Following are the results of the Plan review for the Norwood Square Elderly and Handicapped Housing project proposed for construction near 62nd and 5th Street in Fridley, Minnesota. Our review has been based upon the submitted documents noted above and the codes as noted. 1. The City's review and enforcement of access for the disabled is per MSAC (MSBC 1340) per instruction of the State Building Official. Applicant, Owner and other responsible parties are advised that it is their respon- sibility to assure and provide compliance with the Americans with Dis- abilities Act and other accessibility codes/rules. 2. This review is based upon the following codes: MSBC = 1989 Minnesota State Building Code (1988 UBC, Amended). MSAC = 1989 Minnesota State Accessibility Code (MSBC 1340). MECC = 1989 Minnesota Energy Conservation Code (MSBC 7670, which adopts 1983 Mode. Energy Code with Amendments). I Indicate in the specifications that the City shall be copied with all `_II code -required testing, inpspection, investigation, and other reports. 4. Provide a Special Inspection & Testing Schedule per UBC 302(c) & 306(c). Include the following areas (and others as necessary) or provide infor- mation (e.g; exemption items, calculations, etc.) which exempt an area of work from special inspections: Concrete, Bolts installed in concrete, Welding, High-strength bolting, Special grading, excavation, filling and compaction. 5. Post approved numbers or address in such a position as to be plainly visible and legible from the street or road fronting the property per UBC 513. -- next page -- NORWOOD SQUARE: BUILDING PERMIT PLAN REVIEW 2/10 6. Implement soils investigation reports' recommendations (including site preparation, minimum footing depth, vapor barrier, etc.) and additional observation and testing by qualified personnel. See also notes Sheet S7. 7. Interior floor, wall and ceiling finish materials must comply with UBC Chapter 42 and the Fire Code. Submit flamespread and smoke density ratings for all finish materials for the City's review and approval prior to their installation. Lj_� N���g 8 Provide copies of testing reports for all fire -rated windows, dampers, special fire -stop assemblies, and other fire -resistive assemblies, per / UBC 302(b). Indicate on the Architectural cover sheet that, "Penetrations of fire- resistive floors and walls requiring protected openings shall be only " occasional pipes, conduits, sleeves and electrical outlets of copper, sheet steel or ferrous construction. Such pipes, conduits or sleeves shall extend to a fixture or 18 inches through the wall or floor,�per UBC 4304, 4305 & 1706(a)X7." — per UBC 302(d). 10. Firestopping around permitted openings through fire -resistive construction shall be of an "Approved" material capable of preventing the movement of hot flame or gases for the required fire -resistive time period, per UBC 4304, 4305 & 1706(a)X7. Specify, on the architectural cover sheet, the appropriate UL design number for each typical wall and floor -ceiling penetration, per UBC 302(d). 11. An approved automatic fire sprinkler system must be installed as per UBC 3801; 3802(b & h), UBC Standard -38-1 & 38-2, and the Fire Code. Shop drawings must be submitted for our review and approval prior to their installation: Please note that the system must be connected to a UL 0 listed monitoring service prior to occupancy of the building per UBC 3803. 12. Provide fire alarms per UBC 1211. , 13. Class I standpipes shall be installed in accordance with UBC Chapter 38, where required by UBC Table 38-A. Shop drawings must be submitted for our review and approval .prior to their installation. C14 Provide calculations and data to show compliance with MECC, per UBC 302(d). 0 15. Applicant shall assure integration and compliance of the project with this review and that of the Fire Department and Fire Code requirements and those of other regulatory agencies. 16. Inc.. a - Ann ----t- nonprofit corporation hereinafter referred to as "Owner" of the below -described property; and the City of Fridley, a Municipality under the Laws of the State of Minnesota, hereinafter referred to as "City." See Exhibit A attached hereto WHEREAS, the City has required the Owner to provide on-site detention ponding to accommodate storm water and the rate of flow of area run-off, and WHEREAS, the Owner agrees to construct a detention pond on the above- described property and do all related grading, slope work and restoration, including installation of pipe as approved by City. NOW THEREFORE IT IS AGREED AS FOLLOWS: 1. Owner assumes the full and sole responsibility for the condition, operation, repair, maintenance, and management, at no cost to City, for an on-site Detention Pond Storm Sewer System ("System") that meets generally accepted engineering standards for the purpose of receiving, retaining, and transporting all storm sewer water that may be collected within the System. Owner assumes the responsibility for any surface restoration due to utility work within City easement areas. All restoration shall be at the expense of Owner. 2. City shall not under any circumstances by responsible for the ongoing physical performance of any repairs, changes, or alterations whatsoever to the System and appurtenances, and City shall not be liable for the cost thereof. 3. Owner agrees, at no cost to the City, to regularly: (1) maintain and cut all grass; (2) maintain and trim all other shrubs and vegetation; (3) remove all liter and debris; (4) repair or replace any grass or other vegetation; (5) maintain the outlet structure; (6) maintain any pipe system; and (7) take all other and further steps that would be reasonably necessary for the purpose of maintaining a quality level of landscape care consistent with a residential development. 4. Owner agrees to indemnify and hold harmless City from any action and against any damages that Owner may sustain as a result of the construction and maintenance of the System located on Owner's property. 5. Owner's obligation to indemnify and hold City harmless in paragraph 4 above includes an obligation on the part of Owner to defend City in any actions that may be brought against City and as to which Owner has agreed to indemnify and hold harmless City as set forth above. 