MINISH CHAIRMAN BOARD OF APPEALS 'Y THE MINUTES OF THE BOARD OF APPEALS MEETING OF AUGUST 10, 1971 The meeting was called to order by Chairman Minish at 7:33 P.M. MEMBERS PRESENT: Minish, Drigans, Harju, Sondheimer, Wall OTHERS PRESENT: Clarence Belisle -Building Inspector MOTION by Harju to amend the minutes of July 13, 1971 to add the following statement under item #5: 'Tir Sondheimer's reason for voting nay is based on the fact that under the present circumstances justice cannot be done to either party. His nay was to highlight that some action is required by the City Planning Commission and by the City Council For in his conviction the pr petty owners also have rights when they are paying their taxes and especialiy when their rights go back to the time when the new City Code was not yet in a ist6nce. It should be recorded that the cessage of the professing party was good and was received loud and clear. In the future he would feel obliged to join the majority until the basic issue of the 40 oot lots is satisfactorily resolved." Seconded by Wall. Upon a voice vote, there being no nays, the motion carried unanimously. Chairman Minish reported to the Board the action taken by the Council on the July 13, 1971 Board items and also stated the letter containing the above statement was before the Planning Commision and before the Council and the City is working on getting a report made up on the 40 foot lots. 1. A REQUEST FOR A VARIANCE OF SECTION 45.053, 4B. SUBPARAGRAPH 3 FRIDLEY CITY CODE, TO REDUCE THE SIDE YARD ADJOINING AN ATTACHED GARAGE FROM 5 FEET TO 4.7 FEET TO ALL CONSTRUCTION OF AN 8 FOOT ADDITION ONTO AN EXISTING ATTACHED GARAGE SATED ON LOT 24, BLOCK 2, UPLAND 2ND ADDITION, THE SAIF BEING 6141 -5TH STREET N -E,. DLEY MINNESOTA (REQUEST BY MR HENRY J KOESTER JR., 6141 -5TH STREET N.E., BRIDL$Y,,MINNESOTA.) Mr. Henry Koester was -present to present the request. A survey of the lot and a letter of "no objection" from the neighbor to the south, Mr. Kukowski, were shown to the Board. MOTION by Drigans to receive the letter of no objection from Mr.-Jhkowski., Seconded by Marju. Upon a voice vote, there being no nays, the motion carried unanimously. Mr. Koester stated he now has a single garage that he wants to enlarge by 8 feet to have a 22 foot double garage. There would be'2 single garage doors and he would keep the hipp roof design. Mr, Sondheimer asked why it was necessary to increase the dimension of the garage to be 3 inches over the code requirement. Mr. Koester answered that 8 feet is a standard board measurement and he might just as well have the whole 8 feet than to cut off 3 inches from the boards, It wouldn't cost him any more money for material but it might cost a little more for labor. MOTION by Wall to close the public hearing. Seconded by Sondheimer. Upon a voice vote, there being no nays, the motion carried. 7fe utes of the Board of Appeals etiggn of 10. 1971 Pear„ e,2 '. Mr. Drigans stated he could not see the hardship as it would mean cutting one facia board to stay within code. He did feel that it was a minor varianee but he didn't like it because no one would know whether it was a 22 foot garage or a 21.9 foot game. Mr. Koester said it would not just be a facia board that would be cut but also .the roof sheathing and he added he wants the full g feet as this is a standard building material measurement. MOTION by Wall to recomend to the City Council approval of the request for the following reasons: 1. It is an g foot addition which means the use of standard cut building materials. Without this variance these materials would have to be altered which would create somewhat of a hardship. 2. The neighbor to the South has no objection to the variance. 3. The variance, being only 3 inches, is a minor deviation from the code. Se4pnded by Drigans. Upon a voice vote, there being no nays, the motion carried unanimously. 2. Mr. Olsen was present to present the request. A survey, pictures and the aerial map'showing the lotv..,wem shown to the Board. Mr. Olsen stated he would like to build a 22 foot by 15 foot addition onto the top of an existing 22 foot by 22 foot garage. The addition would be flush with the beck and side of the garage and the setback in front would be decked and railed. The addition would be used as the master bedroom as the extra room is needed.due to growth of the family. The present dwelling is a split level design with 3 small bedrooms. The present garage is 7.1 feet from the lot line and there is 11 feet 10 inches between structures (foundation to foundation). Mr. Olsen said this is the only way he can enlarge the house and still keep the same contour. There was a petition presented with the request, signed by the four adjacent neighbors and the one neighbor directly across the street, which stated they had no objections to the variance. MT. Harju asked Mr. Belisle what would be required, by way of fireproofing the existing garage, in order to build on top of it. RFIiULAR COUNCIL MEETING OF AUGUST 16, 1971 PAGE 5 three year time limit, and Mr. Suer said they expect to expand their building within three years anyhow, so the temporary building would be done away with. The City Engineer asked if they were leasing or buying the building and Mr. Simer said they were buying. The City Engineer said that the plans they have submitted also show some upgrading of the parking lot and improve- ments to the loading dock. MOTION by Councilman Harris to approve the request to move in a temporary building for Simer Pump Co. for a period of three years subject to their completion of the work as outlined on their plot plan submitted to the Engineering Department. Seconded by Councilman Liebl. Upon a voice vote, all ayes, Mayor Kirkham declared the motion carried.
