2. CONSIDERATION OF A VARIANCE REQUEST VAR #93-13. BY RICHARD
AND KATHRYN FISCHBACH:
Per Section 205.07.03.D.(1) of the City Code, to reduce the
front yard setback from 35 feet to 32.7 feet, and Per Section
205.04.05.B.(2).(a). of the City Code to reduce the side yard
setback from 3 feet to 2.7 feet to allow the expansion of an
existing single car garage on Lot 5, Block 3, Rice Creek
Terrace Plat 4, the same being 6810 7th Street N.E.
MOTION by Mr. Kuechle, seconded by Ms. Beaulieu, to open the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:50 P.M.
Ms. McPherson stated this property is located near the intersection
of 68th Avenue and 7th Street. The property is zoned R-1, Single
Family Dwelling, as are all surrounding parcels. Currently located
on the property is a single family dwelling unit with an attached
single car garage. The petitioners are proposing to expand the
existing single car garage to a two -car garage by adding 6 feet to
the south side of the garage and an additional 2 feet to the east
side or front of the garage. The purpose for the addition to the
front of the garage is to facilitate installing a two -car garage
door. It will also lengthen the garage which will allow the
petitioners additional storage space at the rear of the garage
which would normally occur on the sides of a garage.
Ms. McPherson stated the Zoning Code was amended several years ago
to allow the expansion of single car attached garages to two -car
attached garages and to reduce the side yard setback from 5 feet
to 3 feet without a variance if the adjacent dwelling unit is 10
feet from the lot line or if the adjacent double car garage is 5
feet from the lot line.
Ms. McPherson stated the petitioners are requesting that a variance
be granted to allow a side yard setback down to 2.8 inches as
opposed to 3 feet to allow adequate room for the expansion of the
garage. The existing garage is set at approximately 8.8 feet from
the property line. The petitioners did receive a variance to add
the family room to the rear of the garage in 1981. The additional
inches requested by the petitioners will not adversely impact the

property to the south. The property to the south appears to meet
the 10 feet setback requirement. If the variance is approved, the
petitioners will be required to meet the Uniform Building and Fire
Codes.
Ms. McPherson stated the second part of the variance is to reduce
the front yard setback from 35 feet to 32.7 feet to allow a 2 foot
expansion to the front of the existing garage. By reducing the
front yard setback, the petitioners would not be adversely
impacting sight lines from either adjacent property. Also, the
overall lot coverage will not be affected by the proposed addition.
Ms. McPherson stated staff has no recommendation to the Commission;
however, if the Commission chooses to approve the variance, staff
recommends one stipulation:
1. The construction shall comply with the Uniform Building
Code.
Mr. Richard Fischbach stated they also plan to straighten out the
driveway. The front steps would be taken out and replaced with
sod. It will be a two -car wide concrete slab without the existing
steps. As far as hardship, they have lived here for over 20 years
with only a single car garage, and they want to be able to keep
both their cars inside the garage. He stated the neighbors to the
south have no objection to the variance.
MOTION by .Ms. Beaulieu, seconded by Mr. Kuechle, to close the
public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 8:00 P.M.
Ms. Beaulieu stated that since the City changed the Zoning Code to
allow more leniency to expand single car garages to two -car garages
and since the petitioners come within 3/10 of a foot of that Zoning
Code change to be able to have a two -car garage and a two -car
garage door, she would recommend approval of the variance request.
A single car garage is a hardship.
Ms. Savage stated there is clearly a hardship with a single car
garage, and the variance request is not going to adversely impact
any adjacent properties. She stated she would also recommend
approval of the variance request.
Mr. Kuechle stated that to try to build a garage less than 18 feet
wide is very difficult. The petitioner is only requesting a side
yard variance of 4 inches which is very reasonable. As far as the
front yard setback, it appears that there will still be room for
at least two cars to be parked which is really the reason for the
35 foot front yard setback so the spirit of the code is still being
met. He, too, would recommend approval of the variance request.

Request
The petitioners request that a variance be granted to reduce
the front yard setback from 35 feet to 32.7 feet, and to
reduce the side yard setback from 3 feet to 2.7 feet. The
request is for Lot 5, Block 3, Rice Creek Terrace Plat 4, the
same being 6810 - 7th Street N.E.
Site
The subject parcel is located near the intersection of 68th
Avenue and 7th Street. Located on the property is a single
family dwelling unit with an attached single car garage. The
property is zoned R-1, Single Family Dwelling as are all
surrounding properties.
Analysis
The petitioners are proposing to expand their single car
garage to a two car garage by adding an additional 6 feet to
the south (side), and an additional 1.8 feet to the east
(front). The petitioners are proposing to add additional
footage to the front of the garage in order to facilitate
installing a door as the two car garage will only be 18 feet
wide. This will also allow additional storage area at the
rear of the garage.
Section 205.04.05.B.(2).(a) requires a side yard setback of
3 feet if the adjacent dwelling unit is 10 feet from the lot
line or an adjacent double garage is 5 feet from the lot line.
Public purpose served by this requirement is to provide space
between individual structures to reduce the possibility of
fire, to provide access to the rear yard for emergencies, and
to limit the condition of crowding in the residential
neighborhood while allowing expansion of a single car attached
garage to a double car attached garage.
The City Code permits expansion of existing single car garages
to two car garages by allowing the reduction of the setback
to 3 feet if the house adjacent to the expansion is located
at least 10 feet from the lot line or a two car garage is
located at least 5 feet from the lot line. The petitioners

