A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.053, 4B, requires a minimum side yard adjoining living area of
10 feet
Public purpose served by this requirement is to maintain a minimum of 20 feet
between living area in adjacent structures and 15 feet between garages and living
areas in adjacent structures to reduce exposure to conflagration of fire. It
is also to allow for aesthetically pleasing open areas around residential
structures.
Section 205.053, 4B, 5b, requires a minimum setback of 25 feet for an attached
or detached accessory building which opens onto the side street of a corner lot.
Public purpose served by this requirement is to allow for off-street parking
without encroaching on the public right of way and also the aesthetic
consideration of the neighborhood to reduce the building "line of sight"
encroachment into the neighbor's front yard.
B. STATED HARDSHIP:
We would like to line garage up with line of house; 21 feet from lot line
and 33 feet from 60th Avenue. Need for double garage leaves single garage
without function except as living space.
C. ADMINISTRATIVE STAFF REVIEW:
The existing house is setback 35 feet from 6th Street (front yard) , 21 feet
from 60th Avenue (side yard street side), and the attached garage is 5 feet
from the south lot line. The attached garage to the south (5973 -6th Street)
is setback 5 feet (verified) from the common lot line that would leave 10
feet between a living area and an attached garage.
The house to the east (5980 -7th Street) faces 7th Street and is setback
23 feet (not verified) from 60th Avenue so the proposed detached garage
would not be encroaching into their line of sight.
If the Board should approve these two variance requests, the staff has no
stipulations to recommend.