6. In the event that City determines that Owner is not maintaining the System in a fashion consistent with the Agreement, then City shall give written notice to Owner detailing the deficiency in the manner in which Owner is maintaining the System. If ten (10) days after receipt of this notice the deficiency described in the notice has not been corrected by Owner, then City may without further notice take any steps that it deems reasonably necessary in order to correct the deficiency. Owner agrees to reimburse City within thirty (30) days of receipt of invoice for all costs incurred, to include Administrative overhead by City in correcting the deficiency. If this invoice is not paid within thirty (30) days of receipt, Owner agrees that City may assess the cost against Owner's property. In the event that it becomes necessary for City to assess the cost for correcting the deficiency as provided herein, then City is authorized to direct the Anoka County Assessor to certify this assessment against Owner's property and Owner waives any right to a public hearing which may be statutorily or constitutionally provided for. 7. Witnesseth, that the Contractor and the Owner, for the consideration hereinafter set out, agree as follows: Article 1 — Scope of Contract A. The Contract between the parties is set forth in the "Contract Documents" which consists of this Agreement, the Drawings and Specifications. the current edition of AIA Document A20 1, "General Conditions of the Contract for Construction;' except for all paragraphs concerning arbitration and Form HUD 2554, "Supplementary Conditions of the Contract for Construction." Article 2 — Time A. The work to be performed under this Contract shall be commenced within ten (10) days of this Agreement, and shall be completed by -JANUARY 12 ,19 95 . The time by which the work shall be completed may be extended in accordance with the terms of the said AIA General Conditions only with the prior written approval of HUD. B. The Contractor shall correct any defects due to faulty materials of workmanship which appear within one year from the date of substantial completion. C. The date of substantial completion shall be the date the HUD representative signs the final HUD Representative's Trip Report provided that the trip report is subsequently endorsed by the Chief Architect. sticle 3 — Contract Sum and Payments (1) Subject to the provisions hereinafter set out. the Owner shall pay to the Contractor for the performance of this Contract the following items in cash: (a) The actual cost of construction as defined in Article 10 below; plus (b) Afeeofs 68, 543.00 In no event, however, shall the total cash payable pursuant to this paragraph (1) exceeds 2,110, 564.00 (2) If, upon completion, the Contractor shall have received cash payments in excess of (a) the actual cost of construction, plus (b) the cash fee specified in paragraph (1), all such excess shall be refunded to the Owner. 1. Each month after the commencement of work hereunder, the Contractor shall make amonthly request on Form HUD -92448 for payment by the Owner for work done during the preceding month. Each request for payment shall be filed at least ten ( 10) days before the date payment is desired. Subject to the approval of HUD, the Contractor shall be entitled to payment thereon in an amount equal to (1) the total value of classes of the work acceptably completed; plug (2) the value of materials and equipment not incorporated in the work, but delivered to and suitably stored at the site; plus (3) the value of components stored off-site in compliance with applicable HUD requirements less (4) 10 percent holdback and less prior payments. The "values" of (1), (2) and (3) shall be computed in accordance with the amounts assigned to classes of the work in the "Contractor's and/or Mortgagor's Cost Breakdown," attached hereto as Exhibit "A". The Contractor agrees that no materials or equipment required by the Specifications will be purchased under a conditional sale contractor with the use of any security agreement or other vendors title or lien retention instrument. C. The balance due the Contractor hereunder shall be payable upon the expiration of 30 days after the work hereunder is fully completed, provided the following have occurred: (1) All work hereunder requiring inspection by municipal or other governmental authorities having jurisdiction has been in- spected and approved by such authorities and by the rating or inspection organization, bureau, association or office having jurisdiction, . - (2) All certificates of occupancy, or other approvals, with respect to all units of the project have been issued by S tate or local governmental authorities having jurisdiction; and (3) Permission(s) To Occupy (Form FHA -2485) for all units of the project have been issued by HUD. D. With its final application for payment by the Owner, the Contrac- tor shall disclose, on a form prescribed by HUD, all unpaid obligations contracted in connection with the work performed under this Contract. The Contractor agrees that, within 15 days following receipt of final payment, it will pay such obligations in cash and furnish satisfactory evidence of such payment to the Owner. Article 4 — Receipts and Releases of Liens The Owner may require the Contractor to attach to each request for payment its acknowledgement of payment and all subcontractors' and materialmen s acknowledgements of payment for work done and materials, equipment, and fixtures furnished through the date covered by the previous payment. Concurrently with the final payment, the Owner may require the Contractor to execute a waiver or release of lien for all work performed and materials furnished hereunder, and may require the Contractor to obtain similar waivers orreleases from all subcontractors and materialmen. Article 5 — Requirements of Contractor A. The Contractor shall furnish, at its own expense, all building and other permits, licenses, tools, equipment and temporary structures necessary