On August 26, 1996, the Fridley City Council officially approved your request for a
variance, VAR #96-17, to reduce the side corner setback of an attached accessory
structure facing the street from 25 feet to 10 feet, to allow the construction of an 8' x
24' garage addition on Lot 1, Block 14, Hyde Park, the same being 5980 - 5th Street
N.E.
You have one year from the date of City Council action to initiate construction. If you
cannot begin construction in time, you must submit a letter requesting an extension at
least three weeks prior to the expiration date.

Mr. Hickok, Planning Coordinator, stated that this is a request for
a variance to allow an 8 foot by 24 foot garage expansion for the
property located at Fifth Street and 60th Avenue. The variance
would be for the setback along 60th Avenue.
Mr. Hickok stated that the code allows that garages with doors not
opening onto the side street can be as close to the right-of-way as
17.5 feet. The overhead door could be relocated to the west end of
the new garage and minimize the size of the variance required.
Staff recommends this option with several stipulations to reduce
the size of the variance.
Mr. Hickok stated that the Appeals Commission recommended approval
of the variance without the stipulations.
Councilman Billings stated that there are ten foot setback's with
the exception of the" south property line which has a 7.5 foot
setback. He commended staff for trying to come up with an
alternative to minimize the variance. However, in this particular
case, the size of the lot creates a future hardship in that it
takes away almost all the useable space of what would normally be a
back yard. He supported the recommendation of the Appeals
Commission on this variance.
MOTION by Councilman Billings to concur with the recommendation b f
the Appeals Commission and grant Variance Request, VAR #96-17 with
no stipulations. Seconded by Councilwoman Bolkcom. Upon a voice

preliminary draft budget meets the re ements of the City Charter
and the state statutes regarding ruth in Taxation. Budget
appropriations for 1997 are as f ows: General Fund, $10,029,705
(2.44 percent increase); Spe 'al Revenue Funds, $889,197 (9.240
increase); Capital Projec Funds, $1,369,140 (2.420 increase);
Agency Fund, no change f m 1996. The total budget is $12,293,950
or a 2.9 percent incre e over 1996. The tax levy would remain the
same.
Mr. Pribyl state that the total budget will be presented in detail
at the Truth iX Taxation hearing this fall.

Mr. Knaak stated that as a practical matter, 'perhaps this could be
done. It is of unheard of that applicants are required to
compensate for losses incurred. This may be worth examining, as
the issue has been well researched. He would be happy to provide
staff with a emorandum on some of the options.

PERRETEN - 5980 5TH STREET N.E. VARIANCE
DESCRIPTION OF REQUEST:
1Vrchael and Sherry Perreten have requested a variance to allow an 8' X 24' garage expansion. The
property is looted at the corner of 5th Street N.E. and 60th Avenue N.E. The setback of the existing home
and garage is 10' along the 60th Avenue property line.
HARDSHIP STATEMENT: (See body of text)
SUMMARY OF ISSUES:
Code Section 205.07.03.(D), states, "The side yard width on a street side with a corner lot shall not be less
than seventeen and one-half (17.5) feet". Code continues by stating, "Any attached or unattached accessory
building which opens on the side street, shall be at least twenty-five (25) feet from the property line of a
side street". The Peireten's request relates to the 25' setback requirement because the garage opens on
the street side. The existing attached garage is a single car design that opens onto 60th Avenue N.E.
A 1965 reconstruction of a tornado damaged home (on this substandard sized lot) has left few options for
a garage expansion today. According to the setback requirements in effect at that time, two 10 foot side
yards were required. No additional setback was required for a corner lot. Current Code requirements
state: Garages with doors not opening onto the side street can be as close to the right-of-way as 17.5'
(rather than 25). The layout of the Perreten site is such that the overhead door could be relocated to the
west end of the new garage. This would minimize the size of variance required and allow the Perretens
to expand their garage to two cars, while decreasing the impact of cars backing directly onto the street.
The request is then also within range of previously granted variances.
The Perretens have indicated that the staff recommended alternative is not one they would favor, as they
were hoping to utilize their existing drive with little or no modification.
RECOMMENDED CITY COUNCIL ACTIONS:
Staff recommends approval of VAR #96-17 with the following stipulations: 1) The garage be reoriented
to allow access through a relocated overhead door on the west end of the garage, 2) A new hard surface
driveway shall be installed within 1 year of City Council approval of this variance, 3) The existing driveway
shall be removed and replaced with sod or landscape plantings.
APPEALS COMNIISSION ACTION:
The Appeals Commission recommended approval of VAR #96-17, without the staff recommended

