(Request by Mr. Robert A. Riese, 6031 - 5th Street N.E., Fridley, Minnesota.) Anyone who desires to be heard with reference to the above matter will be heard at this meeting. WILLIAM A. DRIGANS CHAIRMAN BOARD OF APPEALS r THE MINUTES OF THE BOARD OF APPEALS SUBCOMMITTEE MEETING OF JULY 23, 1974 The meeting was called to order by Chairman Drigans at 7:34 P.M. MEMBERS PRESENT: Drigans, Crowder, Gabel, Plemel MEMBERS ABSENT: Wahlberg OTHERS PRESENT: Howard Mattson - Engineering Aide MOTION by Gabel, seconded by Crowder, to approve the minutes of the July 9, 1974 meeting as written. Upon a voice vote, there being no nays, the motion carried. 1. A REQUEST FOR A VARIANCE OF SECTION 205.053_, 4, B4, FRIDLEY CITY CODE, TO REDUCE THE SIDE YARD ADJOINING AN ATTACHED GARAGE FROM 5 FEET TO 3 FEET, TO ALLOW THE CONSTRUCTION OF AN ATTACHED GARAGE,. TO BE LOCATED ON LOT 8, BLOCK 6, DONNAY'S LAKEVIEW MANOR ADDITION, THE SAME BEING 5724 JACKSON STREET N.E., FRIDLEY, MINN., (REQUEST BY MR. DONALD WINTERS, 5724 JACKSON STREET N.E., FRIDLEY,`MINNESOTA.) MOTION by Crowder, seconded by Plemel, to waive reading the public hearing. Upon a voice vote, there being no nays, the motion carried. Mr. Winters was present to present his request. Mr. Winters explained he wants to build this garage in front of an existing single garage that will remain. He said the proposed garage will be attached to both the house and the existing garage and the stoop on the side of the house will be removed. He said his intention is to build a 2 car garage as he owns 3 cars. Mr. Crowder stated it looks like an engineering feat tying all of the roofs together. Mr. Winters said the front of the existing garage is flush with the back of the house and the proposed garage will be flush with the front of the house. He said the garage roof will look exactly like the existing house roof. Mr. Crowder asked if the existing garage is heated or insulated and if it is to be turned into living area. Mr. Winters said it will be used as garage area and that it is not heated or insulated. Chairman Drigans asked how far the adjoining structure is from the lot line. Mr. Winters said that the structure is approximately 5 feet from the lot line and his existing garage is 5 .et from the line. Mr. Crowder asked if the adjoining house has its !^,!:�drooms on •hat side and Mr. Winters said it did, but that he has talked to Mr. Kruize about the variance and he had no objections. Mrs. Gabel asked Mr. Winters if he realized he had to install a firewall on the outside wall of his gar je. Mr. Winters said he did know about this. Mr. Crowder stated a firewall will also be required between the house and garage that will extend through the ceiling. Mr. Winters said he realized this also. Chairman Drigans asked Mr. Winters what he will do with the existing cement. Mr. Winters said that the cement will stay, except where the footings will be and this will have to be dug up. Chairman Drigans asked Mr. Winters what he will do with the windows on this side of the house. Mr. Winters said he would like to put in a 3 foot walkway between the house and garage and this way he could save the windows. Mr. Plemel asked if that wouldn't defeat the double garage. Mr. Winters said his neighbor has done it but he said he would check with the building inspector on this. Mr. Winters said he would not want to do that. Mr. Crowder asked Mr. Mattson if there was any maximum footage for a residential garage. He thought he had heard it was 1000 feet. Mr. Mattson said the only restriction he knew of was under lot coverage where all buildings cannot cover over 25 percent of the lot. MOTION by Crowder, seconded by Gabel, to close the public hearing. Upon a voice vote, there being no nays, the motion carried. Chairman Drigans stated the hardship seems to be a single car garage and more cars than space. He added there are no objections from the neighbors. Mr. Plemel and Mrs. Gabel stated they had no objections. Mr. Crowder stated he had no objections except to stipulate the firewall be installed on the south wall of the garage and he did question the area maximum of 1000 feet on a garage but these garages would be under that. MOTION by Crowder, seconded by Plemel, to recommend approval to the City Council of the side yard variance from 5 feet to 3 feet because of the problems already stated, and with the stipulation that a firewall be installed on the south wall of the garage. Upon a voice vote, there being no nays, the motion carried. 