Mr. Mittelstadt pointed out that there was an obvious problem of building the proposed house without jeopardizing the existing house to the rear. There was also a question of the actual placement of the proposed house on the lot. MOTION by Mittelstadt to deny the request for a variance, and suggest that further study be made of the two properties.considering the best development for both lots. THE MINUTES OF THE BOARD OF APPEALS MEETING - JANUARY 10, 1968: The City. Engineer said that the Minutes of the Board of Appeals do not actually require Council action, only receiving the Minuteq,but there is one item that has been considered and denied by the Board of Appeals so many times, Mr. Ratley would like to get Council concurrence of a new proposal he has brought in: 1. A REQUEST FOR A VARIANCE TO PERMIT CONSTRUCTION OF A SINGLE FAMILY RESIDENCE ON THE EAST HALF OF LOTS 13, 14, AND 15, BLOCK 16, HAMILTON'S ADDITION TO MECHANICSVILLE. REQUESTED BY ORVILLE RATLEY, 2857 CENTERVILLE ROAD, ST. PAUL, MINNESOTA• The City Engineer said that the offset of the house does not conform to the neighborhood, and there has been difficulty finding a solution. He said that it does not meet all the requirements, as the property was not platted as it is, but was split this way. Mr. Ratley came to the Council table and showed the Council the plans of the house. There was a long discussion about the way the house could be lined up, removing the present structure, the home owner accepting the additional sewer charges, blacktopping the drive, and an agreement that the present structure will be torn down by a certain time limit. The Council studied an aerial photo map of the area. Mr. Ratley agreed to the stipulations the Council discussed. MOTION by Councilman Sheridan to permit Mr. Orville Ratley to construct a single family residence on the easterly half of Lots 13, 14, and 15, Block 16, Hamilton's Addition to Mechanicsville, to be faced east with a 35 foot south yard.setback and a 35 foot front yard setback with the stipulation that the property owner agrees to pay the sewer connection charge for the hou-,e; is willing to sign an agreement that by the 1st of June, 1971 the present structure on the property will be abated and removed; and that the new house ".' LOT SPLIT REQUEST: L.S. #67-07 FRED YESNES, EAST 273 FEET OF AUDITOR S SUBDIVISION #129: The City Engineer explained that Mr. Yesnes wants his property split into three lots. He said that the Planning Commission had recommended that the lots be 99 feet, 99 feet, and 75 feet, rather than the 100 feet, 100 feet, and 71 feet, as they thought it would be better to have all the lots standard lots, although there would be a side yard variance for an existing dwelling at 9 feet instead of the required ten feet. MOTION by Councilman Liebl to concur with the recommendation of the Planning Commission and approve Lot Split Request L.S. #67-07 for Mr. Yesnes, of the East 273 feet of Auditor's Subdivision #129, in accordance with the surveys provided. Seconded by Councilman Samuelson for discussion. Councilman Samuelson said that this would be the time to get the property utility easements along the rear of the property. The City Engineer said that this was a good idea, and there also will be additional connection charges for sewer service. AMENDMENT to the MOTION by Councilman Samuelson that the necessary utility easements be given to the City Engineer for recording and that the owner be informed that the sewer connections will be charged against the three lots when they are hooked up to the facilities. Seconded by Councilman Sheridan. Upon a voice vote, there being no nays, Mayor Kirkham declared the amendment to the motion carried unanimously. He picked up the permit on11,4-i 1968, a short time after con- struction of his basement had begun. Mr. Ratley is currently involved in a divorce suit and has been ordered to cease construction on the new home. We have received a call from a neighbor, Mrs. Kowalski 5330 7th Street, about the blowing sand and open excavation. Is there any action that the city can take to have this situation corrected? He said that a letter has been received from Central Dental Laboratory, dated August 29, 1968, signed by the abutting property owners statim that they do not wish to have the fence erected. MOTION by Councilman Harris to agree with the property owners request that the fence not be erected. Seconded by Councilman Lieblr Upon a voice vote, all voting aye, Mayor Kirkham de- clared the motion carried. The City Engineer explained that Mr. Ratley is being sued for divorce by Mrs. Ratley. The letter in the Agenda is from Mr. Charles Mayo, Mrs. Ratley's father and he is the fee owner. The daughter and son-in-law are contract for deed purchasers. Mr. Gibbs said that he would recommend revocation of the building Permit and stopping action on the lot