May 26, 1965 - The property owner from 5980 5th Street N.E. stood before the
Appeals Commission requesting a variance to rebuild the home demolished by the
tornado.
June 21, 1965 - The City Council approved a variance to allow a side yard variance
of 2.5' allowing a 7.5' side yard. At that time the Council also approved a front yard
variance to 10'.
October 29, 1965 - A building permit was issued for a house and garage.
July 15, 1996 - A variance was requested to allow expansion of the existing single car
garage.
Elsewhere in the City...
1990 - The City granted a side yard variance to 15', for a garage that open onto the
side street.
1995 - The City approved reconstruction of a garage 6" from an unimproved side
street. In that instance, the garage did not open onto the side street right-of-way and
the City Council cited the unimproved right-of-way as the unique features that
supported their approval.
Code Section 205.07.03.(D), states, "The side yard width on a street side with a comer

Mr. Hickok stated the subject parcel is located at the comer of 60th Avenue and 5th Street.
The request is to allow the expansion of a garage and a expansion of the existing setback
which is 10 feet from the existing right-of-way along the 60th Avenue property line. The
petitioner is proposing to add an 8 -foot x 24 -foot addition to the western face of the
existing garage and to rework the garage structurally to accommodate 2 vehicles. In
looking at the request, staff looked at the code sections that apply to setbacks on comer
lots and noted that the setback requirement for a garage on a comer when the garage door
faces the street is 25 feet. If the garage were positioned so it was not facing the street, it
could be as close as 17.5 feet to the street right-of-way.
Mr. Hickok stated the home constructed prior to 1965. A different home was on the site
at that time which was damaged beyond repair in a tornado. The property owners
requested and received a variance to allow the home to be constructed in this manner.
The variance allowed a 7.5 -foot setback along the south side of the property and allowed
the street side setback of 10 feet that exists today. The building permit was issued and
the house constructed with a single stall garage.
Mr. Hickok stated staff recommends bringing the variance request within previously
granted variances and to approve the variance to the setback with the following
stipulations:
The garage be reoriented to allow access through a relocated overhead door on the
west end of the garage.
2. A new hard surface driveway shall be installed within 1 year of City Council
approval of this variance_

3. The existing driveway shall be removed and replaced with sod or landscape

Mr. Perreten stated he was surprised to see the recommendation to alter the plan. He
would like to see the original plan approved or disapproved. Moving the garage door to
the west side does not change the cost of the structure very much but moving the driveway
around to the west side increases the cost of removing the old driveway and constructing
a new driveway. He would also have a longer driveway to clear of snow in the winter. He
would probably have to back out onto 60th Avenue anyway. He does not see what he
would gain by moving the door to the west side. The house in 10 feet back from the right-
of-way. No use is being made of that right-of-way today. There are two large oak trees
by the end of the west side of the driveway that people would have to come through if the
driveway were changed. He suspects there will not be a sidewalk in front of the house.
Parking cars in the driveway is not blocking anything being used by the public. Their
intention was to widen the garage and replace the asphalt driveway with concrete. That
allows them to park the cars off the street as they have done for the last 23 years.
Dr. Vos asked the, petitioner, if they are going 8 feet to the west, how close will they get to
the large trees.
Mr. Perreten stated he did not understand moving the driveway in order to expand the
existing garage. The existing driveway is wide enough for a car to park to the side of the
existing garage door. The existing driveway is wide enough to serve a two -car garage.
Dr. Vos stated a stipulation was to put the door on the west side so you.would need less
of a variance. If the garage door is placed on the north side, the reduction required is then
less.
Mr. Perreten stated he is not moving anything closer to the street than it was before. It is
the same distance from the street as it has always been. He did not think there were other
ways to expand the garage for the same. amount of money or with the same convenience.
He wants to add one stall to his garage for convenience and make the driveway more
permanent. This will make the dwelling more pleasant and hopefully increase the resale
value of the home. To him, it sounded like an improvement.
Mr. Kuechle stated the problem is the code requires and what should the Commission
allow in the variance.
Mr. Perreten stated the original variance was approved to 10 feet and this request is the
same distance as requested before. The. physical distance between the curb and the