are requesting a variance of 3/10 of a foot to expedite
expansion of the single car garage. The additional 3/10 of
a foot will not adversely impact the adjacent property to the
south. The property to the south appears to be located at the
10 foot setback.
Section 205.07.03.D.(1) of the Fridley City Code requires a
front yard setback of not less than 35 feet.
Public purpose served by this requirement is to allow for off-
street parking without encroaching on the public right-of-way
and also for aesthetic consideration to reduce the building
"line of sight" encroachment into the neighbor's front yard.
The petitioners are adding an additional 1.8 feet to the front
of the existing single car garage. This will allow additional
storage space in the rear of the garage. The added 1.8 feet
will not adversely impact sight lines from adjacent
properties. The overall lot coverage will also not be
affected by the proposed addition.
Should the Appeals Commission recommend approval of the
request, one stipulation should be a condition of approval:
1. The construction shall comply with the Uniform Building
Code.

2. CONS-IDERATTON OF A VARIANCE REQUEST VAR #93-13, BY RICHARD
AND KATHRYN FISCHBACH:
mer Section 205:07..03.D.(1) of the City Code, to reduce the
front yard setback from 35 feet to 32.7 feet, and Per Section
205.04.05.B.(2).(a). of the City Code to reduce the side yard
setback from 3 feet to 2.7 feet to allow the expansion of an
existing single car garage on Lot 5, Block 3, Rice Creek
Terrace Plat 4, the same being 6810 7th Street N.E.
MOTION by Mr. Kuechle, seconded by Ms. Beaulieu, to open the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE# CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:SO P.M.
Ms. McPherson stated this property is located near the intersection
of 68th Avenue and 7th Street. The property is zoned R-1, Single
Family Dwelling, as are all surrounding parcels. Currently located
on the property is a single family dwelling unit with an attached
single car garage. The petitioners are proposing to expand the
existing single car garage to a two -car garage by adding 6 feet to
the south side of the garage and an additional 2 feet to the east
side or front of the garage. The purpose for the addition to the
front of the garage is to facilitate installing a two -car garage
door. It will also lengthen the garage which will allow the
petitioners additional storage space at the rear of the garage
which would normally occur on the sides of a garage.
Ms. McPherson stated the Zoning Code was amended several years ago
to allow the expansion of single car attached garages to two -car
attached garages and to reduce the side yard setback from 5 feet
to 3 feet without a variance if the adjacent dwelling unit is 10
feet from the lot line or if the adjacent double car garage is 5
feet from the lot line.
Ms. McPherson stated the petitioners are requesting that a variance
be granted to allow a side yard setback down to 2.8 inches as
opposed to 3 feet to allow adequate room for the expansion of the
garage. The existing garage is set at approximately 8.8 feet from
the property line. The petitioners did receive a variance to add
the family room to the rear of the garage in 1981. The additional
inches requested by the petitioners will not adversely impact the

property to the south. The property to the south appears to meet
the 10 feet setback requirement. If the variance is approved, the
petitioners will be required to meet the Uniform Building and Fire
Codes.
Ms. McPherson stated the second part of the variance is to reduce
the front yard setback from 35 feet to 32.7 feet to allow a 2 foot
expansion to the front of the existing garage. By reducing the
front yard setback, the petitioners would not be adversely
impacting sight lines from either adjacent property. Also, the
overall lot coverage will not be affected by the proposed addition.
Ms. McPherson stated staff has no recommendation to the Commission;
however, if the Commission chooses to approve the variance, staff
recommends one stipulation:
1. The construction shall comply with the Uniform Building
Code.
Mr. Richard Fischbach stated they also plan to straighten out the
driveway. The front steps would be taken out and replaced with
sod. It will be a two -car wide concrete slab without the existing
steps. As far as hardship, they have lived here for over 20 years
with only a single car garage, and they want to be able to keep
both their cars inside the garage. He stated the neighbors to the
south have no objection to the variance.
MOTION by Ms. Beaulieu, seconded by Mr. Kuechle, to close the
public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 8:00 P.M.
Ms. Beaulieu stated that since the City changed the Zoning Code to
allow more leniency to expand single car garages to two -car garages
and since the petitioners come within 3/10 of a foot of that Zoning
Code change to be able to have a two -car garage and a two -car
garage door, she would recommend approval of the variance request.
A single car garage is a hardship.
Ms. Savage stated there is clearly a hardship with a single car
garage, and the variance request is not going to adversely impact
any adjacent properties. She stated she would also recommend
approval of the variance request.
Mr. Kuechle stated that to try to build a garage less than 18 feet
wide is very difficult. The petitioner is only requesting a side
yard variance of 4 inches which is very reasonable. As far as the
front yard setback, it appears that there will still be room for
at least two cars to be parked which is really the reason for the
35 foot front yard setback so the spirit of the code is still being
met. He, too, would recommend approval of the variance request.