split request until suc]1 time as they get their affairs in order. The City Engineer asked what was going to be done about the hole that has been dug there. Mr: Gibbs said that he has written to Mr. Mayo, saying that as it appears Mr. Ratley has disappeared, Mr. Mayo will be regaining the property, so he is to fill up this hole. MOTION by Councilman Liebl to concur with the recommendation of the City Attorney's office and revoke the building permit and amend any previous action on the lot split as may be necessary to return the land to it's original state before the request. He said that they would be single wooden poles like there is on University Avenue now. He said that if the Council agrees with this, Nsp will go to the railroad for their approval. The City Engineer said that this is a 30' road which runs between the 6kywood Mall Shopping Center and Robert Hall's and carried a lot of traffic. The problem is that there is not enough parking space provided by the apartment house owner. There is a 1'h parking space per unit required, but they may be being used by boats and trailers etc. Councilman Sheridan suggested the possibility of having 2 hour parking between certain hours, but that there cannot be 24 hour parking as this is against the City's ordinance. Mr. Paul Spears, 1050 52nd Avenue N.E. said that he had measured Lincoln Street which has private residences on it, and there was 20 difference between that street and 52nd Avenue, yet they have no restrictions on them. The children who live in the apartment houses play in the back a great deal, and this is where all tle deliveries have to be made, and he said that th®se apartment dwellers feel that this is a hazard to the children, as the drivers are not aware of the many children which play behind the building. He said that if the no parking signs absolutely cannot come down, then he would at least like to have a 25 mile per hour speed limit, as he feels that the cars take advantage of this clear street and go through this area t® fast. councilman Harris said that he had looked at this and he felt that some of the problem was that the grading is such in the back that it will not accommodate a large amount of cars. A REQUEST FOR A VARIANCE TO PERMIT CONSTRUCTION OF A SINGLE FAMILY RESIDENCE ON THE EAST HALF OF LOTS 13, 14, AND 15, BLOCK 16, HAMILTON'S ADDITION TO MECHANICSVILLE. PAUL, MINNESOTA: The City Engineer said that the offset of the house does not conform to the neighborhood, and there has been difficulty finding a solution. He said that it does not meet all the requirements, as the property was not platted as it is, but was split this way. Mr. Ratley came to the Council table and showed the Council the plans of the house. There was a long discussion about the way the house could be lined up, removing the present structure, the home owner accepting the additional sewer charges, blacktopping the drive, and an agreement that the present structure will be torn down by a certain time limit. The Council studied an aerial photo map of the area. Mr. Ratley agreed to the stipulations the Council discussed. MOTION by Councilman Sheridan to permit Mr. Orville Ratley to construct a single family residence on the easterly half of Lots 13, 14, and 15, Block 16, Hamilton's Addition to Mechanicsville, to be faced east with a 35 foot south yard setback and a 35 foot front yard setback with the stipulation that the property owner agrees to pay the sewer connection charge for the house; is willing to sign an agreement that by the 1st of June, 1971 the present structure on the property will be abated and removed; and that the new house REGULAR COUNCIL MEETING, JANUARY 15, 1968 will have a two car attached garage, and a paved driveway. He said that the Planning Commission had recommended that the lots be 99 feet, 99 feet, and 75 feet, rather than the 100 feet, 100 feet, and 71 feet, as they thought it would be better to have all the lots standard lots, although there would be a side yard variance for an existing dwelling at 9 feet instead of the required ten feet. MOTION by Councilman Liebl to concur with the recommendation of the Planning Commission and approve Lot Split Request L.S. #67-07 for Mr. Yesnes, of the East 273 feet of Auditor's Subdivision #129, in accordance with the surveys provided. Seconded by Councilman Samuelson for discussion. Councilman Samuelson said that this would be the time to get the property utility easements along the rear of the property. The City Engineer said that this was a good idea, and there also will be additional connection charges for sewer service. AMENDMENT to the MOTION by Councilman Samuelson that the necessary utility easements be given to the City Engineer for recording and that the owner be informed that the sewer connections will be charged against the three lots when they are hooked up to the facilities.
