DONALD MP ELsTADT Chairman Hoard of APPeals 1 Apr. 23.1959 �—TC OFFICIAL NOTICE CITY OF FRIDLEY PUBLIC HEARING BEFORE THE BOARD OF APPEALS TO WHOM IT MAY CONCERN: NOTICE IS HEREBY GIVEN THAT the Board of Appeals of the City of Fridley will meet in the Council Chambers of the City Hall at 7:30 P. M. on Wednesday, May 7, 1969, to consider the following: Mr. William Shaw, 5212 Capital Street Northeast, Fridley, Minnesota, requests the variance of Section 45.26,Fridley City Code,to reduce the front yard requirements from 35' to 25' to permit construction of dwellings on Lots 1, 2, 3, 4, and 5, Block 1, Marion Hills Second Addition, the same being 52nd Avenue Northeast between Taylor Street and Buchanan Street Northeast. Anyone desiring to be heard with reference to the above matter may be heard at this meeting. DONALD MITTELSTADT CHAIRMAN BOARD OF APPEALS PUBLISH: April 23, 1969 1. 2. TAE MINUTES OF THE BOARD OF AMAJS MEETING OF MLY 7. 1969_ The meeting was called to order by Acting Chairman Minish at 7:30 P -M® MHGERS PRESENT: Minish, Harris, Ahonen, O'Bannon MOMERS ABSENT: Mittelstadt OTHERS PRESENT: Clarence Belisle -Building Inspector MOTION by Ahonen to approve the minutes of April 30, 1969 as written. Seconded by Harris. Upon a voice vote, there being no nays, the motion carried unanimously. Mr. William Shaw was present to present his request. Mr. Shaw.brought with him a plat of Marion Hills Second Addition to show the Board how the lots were situated. A photo of the area, taken by the Building-Inspeotor, was also ehova to the Board. There was a discussion on the elevations of the land, drainage easements ea4, what types of houses could be built on the land. The reason Mr. Shaw wants this variance is that the existing elevat$-on of the land, at the rear of Lots 3 & 4 is such, that a great deal of earth would have to be removed, and would make building unfeasible. MOTION by Harris to close the Public Hearing. Seconded by Ahonen. Upon a voice vote, there being no nays, the motion carried unanimously. MOTION by O'Bannon to approve the variance for the following reasons; 1. There is a hardship in building on Lots 3 & 4 without the setback asked fop, 2. There were no objections from adjoining neighbors. 3. The reason for granting the variance on all the lots is so all the houses will be in the same alignment. Seconded by Ahonen. .Upon a voice vote, there being no nays, the motion carried unanimously. Dr. Dudley was present to present his request. Mr.. Robert Guzy, representing Commerce Park Investments, was present to oppose the request. A drawn copy of the sign was shown to the Board. Dr. Dudley explained that the sign will have two sides with floresent lights behind the letters P E T and two gooseneck lights to be on the two medical symbols on -either side, ---U w*11 be a free standing sign with no flashing lights. We are trying to keep the sign large enough to be more easily read from the highway. Minutes of the Board of Appeals meeting of May 7. 1969 Page 2 Mr. Guzy: I.am here representing Commerce Park Investments to object to this sign. The area is yet undeveloped and Dr. Dudley would more or less be setting an example for sign size. If this variance is granted you would have to let other signs go up of the same size. Also this sign will block the view of our building. If there is some sort of hardship I will withdraw my objection, but we don't want people coming in getting bigger and bigger signs to put up in this area. Dr. Dudley: The sign is to direct the people to the building. It would be a hardship if you would have to put up a sign that could not be read from the highway. The symbols on the sign are what is making the sign larger and making us need a variance. The symbols really don't direct the people to the building but they do put medical ethics into the sign. MOTION by Harris to receive a communication from Commerce Park Investments objecting to the variance and brought before the Board by Robert Guzy. Seconded by O'Bannon. Upon a voice vote, there being no nays, the motian passed unanimously. Harris: Would it be possible to change the sign to comply with the Ordinance? Dr. Dudley: I don't think I can say it wouldn't be possible. MOTION by O'Bannon to close the Public Hearing. Seconded by Ahonen. Upon a voice vote, there being no nays, the motion passed unanimously. Minish: If the Board were to deny this request you would not be able to come back before the Board for 6 months. If you, -could withdraw this request for the reason of redrawing your sign to try to come closer to the Ordinance sign size, it would be better for you time wise. Dr. Dudleys I will withdraw my request. MOTION by Harris to accept Dr. Dudleys request to withdraw his request subject to being resubmitted at a later date if he Inst reduce the sign area.
