 to allow for
the construction of a second accessory building at 6271 Jackson Street.
Seconded by Councilman,,Barnette. Upon a void vote, -all voting aye, Mayor
Nee declared the motion carried unanimously.
Mr. Flora stated, in conjunction with approval of the request for a
special use permits, a variance is requested to reduce the.,front yard
setback from the required 35 feet to 11 feet.
MOTION by Concilman Schneider to concur with the recommendation of the
Appeals Ccmamission and grant the variance to reduce the front yard setback
from the required 35 feet to 11 feet. Seconded by Councilman Barnette.
Upon a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously.

$ A gentleman representing S & R Investment Company stated the variance
�N doesn't really have anything to do with the building permit. He stated
their plan was to have attached garages, which would have been on part of
the setback, but then the City decided they would rather have tuck -under
garages. He stated they have changed the plan and will have tuck -under

garages and, therefore, wouldn't be on part of the setback.
Mr. Flora, Public Works Director, stated a portion of the parking lot
would be on the property requested to be vacated, therefore, it would be
associated with the building permit.
Mayor Nee stated, if this is the case, they can't preempt this vacation
proceeding. Upon a voice vote on the above motion, all voting aye, Mayor
Nee declard the motion carried unanimously.

As you know, we have proposed the construction of a 4 unit
town homes on the vacant lot located at ' 600 4th ST NE. In order to
do this we had applied for the vacation of easement & varience on
about June 10,1982 which is still in process. Now are getting closer
to the end of the sumner season and if we couldn't start the construc-
tion with out losing further time we may not be able to complete this
project before the winter sets in
We therefore request the city council to give us
construction permission prior the second & third reading of the
ordinances,

notice and open the public nearing. Seconded by Councilman Barnette. Upon
a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously and the public nearing opened at 7:35 p. m.
Mr. Flora, Public Works Director, stated this property in question is
located nortneast of the intersection,ot I-594 and University Avenue.
Mr. Flora stated, in conjunction with the vacation request, variances are
requested for the tront and side yard setbacks. He stated these requests
nave been approved Dy the Appeals commission and recommended, through the
Planning Coamussion, for Council approval with the tollowing stipulations:
(1) the petitioner work with the City on the landscape plan; (2) screen the
recuse containers; (3) stripe the outside parking stalls; and (4) the City
retain a 10 foot boulevard easement along the service drive.
Mr. Flora pointed out the parcel of property being vacated allows for a
boulevard along the service drive so there is rat a need for an additional
ten teet for boulevard easement in that area.
Mr. Flora stated the variance requests are to reduce the tront yard setback
trom the required 35 feet to 30 feet which would line tnis building up with
the rest of the properties on 4th Street. He further stated the side yard
variance is tram the required 35 feet to 25 feet, but in order to align
this structure with the otners on the Fast side of 4th Street, the variance
,tor the side yard should not be less than 16.25 feet. Mr. Flora stated the
xe6amnendatlon made by the Appeals Camassion essentially states the side
1jaid setback be in line with the structure to the East side of 4tn Street,
but not closer than 16.25 feet to the property tine.

Mr. Flora, Public Works Director, stated, as discussed earlier in the
meeting, during the public nearing, the variances requested are to reduce
the tront yard setback tram the required 35 feet to 30 feet and reduce the
side yard setback tram the required 35 feet to 25 feet. Mr. Flora stated,
during discussion by the appeals Commission at the public hearing, it was
telt the side yard setback for this structure should be no closer than
16.25 feet in order to align this building with the other properties on the
East side of 4th Street.
Mr. Flora stated the Appeals Cmmission and the Planning Commission Dotn
recommended approval of the variances with the toliowing stipulations: (1)
the petitioner work with the City on the landscape plan; (2) screen the
recuse containers; and (3) stripe the outside parking stalls. He explained
a tourtn stipulation for a ten foot boulevard easement, therefore, an
additional ten feet is not required.
Councilman HamerniK asked statt it tney were comfortable with a side yard
setback of 16.25 feet. Mr. Flora stated the plan for the building provides
for a 25 foot setbacK, however, the Appeals Commissions action was that
this structure be no closer than 16.25 feet so it gives the developer some
tlexibility.
Councilman HamerniK stated wnat he is saying then iS, that the building be
no closer than 16.25 feet, but it does not nave to line up with the other
properties. He stated the only reservation ne has is it the City has
enougn control.
Mr. Flora stated, as long as the approval indicates the side yard setback
should be no closer than 16.25 feet, staff has no problem with it, but they
wouldn-t want it any closer.
MOTION by Councilman Hamernik to approve the variances, as recommended by
the Appeals Ummission to reduce the tront yard setback trom the required
35 feet to 30 feet and to reduce the side yard setbacK tram the required 35
feet to a distance not less than 16.25 feet, with the following
stipulations: (1) the petitioner work with the City on the landscape plan;
(2) screen the retuse containers; and (3) stripe the outside parking
stalls. Seconded by Councliman Schneider. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.
