OFFICIAL NOTICE CITY OF FRIDLEY PUBLIC HEARING BEFORE THE APPEALS COMMISSION TO WHOM IT MAY CONCERN: NOTICE IS HEREBY GIVEN that the Appeals Commission of the City of Fridley will meet in the Council Chamber of the City Hall at 6431 University Avenue Northeast at 7:30 P.M. on Tuesday, April 11, 1978 to consider the following matter: A request for variances to the Fridley City Code as follows: Section 205.053, 4, C, to reduce the minimum rear yard setback of 25% of the lot depth (between 25 and 40 feet) from the required 32.5 feet to 7 feet, and, Section 205.053, 4, B, to reduce the minimum side yard setback adjoining living area from the required 10 feet to 2 feet, to allow construction of a 24' x 24' addition to an existing house, located on the West Half of Lots 13, 14 and 15, Block 16, Hamilton's Addition to Mechanicsville, the same being 5310 7th Street N.E., Fridley, Minnesota. (Request by Wayne F. Schroer, 5310 7th Street N.E., Fridley, Minnesota 55421). Anyone who desires to be heard with reference to the above matter will be heard at this meeting. VIRGINIA SCHNABEL CHAIRWOMAN APPEALS COMMISSION Note: The Appeals Commission will have the final action on this request, unless there are objections from surrounding neighbors, the City staff, or the petitioner does not agree with the Commission's decision. If any of these events occur, the request will continue to the City Council through the Planning Commission with only a recommendation from the Appeals Commission. Item #2 April 11, 1978 ADMINISTRATIVE STAFF REPORT 5310 7th Street N.E. A. PUBLIC PURPOSE SERVED BY REQUIREMENT: Section 205.053, 4, C, A rear yard depth of not less that 25 percent of of the lot depth is required with not less than 25 feet permitted or more than 40 feet required. Public purpose served by this requirement is to provide rear yard space to be used for green areas which enhance the neighborhood. Section 205.053, 4, B, Two side yards are required with not less than 10 foot width adjoining living area. Public purpose served by this requirement is to maintain a minimum of 20 feet between living areas in adjacent structures and 15 feet between garages and living areas in adjacent structures to reduce exposure to conflagration of fire. It is also to allow for aesthetically pleasing open areas around residential structures. B. STATED HARDSHIP: The placement of the original structure makes this the only way to expand. We need the additional bedrooms for the family. C. ADMINISTRATIVE STAFF REVIEW: On January 15, 1968, the City Council granted a variance to allow building on the -Easterly portion of these lots provided the existing house be demolished by June, 1971. The house was not destroyed and due to divorce proceedings, the building permit was revoked. The revocation included returning the lots to their original state before 1966. (The City had approved a lot split in June of 1966.) It should be understood at this time that any future approval of a similar lot split request would most likely be predicated on the demolition of this house which Mr. Schroer wants to improve. A lot split would necessitate a variance to allow for over 25% lot coverage on the West one-half. The proposed addition will be 13.5 feet from the garage to the north. The rear yard is the West side of the house. Please note that plans are not available at this writing. The petitioner had indicated that he has no intention of splitting this lot now. N MEETING - APRIL 11 are 1, Mr. Wanzong explained that the Company presently was storing supplies in the recessed truck bays because there wasn't room in the existing building. He said that the proposed addition would be a white metal -type building with the pitch of the roof being east and w to'alleviate any drainage problems. He said that the proposed additi woixld enable Reserve Supply Company to get the present storage out of"the open and out of the truck deck space so that the area could ;handle the truck traffic. Mr. Wanzong said that Mr. Aldrich, of the Fire Department, wanted 'Reserve Supply Company to provide a hydrant located in the back of the building. He said that the Company would definitely provide a hydrant that would be located in the middle of the area in the rear o the building. He said that the Company would prefer to have a larger than six inch water main. The Commission members said that he would have to provide "at lea a six inch water main; he could go bigger if he so desired, he just couldn't provide smaller. Mr. Wanzong explained to the Commission members the various plans .Reserve Supply Company had in upgrading their entire operation. He said that areas would be blacktopped and changes would be made to some of the fencing located on the property. MOTION by Mr. Barna, seconded by Ms. Gabel, to receive the letter from Dealer 's Manufacturing Company and Fullerton Metals Company in w both Companies expressed that they had no objections to the variance. Upon a voice vote, all voting aye, the motion carried unanimously. T letters were received at 7:53 