RE: Notice of Noncompliance of the Fridley City Code at 201 45TH AVE NE
Dear Property Owner:
According to our records, you and Daniel Locker met with City staff on June 2, 2010 to discuss
the garage and driveway setback violations on your property. It was decided at that meeting that
you would pursue vacation of the alley. It has now been five years since that meeting. The City of
Fridley has granted you more than sufficient time to seek cooperation from neighbors on the alley
vacation.
This letter serves as your official notice that your garage and driveway encroach into the City -
owned alley, making your property illegal non -conforming. There are no City records showing a
variance or a vacation of the alley beside your property. When staff met with you previously, you
were going to pursue the alley vacation. The problem is, however, even if the alley is vacated, the
garage is encroaching into the required 3' setback. Therefore, staff has concluded that you must
reduce the size of the garage in order to bring your property into compliance. Because the City
does not have a certificate of survey on file for your property, you will also need to provide the
City with a survey and have the east property corners marked to verify the minimum 3' setback
compliance.
Due to the significant work that needs to be accomplished to reduce the size of the garage, I will
give you 90 days to complete this task. Therefore, the next inspection of your property will occur
on or about 9/1/2015. The City asks that you correct this serious violation by this date. If you
