SUBJECT: Effecting Lots 1 through 4, Block 1 -
Marian Hills 2nd Addition
Please be advised that the referenced properties are adjacent to
an existing sanitary sewer line. Due to the topography of the lots
in relation to how single family dwellings would•be constructed,
the manholes tend to stick out of .the ground quite a distance.
It was initially.discussed with the property owners from DeGardner
Realty, that the City would have -no objection to lowering the man-
holes; -however, at the property.owners' expense. On June 11, 1979,
contact with the property owners indicated that they do not intend
to lower the manholes. They, instead,will provide landscaping to
screen the structures.

Dear Ms. Sammarco:
You called our office to report a problem with your home in that you are
experiencing a seepage problem through the wall/ceiling/roof system.
A field inspection was conducted on June 5, 1980 following a substantial
rain from.the morning of that day. It was noted that in almost every
room of the structure there was evidence of moisture leaking into the
living areas. It appears that it occurs near the.ceiling in almost
all instances.
This is a result of the waterproofing failing to seal off water from
entering the interior of the structure.
This office can not determine the exact cause of fault which is causing
the failure. No waterproof design was ever submitted for our review
and no inspection was called for or made prior to backfilling.
Therefore, you and/or your applicator must correct the problem. Since
this process is new, an inspection by a third party may be necessary
to determine the correction method.
9his correction must occur as soon as possible; certainly within
30 days.
Please let this office know what your intentions are in this matter.

1. 1986 Rice Creek Pryonitoring Program. Engineer reminded Board it is time to begin
Water Quality Monitoring for 1986. This program was developed through the 509 Plan
and implemented in 1985. Sampling to begin in April, and will include monitoring
lakes one time in July and streams nine times per year for a total of $26,000 already
budgeted. After discussion, Petrangelo moved to approve and authorize E.A. Hickok
& Assoc. to initiate and conduct throughout 1986 the Rice Creek Monitoring Program,

a duplicate of 1985, at $20,000 for Stream Monitoring and $6,000 for Lake Monitoring,
to include a written report. Seconded by Scott. Motion carried. 4-0
It was noted these costs will be paid from 509 Funds.
2. Request for Partial Payment, Estimate #2, Sed Basin Maintenance Project No. 85-1.
Engineer distributed and reviewed Partial Payment Estimate #2 from C.S. McCrossan,
noting the Change Order No. 1 for 200 CY of common channel excavation at $6.50/CY
for a total of $1,300, per Board action 2-20-86. Engineer reported McCrossan has
completed excavation of the Sed Basin, and all that remains is restoration. After
review and discussion, Petrangelo moved approval of Partial Payment Estimate #2 for
the period 2-7-86 through 3-19-86, in the amount of $22,410, based upon recommendation
of the Engineer. Seconded by Sande. Carried. 4-0
3. Engineer Willenbring distributed a memorandum of questions/responses to queries
of League of Women Voters, Mahtomedi Chapter, compiled at request of Petrangelo who
will address this group on 3-25-86. Petrangelo explained his need for technical
background information. This item was not reviewed at the Meeting.
4. Discussion with Pat Mulley. Willenbring reported speaking with Pat Mulloy, MPCA,
on Managers' questioning possibility of retaining Lake Josephine funds for future use
in that Lake, and the negative response. Regarding the possibility of transferring
these funds to a Non -point source pollution abatement project in bite Bear lake/Bald
Eagle Lake, there were a number of issues to be discussed, and Mulloy offered to attend
the next Projects Meeting, if Managers desired. Consensus is to invite Mulloy to the
4-17-86 Projects Meeting for discussion on transferring funds.
5. Anoka County Ditch 22. Engineer displayed a map of subject Ditch and gave back-
ground to date, advising there was a meeting 3-19-86 including representatives of
County, City and RCM (Cardinal and Willenbring attending) with consensus being that
an improvement project would be necessary in order to provide the drainage needed to
adequately handle the anticipated runoff. Lino Lakes Council has been seeking a repair
up to this point, but if the Ditch is returned to its original configuration at a cost
of $40,000, it will still be inadequate for the City's purpose. The City has set up
an informational meeting on 3-24-86, 7:35 PM at Lino Lakes City Hall, and requests
Rao be present to respond to questions from citizens. There was discussion, with
consensus being that 10M will not participate further, having expended considerable
funds to date, until a proper petition under Ch. 106 or 112 is received. Anoka Co.
Managers Cardinal and Petrangelo will attend the informational meeting. Engineer was
directed to convey the Board's decision in writing to the City of Lino Lakes.
6. Update on Long Lake Outlet, Hugo. Engineer reported work began today on the Outlet.
The City was previously advised the Board was taking emergency action, and that the
City advised property owners downstream of long Lake of the project commencing. Several
property owners were present to speak with the Board regarding lack of notice and water
quality, as well as rising water level in Round Lake. Engineer noted Long lake is five
feet higher than Round Lake, that there will be a temporary rise in Round Take water
level and further downstream, but this will equalize. If the rising water level (DNR
has set Normal OHW at 966.2 in Round Lake) adversely impacts property owners on Round
lake, the outlet will be metered back. Staff gauges have been installed in Round, Mann
and Pine Tree Take, and will be inspected daily. Culvert Maintenance will be turned
over to Washington County. Juanita Lovegren stated that MPCA informed them last year
that Round Lake is already degraded, producing blue-green algae, and advised of her
concern that Greiskalns' septic system has probably affected Long Lake waters, which
will flaw into Round Lake and further degrade the waters. Engineer Willenbring dis-
tributed a memorandum dated 3-20-86: Results of Water Quality Monitoring of Long
Lake and Round bake in Hugo, and reviewed this with Managers and citizens who were
present. Conclusions reached from test results are that concentration of nutrients,
solids and other monitored pollutants in Long Lake were significantly less than those

