TXGNI J.MGMR V "T- a L ki a Ft he City Manager read the motion by the Parks a" Recreation Commission informing he City Council of a trade requested by Mr. Jaeger who is interested in trading five lots in Riverview Heights for Lot 10, Block 3 in Hamilton's Addition. The City Attorney said that there may be a problem in this, in that if the City gets title from the County for the property in Hamilton's Addition, they would have to acquire it for public purposes only. He said that, if the City is interested, Mir. Jaeger should get title to the property, and if the Council wants the property to Riverview Heights, they could probably buy it for the cost of the Special Assessments on the Hamilton's Addition property. It was understood that Mr. Jaeger wanted to trade so he could acquire the Hamilton's Addition property free of special assessments, and then would deed the lots in Riverview Heights to the City. The City Manager pointed out that the County is not putting any property on sale except to the City, and if it goes on public sale, Mr. Jaeger may not get it. The City Attorney said that this is just a 40 foot lot in Hamilton's Addition and is not a buildable lot, but would be of value to Mr. Jaeger as it is adjacent to his property. Mayor Kirkham suggested that this matter be pursued to see what arrangement can be made. These uses are typically limited to single family, two family, or multiple family dwellings. Per section 102 of the 1994 Uniform Building Code which states in part, any structure that constitutes a hazard to safety, or health, or welfare, shall be considered unsafe. All unsafe buildings shall be declared a public nuisance and shall be abated by repair or demolition as referenced in the Dangerous Building Code. Section 302 of the Dangerous Building Code states that any building or structure which has any or all of the conditions or defects herein described shall be deemed a hazardous building, provided that such conditions or defects exist to the extent that the life, health, property or safety of the public or its occupants are endangered. The following items deem the building to be dangerous: 1) Whenever any portion thereof has been damaged by fire, earthquake, wind, flood, or by any other cause, to such an extent that the structural strength or stability thereof is materially less than it was before the catastrophe and is less than the minimum requirements of the Building Code for new buildings of similar structure. 2) Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached or dislodged, or to collapse and thereby injure persons or damage property. 3) Whenever any portion of a building, or any member, appurtenance or ornamentation on the exterior thereof is not sufficient strength or stability, or is not so anchored, attached or fastened in place so as to be capable of resisting a wind pressure of one half of that specified in the Building Code for new buildings of similar structure, purpose or location without exceeding the working stresses permitted in the Building Code for such buildings. 4) Whenever any portion thereof has inracked, buckled or settled to such an extent, that walls or other structural portions have materially less resistance to winds or earthquake than is required in the case of similar new construction. s Mr. Chuck Jaeger Re: 5601 4 St NE October 7, 1996 Page 2 5) Whenever, for any reason, the building or structure, or any portion thereof, is manifestly unsafe for the purpose for which it is being used. 6) Whenever the building or structure, exclusive of the foundation, shows 33 percent or more damage or deterioration of its supporting members or 50 percent damage or deterioration of its nonsupporting members, enclosing or outside walls or coverings. 7) Whenever the building or structure which, whether or not erected in accordance with all applicable laws and ordinances, has in nonsupporting part, member or portion less than 66 percent of the strength, fire resisting qualities or characteristics or weather resisting qualities or characteristics required by law in the case of a newly constructed building of like area, height and occupancy in the same location. 8) Whenever any building or structure, because of obsolescence, dilapidation, deterioration, damage, inadequate exits, lack of sufficient fire resistive construction, faulty electric wiring, gas connections or heating equipment or other cause, is determined by the Fire Marshal to be a fire hazard. 9) Whenever any building or structure is in such a condition as to constitute a public nuisance known to the common law or in equity jurisprudence. Per Section 403 of the Dangerous Building Code, you are hereby ordered to demolish the entire structure, including the foundation, because of the extreme damage to the building. Demolition shall be completed with 60 days from the date of this letter. The building has been posted as a unsafe building. Per your letter dated October 3, 1996, the City has boarded the building, and will bill you for the expenses for securing the building from trespass. The building shall remain secure until demolition is completed. Prior to demolition, a wrecking permit must first be obtained from the City.
