Therefore, it staff recommendation that the request be denied, or if approved, no windows be allowed along the east side to maintain some degree of rear yard privacy for the lot to the east, also that the south setback* should be approved. Nr. Clark said that he had talked to Karla Blomberg, who is the developer of the property on the South side of this house, and she said she had no objection to the variance being granted. Mrs. Gunnick said that the present 12' by 24' living area was not large enough for her wheel chair to move around in, and if there were other people in the room, it became too congested. Mrs. Kurtznolan, owner of the property to the east side of the house, said that she did not object to the addition to this house. Her house sits north of this house, and her lot is over 300 feet long. Even if Mrs. Kurznolan were to split off the south half of her property, the lot was over 100 feet wide and it was felt that any new house could be placed so as not to be bothered by this addition. (The new lot would be approximately 150' x 100'). Mrs. Karla Blomberg spoke in favor of the addition .and showed the Commission members the house plans. Mrs. Schnabel asked if the proposed addition would be appoximately the same size of the existing deck? Mrs. Gunnick said it would be as wide (12') bur would be about 2 feet shorter. Mrs; Schnabel asked if the trees growing behind the deck, and serving as a screen from the property to the east, were on the lot line. Mrs. Gunnick said yes, they were on the property line. Mrs. Schnabel asked Mr. Clark if, in view of the'comments of the neighboring property owners, the staff would withdraw their objections? Mr. Clark replied that yes, the objection would be withdrawn, especially in light of the large lot size of the property to the east. MOTION by Ms. Gabel, seconded by Mr. Barna, to close the public hearing. It should also be noted that they could add 12' to the north of the family room or -6 feet to the east without a variance. X. Ms. Gabel said that the. Council and. Planning .Commission should decide how,:.,, these situations should'be handled in the future. Mr., 2wk stated the special use permit process could be used to allow; for. two=family dwellings in,k l zoning. Mrs,,. Schnabel said that the problem with special use permits was that the burden of approval was pub on the City, ,.instead of the petitition,;where,it should be. Ma.. Gabel felt that the burden of approval should be on the petitioner, especially in these conversion appeals situations. The Commission -,members discussed various problems assocated.,with-providing additional housing and with converting R-1 single family homes into two family homes. MOTION.by Mr. Plemel, seconded by Mr. Barna, to,,have the Planning Commission set up'a policy to determine the terminology to be, used on a single-fami�.y. dwelling ,to..be. converted into a two-family •dwelling, and that there 'sheuld- fie a policy to determine decisions on such cases. He stated the Appeals Commission felt ,therefore, this was a self-inflicted hardship, as the variance wouldn't beXieeded if he had kept all the property. Councilman Fitzpatrick stated this applicant previously ap ied for a variance, which was granted, to reduce the area of the lot from 9, 0 to 7,800 square feet rhich is already below the requirement for a sing family dwelling and he no wants to make this dwelling into a duplex. Mr. Ki the applicant, stated the land to the S th was sold, however, he wasn't a sole owner of the property. He felt a codes of the City really don't ap ly themselves to a basement unit and oes not look at this as a duplex. Councilman... itzpatrick stated he hesitate move for denial as he realizes Mr. King is urrounded by multiples, but elt this is a sub -standard lot and would be a su -standard floor area and at the hardship was self-inflicted. MOTION by Counci man Fitzpatrick to oncur with the recommendation of the Appeals Commissioh,and deny the r uest for variances to 1) reduce the square footage for a doubl bungalow f 10,000 to 7,800 square feet; 2) to reduce the required garage s lls fro 3 to 2 stalls; and 3) to reduce the floor area from the required 0 s are feet to approximately 590 square feet. Councilma Fitzpatrick felt, in this particular case, the City does ha a policy, owever, another area might be if the owner of a single family hom had a rge enough lot and floor area to be considered for use as a double bunga ow. Mr Flora stated the Planning Commission is reviewing the Zoning Ordinance and m ing certain changes in these areas and he would make a note to include this atter in�their discussions. / - CONSIDERATION OF VARIANCE REQUEST TO REDUCE SIDEYARD TO ALLOW CONSTRUCTION OF A SIX UNIT APARTMENT BUILDING, 5450 -5TH STREET, RICHARD TRACZIK: MOTION by Councilman Fitzpatrick to concur with the recommendation of the Appeals Commission and grant the variance to reduce the side yard setback from a side street of a corner lot from the required 35 feet to 32 feet to allow construction of a six unit apartment building at 5450 - 5th Street. He felt this policy would serve as es f various units of City gove int. 184 REGULAR MEETING OF JULY 7, 1980 PAGE 6 Councilwoman Moses felt, as she looks at it, there would have to be some change in the language so that it would be more of a guideline. She felt there are a lot of items covered in the policy that probably aren't economically feasible. She stated the scope of energy is far-reaching in order to get to businesses and residents and asked if it was the Commission's intent to have.a full-time employee to carry out the policy. Mr. Wharton stated there was consideration given to have someone in administra- tion accountable for energy policy. He felt it should hinge on what the County was doing and, if they had an Energy Coordinator, possibly the City wouldn't i require such a full-time endeavor. J Councilwoman Moses felt it would entail a full-time person to carry out these policies, but didn't want to upset the Commission if they didn't have a person to handle the items covered in the policy. Councilman Schneider asked if it was the Commission's intent that the item - covered in the policy would be the things they would be checking into and reviewing. Mr. Wharton stated the intent, at the time, was that various departments in the City look at these individual items to see how they fit and what would be the impact on them. Mr. Wharton felt, once guidelines were received and it is stated what type of things the City should be considering, he believed the Commission would then work in conjunction with the various departments to help.them establish their own procedure for energy conservation. i Councilwoman Moses felt some documentation is needed, if the City were to pro- ceed with the items outlined in the policy, on the costs involved. Mayor Nee thought perhaps the Commission would help weigh the different sug- gestions before they were actually put into policy and asked what the Commission would like from the Council. Mr. Wharton stated what the Commission is looking for is for the Council to say they basically agree, in principle, with this policy and would like to see the I various departments initiate some action on.how they are going to establish energy conservation. He felt if the departments feel they need some assistance in these areas, the Commission would be happy to work with them. Mayor Nee stated administration could redraw this and it probably would be basically the same, but more flexible. Mr. Wharton felt this would be satis- factory with the Commission. MOTION by Councilman Barnette to accept the theory behind the Energy Commission"s policy statement, as presented.to the Council, and refer the policy to staff for rewording into a set of guidelines which the Commission could follow, with this recommendation back to the Council by July 21. Seconded by Councilwoman Moses. Mr. Wharton stated they would like to hear from staff if there are certain items that are totally unacceptable.