observed in Round Lake, and that there was no indication of contamination from the
drainfield system on Greiskalns' property. However, after water recedes, City of
Hugo will test the drainfield function and if not proper, will require it be fixed.
Managers assured the citizens they gave notice to the City of Hugo immediately after
their decision to take emergency action.
REPORT CF THE ADMINISTRATIVE ASSISTANT:
1. Letter received from Fletcher Driscoll, declining appointment to the Citizens
Advisory Comnittee, dated 3-18-86, although the CAC had recamnended Driscoll for
membership. Discussion. The Board will require a letter of intent from candidates
in the future. Petrangelo moved to void previous appointment of Fletcher Driscoll
to the CAC. Seconded by Scott. Carried. 4-0
Sett queried the length of appointments to the CAC. It was noted the Committee
passed a rule that anyone serving 2 three-year terms must take a one-year furlough.
2. Torpe reported a call from Engineer Panuska that C.Donahvwer has phoned him
regarding lack of what he deems proper stipulations on Ellman Permit #85-89, issued
10-29-85. During discussion, Board requested next Manager who attends CAC Meeting
inform the CAC that their inquiries regarding Board action are best directed to the
President of the Board, and not to the staff.
3. Torpe queried whether Board wanted the 50 -page copy of MLV Stat. 112 and the 509
law copied to each CAC member. Response: make one copy and it can be circulated.
4. Received from TCAAP 3-20-86: copy of DNR Permit Application for Appropriation
of Waters, Non -irrigation, keeping the District advised of the Groundwater Extraction/
Treatment Program as C.Oster had indicated.
OTHER:
1. Sande indicated a need for clarification of 2-26-86 Minutes, page 2, Item #3
under Report of the Engineer, correction to read (addition underscored): "After dis-
cussion, Willcoxen moved, supported by Scott, to authorize payment at $250, to be
21�riated from the Survey & Data Acquisition Fund of the District, as part of a
cost -share project to determine water quality in Silver,Lake, St. Anthony." Petrangelo
moved, supported by Sande to insert the recomrnnded phrase. Carried. 4-0
2. Cardinal described the need for moving the Application submittal deadline to 13 days
prior to 4th Wednesday each month (fr n 12 days prior). Petrangelo moved accordingly,

