The Fridley Zoning Code sets a height limit of seven feet for fences built in the side and rear yards on residential properties. In addition, Fridley City Code 213 establishes other standards for fence construction. Neither of these code sections distinguishes between temporary and permanent fencing. (I have enclosed copies of this information for your review.) Neither staff nor the City Council has the authority to administrativelyapprove construction of a fence in excess of the height limitations. If you wish to install such a fence, you must obtain a variance from the Zoning Code requirements. I have enclosed an application form and meeting schedule should you wish to pursue this option. Fridley, MN 55432 Dear Mr. Gerard: As you are aware, there has been an ongoing dispute between you and one of your neighbors. It is my understanding that this disagr xit centers around shaveling and storage of snow near your property lines and on the adjacent boulevard. MAs letter is to clarify the City's position regarding this matter. Vile the City has an interest in how boulevard areas are used and maintained, the Fridley City Code only addresses this issue to a limited degree. Specifically, the two areas covered are as follows: 1. vision Safety/safety Hazard - Any barrier (which presumably would include storage of snow) which impedes vision safety at an intersection or driveway or causes some other type of safety hazard sha11 not be permitted. 2. Maintenance - The boulevard area shall be propexly maintained, groomed, and cared for by the abutting property owner. This implies that property owners have some interest in abutting boulevards sine they are responsible for maintenance of these areas. Therefore, it is my understanding that a property owner could attempt to bring civil action against a party for damage done to sodding/landscaping in the adjacent boulevard area. Subject to the above points, the Fridley City Code does not address the issue of snow being moved from one portion of the boulevard to another. As a result, there does not appear to be a code restriction preventing either you or your neighbor from performing such work. However, I feel it is important that you and your neighbor work this problem out to prevent a bad situation in the future. I have enclosed a brochure from an organization called "Mediation Services for Anoka County". This agency uses trained mediators to perform conflict resolution between neighbors on matters similar to yours.
