Per Section 205.07.03.D (2).(c).((3)) of the Fridley Zoning Code, to reduce the side yard
setback for an accessory building which opens on a side street from 25 feet to 17.9 feet
to allow the construction of a new detached garage on Lot 11, Block 5, Bonny Addition,
generally located at 5900 7h Street.
MOTION by Ms. Jackson, seconded by Dr. Vos, to open the public hearing and waive the
reading.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING WAS OPENED AT 7:53 P.M.
Mr. Hickok stated that the petitioner is requesting a variance to reduce the required side yard
setback for a garage on a corner lot. The doors open onto a side street, and the setback needs
to be 25 feet according to code. The petitioner is also requesting a special use permit to allow a
second accessory structure. The hardship is that they would lose the trees due to setback, and
the yard would be less usable due to the long driveway. The garage would be in line with the
home. Staff has no recommendation since the request is within previously recommended
variances. VAR #00-12 reduced the side yard setback from 25 feet to 12 feet at 600 Hugo.
The petitioner, Mr. Hughes, stated that he has nothing to add to the staff report.
Mr. Kuechle asked about his present garage.
Mr. Hughes stated it is a single attached garage.
Mr. Kuechle asked why this had to come to the Appeals Commission.
Mr. Hickok stated that if the garage is closer than 25 feet to the side lot line and there is a home
on a corner lot, it needs to be set back an appropriate distance to not crowd the aesthetics of
the neighborhood. In this case, the building face needs to line up with the garage face. They
have a significant tree in the back yard that they hope to avoid removing.
Dr. Vos stated there are a lot of garages like this in Fridley.
Mr. Hughes stated that the neighbor to the west is also requesting a variance like his.

Mr. Kuechle stated his concern is that that Mr. Hughes will not have enough space to put a car
on the concrete without the car sticking in the street.
Mr. Hughes stated that it is possible.
Ms. Jackson asked Mr. Hickok if staff had heard anything from the neighbor closest to the
garage.
Mr. Hickok stated that after he described the situation to the neighbor directly to the south, he
was very comfortable with the variance.
Mr. Kuechle asked why this was considered a second accessory structure.
Mr. Hickok stated that there is an existing secondary structure and there is an attached garage.
Mr. Hughes asked if the garage was considered an accessory structure if it is attached.
Mr. Hickok stated it is.
Mr. Hughes stated the shed would be removed.
MOTION by Mr. Jones, seconded by Mr. Tynjala, to close the public hearing
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING WAS CLOSED AT 8:00 P.M.
Dr. Vos stated this is a reasonable request. It has good sight lines and still provides a parking
place. He would vote in favor of the variance.
Ms. Jackson stated that it maintains green space, and she would vote in favor of the variance.
Mr. Jones and Mr. Tynjala also agreed.
MOTION by Dr. Vos, seconded by- Ms. Jackson, to recommend approval of Variance, VAR #01-
04, with the following
stipulations:
1. The petitioner shall obtain all necessary building permits prior to construction.
2. The garage shall be architecturally compatible with the existing home and finished with
same siding and color scheme.
3. The petitioner shall install the code -required hard surface drive.
4. The garage shall not be used for home occupations.
5. The variance is dependent upon approval of Special Use Permit, SP #01-02.

On March 28, 2001, the Fridley Appeals Commission officially approved a request for a
variance, VAR #01-04, to reduce the side yard setback for an accessory building which opens on
a side street from 25 feet to 17.9 feet to allow the construction of a new detached garage on Lot
11, Block 5, Bonny Addition, generally located at 5900 r Street, with the following stipulations:
1. The petitioner shall obtain all necessary building permits prior to construction.
2. The garage shall be architecturally compatible with the existing home and finished
with the same siding and color scheme.
3. The petitioner shall install the code -required hard surface driveway.
4. The garage shall not be used for home occupation.
5. The variance approval is dependent upon approval of Special Use Permit, SP #01-
02.
You have one year from the date of the Appeals Commission action to initiate construction. If
you cannot begin construction during this time, you must submit a letter requesting an
extension at least three weeks prior to the expiration date.

ANALYSIS
The property is located on the corner of 7' Street and 59f' Avenue. The lot is rectangularly
shaped, with the home being "squared up" to and fronting on 7h Street. The existing home and
attached garage was built in 1958.
The proposed garage location would not encroach closer to the lot lines than the existing home
already does and would allow the petitioner to save one rather large tree, that would be removed
if garage were setback to meet code requirements. City staff has received no comments from
neighbor

applicants within 10 working days if their land use applications are complete. We
officially received your application for a special use permit on March 2, 2001 and
application for a variance on February 23, 2001. This letter serves to inform you that
your applications are complete.
Your variance hearing will take place on March 28, 2001 at 7:30 P.M. in the City
Council Chambers. Your special use permit hearing and discussion will take place at
the City of Fridley Planning Commission Meeting on April 4, 2001 at 7:30 P.M. in the
City Council Chambers at 6431 University Avenue. Final action on your requests will
be taken by the City of Fridley City Council at 7:30 P.M. on April 23, 2001.