2. Upon a voice vote, there being no nays, the motion carried. Mr. Robert Riese was present to present his request. Mr. Riese explained he has only 23 feet between his house and the lot line. He said he wants a 20 foot garage for a double garage that will be 24 feet deep. He stated the building inspector had been out to check the deck he is building, so he asked him about the proposed garage. The building inspector said he couldn't go any deeper with the garage because of the hipp roof and he suggested the garage as proposed. Chairman Drigans asked what the condition of the house was.after the tornado. Mr. Riese said it was completely destroyed. Chairman Drigans questioned him not building a garage at that time. Mr. Riese said they needed an extra room at that time and he did not have enough money to build both the room and the garage. lie added he needs the garage now. Chairman Drigans asked if he had considered putting the garage in the back yard. Mr. Riese said he had not as his driveway would be to long. Chairman Drigans asked how far the adjoining structure was away from the lot line. Mr. Riese said the adjoining house is over quite a way and the detached garage is set back farther than he proposes to build his and about 4 to 5 feet from the lot line. Mr. Crowder asked if the cement that is existing is the same size as the proposed garage. Mr. Riese said the concrete is larger, but they will have to pour more on top of it and then dig the footings down. Mr. Riese said it will be 24 inches to match the house. Chairman Drigans was concerned with the drainage off this side of the garage. Mr. Riese added the run-off will drain toward the back of the lot so there should be no problem. Mr. Crowder added that the neighbor might ask that a rain gutter be installed to prevent drainage on his lawn. MOTION by Gabel, seconded by Crowder, to close the public hearing. Upon a voice vote, there being no nays, the motion carried. Chairman Drigans stated the hardship is having no garage. Mr. Crowder added one problem seems to be the window on the side of the house. Mr. Mattson added the firewalls on both the inside and outside walls will have to be installed. MOTION by Plemel, seconded by Gabel, to recommend approval to the City Council of the side yard variance from 5 feet to 3 feet with the stipulation that the firewall be installed on the south wall of the garage. Upon a voice vote., there being no nays, the motion carried. 3. A REQUEST FOR VARIANCES OF THE FRIDLEY CITY CODE AS FOLLOWS: SECTION 205.135, 1, G2, TO ALLOW LOADING FACILITIES IN THE FRONT YARD, AND, SECTION 205.135, 1, E4, TO REDUCE THE SETBACK FOR OFF STREET PARKING FROM THE MAIN BUILDING FROM 5 FEET TO ZERO FEET, AND, SECTION 205.134, 3A, TO INCREASE THE LOT COVERAGE FROM 40 PERCENT TO 43.7 PERCENT, TO ALLOW THE CONSTRUCTION OF TWO WAREHOUSE BUILDINGS, TO BE LOCATED ON LOTS 9 AND 10, AND PARCEL 2500, AUDITOR'S SUBDIVISION #78, AND PART OF PARCELS 10 AND 1200, SECTION 22, THE SAME BEING APPROXIMATELY 120 FEET WEST OF THE WEST LINE OF THE BURLINGTON NORTHERN RAILROAD RIGHT OF WAY, TO THE EAST LINE OF EAST RIVER ROAD; SOUTH TO THE NORTH LINE OF SECTION 22, T-30, R-24, TO APPROXIMATELY 1560 FEET SOUTH OF SAID NORTH LINE, BEING GENERALLY LOCATED AT 5951 AND 6051 EAST RIVER ROAD N.E., FRIDLEY, MINNESOTA. Mr. Mattson explained the applicant asked that this be tabled until the next meeting as they have some problems to work out. Mr. Wentz, with Industrial Development of Burlington Northern and Mr. Brokhof, with the Land Department of the Railroad, were present. Mr. Wentz explained they came to the meeting mainly as spectators to see what the situation is but since the applicant is not present, there is not a great deal they could say tonight. They stated they were concerned with the land that the County is asking to be dedicated and they can see no reason for it so they would like to find out why they are asking for so much. They stated the County -wants 22 feet along East River Road and 60 feet for 61st Avenue. Chairman Drigans asked Mr. Mattson to get the background information on the dedications and to report back at the next meeting. ADJOURNMENT: The meeting was adjourned by Chairman Drigans at 8:25 P.M. MOTION by Councilman Starwalt to approve the request to reface the present building located at 5351 Central Avenue N. E. as requested by Miller Construction, with the stipulation recommended by the Subcommittee. Seconded by Councilman Utter. Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously. Mayor Liebl read the three recommended stipulations to the Council and audience. MOTION by Councilman Utter to approve the request to construct an addition to the present building for warehouse use at 7421 Cormnerce Lane as requested by Larsen Manufacturing with the three stipulations of the subcommittee. Seconded by Councilman Nee. Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously.