house is 26 feet He has been parking his car in front of the garage for years with space
left over on the end.
Dr. Vos stated the only neighbors affected is the one to the south and to the west. Have
there been any comments from the neighbors?
Mr. Perreten stated he has not heard anything from the neighbor to the west. The
neighbor to the south has another garage at the end of their house.
MOTION by Dr. Vos, seconded by Ms. Beaulieu, to close the public hearing.

Dr. Vos asked if this request would automatically go to the City Council because there was
a staff difference.
Mr. Hickok stated yes, this request would go before the City Council.
Ms. Beaulieu stated she thought there was a hardship because this is a 41 foot lot. With
a 41 foot lot, their options are not as open as with a larger lot. The lot is narrow and that
in itself could be considered a hardship. She did not see this as a detriment.
Mr. Kuechle stated he concurred. It is somewhat of a hardship in that the City allowed the
first variance in 1965 and is now saying they cannot. He can understand the code
requirement and the City has a right to demand a variance be requested. He cannot see
that there is any purpose served by moving the driveway to the west except to meet the
code but the petitioner would still need a variance although to a lesser degree. He would
recommend approval.
Dr. Vos stated, in looking at the suggested driveway, the petitioner would lose more yard.
He did not see any advantage to changing the driveway. The request seemed reasonable
considering the narrow lot. He would recommend approval.

Mr. Hickok stated the request is by the City of F,prdley. Mr. Flora, Director of Public Works,
has requested the variance on behalf of t City to allow a reduced front yard setback
along Highway 65 and a reduced front y d setback along 73 1/2 Avenue. The purpose
of the request to allow the constructi of an addition to the filter plant structure serving
well #12. As proposed, the setba along Highway 65 would be reduced from 35 feet to
30 feet and along 731 /2 Avenu rom 35 feet to 25 feet.
Mr. Hickok stated the City squired this property in 1969 through tax forfeiture. As the
code is written, property wired for a City purpose reverts to a "P", Public Designation,
by City ownership an use of the land. The existing building was constructed in 1970.
Recently, the City ouncil has grappled with water quality and the necessity for an
additional f"trati facility in the City. The City hired a consulting firm to analyze where
the facility wo d be best placed and this site was pinpointed.
Mr. Hic stated a hardship does exist in that well #12 is drilled and the related
equip ent is in place. The filtration building as designed would be matched to the existing
wel ouse. The addition extends the existing building setback dimensions toward the right-
-way. Staff looked at alternatives to construction on this site including stepping the
building back. The issue is not a new building but the existing building with a substandard
setback. Staff also evaluated the alternative of demolishing the existing structure and

Notice is hereby given that the Appeals Commission of the City of Fridley will conduct a
Public Hearing at the Fridley Municipal Center at 6431 University Avenue N.E. on
Wednesday, August 14, 1996, at 7:30 p.m. for the purpose of:
Consideration of variance request, VAR #96-17, by Michael & Sherry
Perreten:
Per Section 205.07.03.D.(2).(c).((3)) of the Fridley Zoning Code, to reduce the
side corner setback of an attached accessory structure facing the street from 25
feet to 10 feet to allow the construction of an 8 foot by -24 foot garage addition,
on Lot 1, Block 14, the same being 5980 - 5th Street N.E., Fridley, Minnesota,
55432.
