Attached is a letter and survey that I received from Mr.
Nelson, Mrs. Mistelski's attorney. As I understand, from Darrel,
you would sign -off on deeds, one for Lots 6 and 7, and one for Lots
8 and 9, without going through the division process for Lots 7 &
8 which are currently one parcel. The original concern was the
distance of the garage from the lot line, which attached survey
seems to satisfy. will you please contact Mr. Nelson and advise
him of what is need to accmomplish their goal?

Dear Mr. Madsen:
This is in reference to a telephone conversation I had with your
office several weeks ago and also with Darrell Clark, Building
Inspector for the City, all in regard to the lots owned by my
client, Ann Mistelske.
Mrs. Mistelske has been trying for some time to divide lots 7
and 8 and to then combine lots 6 and 7 as a separate parcel, and
lots 8 and 9 as a separate parcel, so that she would have a
salable/buildable lot on 6 and 7.
In accordance with the City's request, Mrs. Mistelske has
obtained a survey showing that the garage in question is located
more than five feet from the north lot line of lot 7. A copy of
that survey is enclosed for your review. we were informed that
upon receipt of this survey your office could "administratively"
comply with Mrs. Mistelske's request to combine lots 6 and 7
into one parcel for tax purposes, thereby leaving lots 8 and 9
as a separate parcel.
Should you need any additional information, please do not
hesitate to contact the undersigned.

Dear Mr. Nelson:
Our City Assessor, Leon Madsen, has asked me to respond to your
letter of May 4, 1989 regarding division of Lots 6, 7, 8 and 9,
Block 32, Hyde Park. The property is zoned S-1, the Hyde Park
District.
Minimum lot area requirements are 7,500 square feet. Minimum lot
width requirements are 60 feet for interior lots and 65 feet for
corner lots. The survey dated April 24, 1989 which was included
in your letter indicates that Lots 6 and 7 together exceeds the
minimum requirements of the S-1 district. In addition, the setback
of the detached garage on Lot 8 meets the setback requirements of
the S-l,district.
Conveyance of Lots 6 and 7, Block 32, Hyde Park meets the zoning
ordinance requirements. Please arrange to have the deed forwarded
to my office prior to recording.

referenced parcel. The Anoka County Auditor's Office advised me
that recording the deed will also initiate a tax parcel split with
the Auditor's Office. The County will then notify the City about
the split.
As I mentioned to you before, the deed must be stamped by me prior
to recording.

Dear Assessor's Office:
This is in reference to the enclosed copy of Notice of
Homestead Application for Ann A. Mistelske. Further reference
is made to my recent telephone calls to your office.
As Ms. Mistelske has been informing your office for
years, her house is not located on Lots 7 & 8, Block 32. Her
house is located on Lots 8 & 9, Block 32. She also owns Lots 6
& 7, Block 32, which are vacant.
Recently, Ms. Mistelske went through a rather time
consuming and expensive procedure with the City of Fridley to
correct this problem. The City of Fridley agreed that Lots 6 &
7 should be combined for tax purposes and Lots 8 & 9 combined
for tax purposes. However, as your notice reflects, Lot 7, a
vacant lot, is still combined with Lot 8 upon which is situate
(along with Lot 9), Ms. Mistelke's house and garage.
Once more, we again request, that both your office and
the City of Fridley correct your records to show Lots 6 & 7, two
vacant lots, as a single parcel for tax purposes and Lots 8 & 9,
two improved lots, as a single parcel for tax purposes.
For numerous years, Ms. Mistelske has been trying to
obtain this division of her property so that she can sell Lots 6
& 7 as one buildable lot. When she obtains a potential buyer,
the buyer checks the city and county records, and is informed
that Lots 7 & 8 are combined, not Lots 6 & 7, and, therefore,
your offices are informing these people that Lots 6 & 7 cannot

be sold as one parcel. Is there some reason why it is
impossible to correct these records? As Ms. Mistelske does not
at present have a buyer, please do not ask for a deed as was
requested in the City of Fridley letters.

Dear Mr. Nelson:
I am in receipt of your letter dated March 21, 1990 regarding Ann
A. Mistelske's property legally described as Lots 6 through 9,
Block 32, Hyde Park. Because Leon Madsen is on vacation this week,
and because I corresponded with you last May regarding buildability
of the lot, I am attempting to address your concern as to why the
County and City are not showing your client's property to be split
into two lots, Lots 6 and 7 and Lots 8 and 9.
Enclosed are two forms in order to accomplish the split for your
client. These forms must be filed with the County Auditor's
office.
As of now, I understand that there are three parcel identification
numbers (P.I.N.); one for Lot 6, one for Lots 7 and 8, and one for
Lot 9. In order to accomplish the division such that Lots 6 and
7 are together and Lots 8 and 9 are together, we must first have
Lots 6 through 9 combined into one parcel identification number and
then a form filed to split the newly created lot into two parcel
identification numbers. Therefore, the first form combines the
three existing P.I.N.Is into one P.I.N. The second form takes that
newly created P.I.N. and splits it into two parcels.
Once this paperwork has been filed, potential buyers who contact
the City or the County regarding information about the new lot will
be given information on Lots 6 and 7.
Please have your client sign the attached forms and have her return
them to your office, at which point you may either mail these forms
directly to Anoka County or to Leon Madsen's attention at the City
of Fridley.
