A. PUBLIC PURPOSE SERVED BYREIREMENT:
Section 205.053, 4, A, requires a front yard setback of 35 feet.
Public purpose served is to provide open space for off-street parking
without encroaching on public right of way. Also for the aesthetic -
considerations not to reduce,the "building line of sight" encroachment
into a neighbor's front yard
B. STATED HARDSHIP:
The extra room is needed and there is no other feasible way to add onto
the house.
C. ADMINISTRATIVE STAFF REVIEW:
The existing 22' x 46' house is located 35.5' from 2nd Street. The 22..
foot dimension parallels 2nd Street and the petitioner want to add,8 feet
onto this end of the house to enlarge their kitchen and living room. Since
they have a detached garage fronting on 46th Avenue, the 8 foot addition
will not affect off-street parking.
Should the Commission approve this request, the staff does not have any
stipulations that we would recommend.

Mr. Sandin stated that the garage faces 45th Avenue. i .
Ms. Schnabel stated that the Commissioners had a copy of the survey and also two
pictures of the house. She stated that as a point of clarification, although the
house does front on 45th Ave., the narrow part of the lot faces 2nd Street, and the
narrow part of the lot is considered the front. That is the reason .for the 35 foot
setback rather than 17.5 in this case. Ms. Schnabel asked Mr. Sandin to come
forward and stated that their understanding was that he wanted to add on to the
narrow part of the house facing 2nd Street.
Mr. Sandin stated that was correct.
Mr. Kemper asked how recent the survey was.
Mr. Sandin stated that it was an old survey, but was taken after the house was
built.
Mr. Kemper asked how Mr. Sandin would continue the roof line.
Mr. Sandin stated the roof line would remain the same, he would move the hip line.
It would be just like if he cut it in half and added to fIie center and moved the west
Vail _our & feet.
Ms. Schnabel asked if the siding would be the same.
Mr..Sandin stated it would.
Ms. Schnabel asked what he would do with the lower level.
Mr. Sandin stated it would be all basement, there are no rooms there._ Since he
had to go down 42 inches, he might as well pour the basement. It would look the
same as it does now, only extend out further.
Ms. Schnabel noted that the hardship stated on the Staff Report was that he needed
extra room. She asked if this was a kitchen and dining area.
Mr. Sandin stated that the kitchen and dining area were to the rear of the house
and the living room was in front. He would like to enlarge the kitchen and dining
area and this was the only way to do it.

Ms. Schnabel asked if there were pipes on that wall of the kitchen.
Mr. Sandin stated there were and the plumbing would have to be moved.
Mr. Kemper asked if he would be doing the work himself.
Mr. Sandin stated he would be the general constractgx' : He .would bi-#9= Pe9Ple t,001a tha
work. His wife's uncle would do the carpenter work.
Mr. Barna asked if he had considered making the basement a walkout.for future
expansion. The slope of the earth there would lend itself to that.
Mr. Sandin stated he had no intentions of putting a doorway in there.
Ms: Schnabel asked if he had talked to his neighbors.
Mr. Sandin stated that two of his neighbors were here, the one immediately to the
north and the one next to him,on the 2nd Street side..
Mr. Gareth Iverson, 4519 - 2nd St. N.E. came forward and stated he had no objections,
and felt it would add to the neighborhood.
Mr. Edwin Hoglund, 4531 - 2nd Street N.E. came forward and stated he had no objections,
that whenever Mr. Sandin did anything to his home, he always made it better. He
did not feel there would be any problem with the line of traffic.
KION by Mr. Barna, seconded by Ms. Gabel, to close the public hearing.

Mr. Barna stated he felt it would make a good walkout. He also stated that 90% of
the corner lots don't line up with the rest of the street anyhow,.so he did not
feel there would be any visual impact, especially since it is so far back from the
street. He would have no problem with it.
Ms. Schnabel stated that since, the neighbors to the north did not object, she had
no problem either.
MOTION by Mr. Barna, seconded by Ms. Gabel, to approve the request for variance
pursuant to Chapter 205 of the Fridley City Code, to reduce the front yard setback
of an existing house at 201 45th Ave. N.E. from the required 35 feet to 27 feet, to

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205. 14, The public purpose of this section , and the five acre
minimum size for a townhouse development, is to provide for and
encourage advances in housing design; changes in types of dwellings; give
more flexibility in layout and site planning; the development of the
life -cycle environment; and the more efficient use of land, open space
and public facilities.
B. STATED HARDSHIP:
None was given with the application, however, all conditions exist, and
a variance approval will be necessary to accomplish the petitioner's
plan to sell off the units as owner occupied.
C. ADMINISTRATIVE STAFF REVIEW:
The City attorney was verbally consulted and his response was that the
Commission should review the request based on the subst3ndard size of the
overall tract, that he would have to review the townhouse association by-
laws, and that he may want to comment on those when the proposal reaches
the City Council.
The staff has no stipulations that it would recommend, related to the
variance, and will reserve its comments later on in the process when we
have received more details from the petitioner. This will occur when the
plat (Jay Park Addition), association by-laws, and variance request,
reach the Council level as a complete package.'
Ms. Schnabel stated that the Commissioners had received copies of the minutes
from the Planning Commission Meeting of March 21, 1979. One of the first items
on the agenda that evening was a public hearing for consideration of a proposed
preliminary plat. That plat was recommended to Council for approval with the

