ADMINISTRATIVE STAFF REVIEW
5618 - 5th Street N.E.
A. PUBLIC PURPOSE SERVED BY REQUIREMENT: Section 205.053, 4B, 10 foot side
yard adjoining living area
Public purpose served is to maintain a minimum of 20 feet between living
areas in adjoining structures and 15 feet between garages and living
areas in adjoining structures and to reduce exposure to conflagration of
fire between structures and to allow for aesthetically pleasing open areas
around residential structures.
B. STATED HARDSHIP: Family requests extension of existing kitchen for more
living area.
C. ADMINISTRATIVE STAFF REVIEW: The verifying survey in the file shows that
the house at 5618 - 5th Street N.E. is located less than 10 feet from the
common property line to the south, which would make this house an existing
non -conforming use. Verifying surveys indicate a 5.6' setback from 5618 -5th
Street to the south property line, and a 4.2' setback from the garage at
5614 - 5th Street to the north property line. Field measurements by the
staff show the distance between these two structures and a common line to
be a total of 7.5' which is 2.3' less than the verifying survey distances
of 9.8 feet. In other words, a discrepancy in the surveys exist. The
petitioner has submitted a mortgage survey which doesn't correspond to the
registered land survey for the same lot. The registered land survey would
have to be considered the more valid of the two.
Therefore, we have a request for a variance of 3 feet which covers the
least possible distance of the house to the property line whichever survey
is being used.
If this variance is approved, staff recommends that there be no opening
in the south wall, and that it be a firewall.

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.153, 2, front yeard setback of no more than six (6)
feet from average front yard setback (when greater than 35 feet).
Purpose served is to allow for off-street parking without encroaching
on the public right of way, reduce the "building line -of sight"
encroachment into neighboring yards and preserve the aesthetic
considerations of the neighborhood.
B. STATED HARDSHIP:
Family requires more living space and an additional bedroom.
C. ADMINISTRATIVE STAFF REVIEW:
Available verifying surveys of neighborhing lots show the average
setback to be 43 feet. Therefore a setback of 37 feet is allowable.
5618 5th Street is setback 46.7 feet from the front lot line. The
14 foot proposed addition would then come within 33 feet of the
front property line. This would put the addition 3 feet in front
of the house to the North. Staff feels that the neighbor's feelings
about the reduced line -of -sight should be considered first.
Staff has no objection to this variance request being granted.