P.M. Mr. Holden indicated that the.Fire Department said they had no problems with the request as long as a fire hydrant was provided at the middle of the rear area of the building. MOTION by Ms. Gabel., seconded by Mr. Barna, to close the Public Hearing. Upon a voice vote, all voting aye, the motion carried unanimously. The public hearing was closed at 7:56 P,M, Ms. Gabel said she had no objections to the request as long as th Company agreed to meet the stipulations of the Fire Department. Mr. Barna said that his only concern was the acces3 lane over the railroad tracks. Mr. Wanzong said that the area around the tracks would also be °upgraded and that access over the tracks would be blacktopped. �I MOTION by Mr. Barna, seconded by Ms. Gabel, that the Appeals Commission recommend approval of the request for variance to the Fridley City Code, Section 205.13494,B, to reduce the required side yard setback in a M-2 zoning district, from 20 feet to 10.5 feet, to ;allow the construction of an 120 ft by 241 ft addition to an existing 11 warehouse, on Lot 39 Auditor's Subdivision No. 79, the same being 5110 Main Street NE, Fridley, MN with the stipulation that the locati 'of',,a fire hydrant and access to the rear yard be approved by the Fire Dopartment. APPEALS COMMISSION MEETING - APRIL 11, 1278 Page 5 The petitioner had indicated that he has no intention of splitting this lot now. Mr. Schroer showed the Commission members the plans he had for his proposed addition. He said that the addition would be to the East of his house, lining up with the existing north wall of the house. Chairperson Schnabel asked what he.planned to use the new addition for. She also wanted to know if the entire house would be restructured. Mr. Schroer said that the neer addition would allow for two bedrooms. He showed the .members exactly where all the rooms o.f the house would be located after the completion of the propsed addition. Ms. Gabel asked if a basement would be put under the new addition. Mr. Schroer said that he did not plan to put basement under the new addition. He.said that the house presently had a partial basement that contained the hot water heater and the furnace. Chairperson Schnabel indicated that the variance was.actually for the new addition and "grandfathering in" the existing house. Ms. Gabel asked what would be done about tying -in the roof lines. Mr. Schroer said that the present roof did not have the proper support and that at the time he put on the addition, he planned to put an entirely new roof on the dwelling tying in the existing house with the neer addition. Chairperson Schnabel asked if he had talked to the adjacent neighbors. Mr. Schroer said that he had talked to several of the neighbors and they had no objections to his plans. Ms. Gabel asked if Mr. Schroer would do the work himself. Mr. Schroer said that he would contract out the brick work and that he would have reliable help with the rest of the construction. Chairperson Schnabel asked how many windows Mr. Schroer planned to have on the North side of his house. Mr. Schroer said that there would be at least two windows on the North side of the house. P SSION MEETING - APRII, 11, 1 The Commission members took some time to discuss with Mr. Schroer the''fire hazard that would exist and suggested several alternatives to Mr. Schroer's plans that could alleviate the necessity for openings on the North side of the house. None of the alternate plans were economically feasible for Mr. Schroer. Chairperson Schnabel explained to Mr. Schroer that the reason for''the above discussion was to make Mr. Schroer aware of the potentia firl hazard that would exist. It was also discussed and decided by the Appeals Commission and Mr.'Schroer that the overhang on the North side of the house would have to be very minimal for the same reasons; that being the possibility of fire spreading from the adjacent garage to the living area of Mr. Schroer's home. ''!MOTION by Ms. Gabel, seconded by Mr. Barna, to close the Public Hearing. Upon a voice vote, all voting aye, the motion carried unanimously. The Public Hearing was closed at 8:26 P.M. Chairperson Schnabel asked if the alley located to the rear of his;', house was v4cated. Mr..Schroer said that he was informed two years ago that the alle wa,:�lconsidered vacated. ;'Chairperson Schnabel said that the one variance of Section 205.05 could be changed to be 13 feet rather than ?,feet. Mr. Barna said that there would still be adequate open space and adequate access for fire -fighting equipment, and the petitioner was aware of the potential situation and he was sure that for the safety of 'ithe family that Mr. Schroer would construct in such a way so as to maintain the most safe circumstances. He felt.that the addition was an''improvement to the dwelling and to the neighborhood. Ms. Gabel said that she was concerned about the proximity but she, said that the petitioner was aware of the problems. She said tha as',"',long as there mould be enough room for fire safety she mould have no '',objections.