B. STATED HARDSHIP:
This setback will conform to the setback of adjoining dwellings on
same side of street. If building were moved 3 feet to the rear, it
would make access to garages more difficult, and would put the
building out of alignment with adjoining buildings.
C. AlMINISTRATIVE STAFF REVIEW:
The verifying survey for 389 Hugo shows a 32.5 ft. front yard setback.
The verifying survey for 369 Hugo shows 30.8 ft. front yard setback.
Other houses in the area appear to have similar setbacks. The
petitioner's building will be a multiple dwelling with tuck under
parking in the rear of the unit. Vision at the intersection is not
obstructed by the building or parking. Total lot coverage equals
18.8%. The petitioner has applied for a Special Use Permit to
allow off-street parking on the two adjacent R-1 lots to the east
of the proposed multiple dwelling.
Ms. Schnabel suggested they receive the letter from Mr. Doyle.
MOTION by Ms. Gabel, seconded by Mr. Barna, to receive the letter from Mr. John
R. Doyle, dated March 4, 1979

Ms. Schnabel stated that according to the letter, the reason for requesting an
extension is because of financial problems in obtaining financing.
Mr. Doyle stated that up to this point, obtaining financing was a problem, but it
looked it would be coming in the future.
Ms. Schnabel asked Fahy he felt it would be available now.
Mr. Doyle stated that there were some financing programs that he had been working on
for three or four weeks that make the financing look possible.
Ms. Schnabel stated that while the Commission responsibility with regards to this
request was not necessarily to debate the pros and cons of the setback, they could
review the original plans if they wanted to. The main question was whether or not
they wanted to grant the extension.
Mr. Kemper asked if they had the minutes for the discussion of last year.
Mr. Barna stated that the main point in the previous discussion was that the
adjoining houses to the east were setback further, which brought his lineup
into the rest of the lineup in the street.
Nlr.- Plemel tasked how many units "there would be.
Mr. Doyle stated there would be 10 units, they would enter off Hugo and go into
the garages from the back side.

The Commissioners reviewed the plans and pictures of the proposed structure.
1x. Kemper asked if,there had been any opposition when the variance was first
requested €a year ago.
Ms. Schnabel stated that Mr. Kemper had made the motion to approve, Mr. Barna
had seconded it, and the motion was carried unanimously.
Mr. Barna stated that he thought it was a very nice looking building.
Ms. Gabel asked if they were the same plans from one year ago.
Mr. Doyle stated they were.
Mr. Plemel noted that the Special Use Permit did not pertain to the Appeals Commission,
but asked if they were allowing parking in side yards.
Mr. Doyle stated that was for the extra vehicles. Mr. Doyle noted that was shown
on Page l of the plans.
Mr. Kemper asked if it was an appropriate action for the Appeals Commission to grant
an extension.
Ms. Schnabel stated it was and read the following: "Whenever within one year after
granting the variance, the recipient of the variance shall not have completed the
work as permitted by the variance, then such variance shall become null and void,
unless a petition for extension of time in which to complete the work has been
granted by the Board'of Appeals."
Mr. Plemel stated that had done it in the past.
Nit'. Barna asked Mr. Doyle if the financial situation he was going through would
cause any major changes in the structure.
Nx. Doyle stated he did not foresee any changes at the moment.
Ms. Schnabel stated that if the extension was granted, the variance request previously
made would still hold, in other words, he couldn't go any greater than the variance
allowed.
Mr. Doyle stated he understood that.
Mr. Plemel asked what "RIO -CALLS" meant.
Mr. Doyle stated that meant "River Road" in Spanish.

of the Fridley City Code. If construction is not completed within one year of
the granting of a variance, the petitioner must apply for an extension 20 days
before the end of a one year period.

Ms. Schnabel stated there would be a special meeting on March 28, 1979 and the
commissioners were invited to attend.
Ms. Schnabel stated that Ms. Gabel and Mr. Barns. had been reappointed for another
three year term to the Board of Appeals. Ms. Schnabel extended her congratulations
along with the other Commissioners to Ms. Gabel and Mr. Barna.

setback of an existing house at 201 45th Avenue North-
east, from the required 35 feet to 27 feet, to allow the
construction of an 8 foot by 22 foot addition to the