for the construction of the project. The Contractor shalll give all required notices and shall comply with all applicable codes, laws, ordinances, rules and regulations, and protective covenants, and with the current regulations of the National Board of Fire Underwriters, wherever applicable. The Contractor further shall comply with the provisions of the Occupational Safety and Health Act of 1970. The Contractor shall immediately notify HUD of the delivery of all permits, licenses, certificates of inspection, certificates of occupancy, and any other such certificates and instruments required by law, regardless of to whom issued, ,wl shall cause them to be displayed to HUD upon request. B. If the Contractor observes that the Drawings and Specifications are at variance with any applicable codes, laws, ordinances, rules or regulations, or protective covenants, it shall promptly notify the Architect in writing, and any necessary changes shall be made as provided in this Contract for changes in the Drawings and Speci- fications. C. Upon completion of construction, the Contractor shall furnish to the Owner a survey showing the location on the site of all improvements constructed thereon, and showing the location of all. water, sewer, gas and electric lines and mains, and of all existinrg utility easements. Such survey shall be prepared by a licenswtn surveyor who shall certify that the work is installed and erected entirely upon the land covered by the mortgage and within any building restriction lines on said land, and does not overhang or otherwise encroach upon any easement or right-of-way of others. In addition, the Contractor shall furnish additional surveys when required by the owner for any improvements, including structures and utilities, not theretofore located on a survey. The Contractor shall furnish copies of such survey required hereunder for HUD. D. The Contractor shall assume full responsibility for the mainte- nance of all landscaping which may be required by the Drawings Page 2 of 4 form HUD -92442 -A -CA and Specifications until such time as both parties to this Contract shall receive written notice from HUD that such landscaping has been finally completed. In the event HUD elects not to undertake such comple- tion, the Contractor's obligations under this Contract shall terminate. Article 10 - Certification of Actual Cost A. 3. HUD shall also have the right to interpret the Contract Documents and to determine compliance therewith. H. Article 9 - Assignments, Subcontracts and Termination 4. This Contract shall not be assignable by either party without prior written consent of the other party and HUD, except that the Owner may assign the Contract, or any rights hereunder, to HUD. The "actual cost of construction; ' as used in Article 3 above, shall include all items of cost and expense incurred by the Contractor in the performance of this Contract, including costs and expenses of labor, materials for construction, equipment and fixtures, field engineering, sales taxes, workmen's compensation insurance, social security, public liability insurance, job overhead expenses, and all other expenses directly connected with construction, and including general overhead expenses, but excluding kickbacks, rebate and discounts received in connection with the construction of the project, and excluding any retum on orcostof the Contractor's working capital, such return on or cost of working capital being a part of or to be paid from the Contractor's fee or profit. Bob Roach has used the state guidelines for square footage cost for elderly construction for his calculations. These guidelines are not consistent with the type of construction and level of finish mandated by HUD for their Section 202: Cost Containment Program. Bob's calculation of $2,357,550.00 is approximately $247,000.00 greater than our actual contract amount for this project. I have enclosed a copy of the contract we will be using for this project. You will note that Article 3 stipulates a maximum cost of $2,110,564.00. As we discussed in our telephone conversation of 5/13/94, I don't think there is a fairer way to evaluate the cost of a structure than the actual construction contract amount. Please review this information and call me so that we may arrive at a final evaluation figure and proceed with the permitting process. NORWOOD SQUARE This letter is a follow up to our telephone conversation this morning concerning the sanitary sewer service to the building. Your review comments requesting that the slope of the sanitary sewer be increased from 0.4!k to a 1.0 k minimum grade would require raising the finished floor elevation of the building 1.3 feet and significant alteration of the site grades and drainage. The exioting design provides for an 8 inch PVC sewer at 0.4t which is the standard minimum slope design criteria for the Great Lakes - Upper Mississippi River Board of State Sanitary Engineers. This criteria provides a minimum pipe flow velocity of 2 feet per second. It is estimated that the 51 housing units will generate 90 to 100 gallons of waste flow per unit per day. This flow would occur over a 10 - 14 hour day resulting in an average flow of 5.5 to 9.5 gal/hour with peak flow of 22 to 34 gal/hour. The pipe slope should be adequate to maintain acceptable pipe flow velocity. These flows would be similar to any residential neighborhood at the upper end of the sanitary sewer system. Backflow preventers are very important since they prevent contaminated water from entering the potable water supply. The Minnesota Plumbing Code in Section 4715.2161 states that all reduced backflow preventers must be tested each year and overhauled every five years by a plumbing company certified for backflow prevention service. We have not received the annual testing reports on the backflow prevention device for the boiler at the above location. It is very important that backflow preventers are checked annually to insure that the potable water remains safe for everyone. Because the annual testing requirement is mandated by the State Plumbing Code, failure to comply could result in legal action.