CALL TO ORDER:
Prlesident Cardinal called the Regular Meeting to order at 7:30 PM in the Council
Chambers of Arden Hills City Hall on March 26, 1986. Petrangelo moved to suspend
the Rules of Procedure. Seconded by Scott. Carried. 4-0
SETTING OF THE AG MA:
Cardinal added Report on meeting at Lino Lakes 3-24-86, and added appearance by Tony
Jambor, and TM Conference. Petrangelo added Report on IW meeting 3-25-86. Scott
added item on CAC. Engineer Panuska deleted frcan Consent Agenda Applications 86-21,
86-23, 86-25 and added 86-24 to Table portion. He then added 1985 Permit Summary.
Willenbring added Long Lake Outlet Project, Hugo, and Report on MPCA Trophic Status
Report, and information on total assessed valuation of the District. Torpe added
letter from Metro Council and Steenberg appearance. With these changes, President
declared the Agenda set.

MANp.ICERS' ITEMS FOR DISCUSSION:
1. Tony Jambor appeared to request the Board not require him to obtain a Permit
since he has decided not to construct mini -storage buildings on his site in MoundsView.
Panuska reviewed exhibits Jambor has submitted, reported on conversation with the City
and recommended the Board require a Final Site Drainage Plan delineating the floodplain
area on the site. After discussion, Petrangelo moved that Application 86-14 be revised
to reflect Jambor's need for Final Site Drainage Plan approval (rather than Land Devel-
opment Plan). Seconded by Sande. Carried. 4-0

REPORT OF THE ENGINEER:
1. Consent Agenda. It was moved by Petrangelo and seconded by Sande to approve/
ratify the following Permit Applications in accordance with the District Engineer's
Recourendation, as contained in the Engineer's Report dated March 21, 1986: 85-134,
86-06, 86-07, 86-15, 86-22. Carried. 4-0
It was moved by Petrangelo and seconded by Sande to table the following items
as recommended by the District Engineer in the Engineer's Report dated March 21,
1986: 86-05, 86-27, 86-24. Carried. 4-0
2.- Permit Application Background and Recommendations. Engineers Willenbring and
Panuska reviewed exhibits and made recommendations on the following Applications:
86-21, 86-25, 86-26, 86-13, 86-20, 86-23. See Attachments 1 through 5 for Board
action.
3. Informational Items: (1) Panuska reported that Ramsey County has responded well
to FOO comments on Project Review No. 85836: Reconstruction of County Road J from
I -35W to Lexington Avenue.
(2) Panuska distributed and briefly reviewed the 1985 Year Permit Summary showing
136 Application, 37 Project Reviews and 4 Comprehensive Plans received.
(3) Willenbring updated the Board on the Long Lake Outlet Project, Hugo, noting the
flow began on 3-24-86 with long Lake down ten inches today, Round Lake two inches
above the NOHW. At first Round Lake rose three inches, and the downstream area rose
also. Calls from Creager and Ball requesting relief from Round Lake ice banging
against their trees resulted in metering back the flow. Engineer noted daily inspec-
tions are made. Scott inquired if discussion has progressed with Washington County.
Willenbring reported speaking with Tarry Bousquet about giving over maintenance to
the County, and Bousquet reminded him that the Permit states RCWD will be responsible.
Willenbring said the Contractor has backfilled, and the job is done except for restora-
tion. He then distributed Request for Partial Payment from Jedlicki, Estimate No. 1
for Period March 1 through March 24, 1986 and recommended payment of $9,989.00. Pet-

etrangelo moved approval in accordance with Engineer's recommendation, seconded by Sande
(to be paid from, Survey & Data Acquisition Fund). Carried. 4-0
(4) Willenbring then reported on his review of MPCA's Trophic Status of Minnesota Lakes
Report, involving 1,087 lakes (10% of those in the Stare), noting data froan STORET was
used, advising the ranking status of lakes in the RCWD.
(5) Willenbring, at Petrangelo's request, then advised the Total Assessed Valuation of
RCWD at $1,042,000,000. Petrangelo noted the RM 1985 Tax levy in each of the Counties
was 36G per $1,000 assessed value; in 1986 the RCD Tax levy has dropped to 18.8 per
$1,000 assessed value per home.
The Board then addressed Bruce Bernie, who stated he was present regarding construction
of an outlet to Oneka Lake, U t the City of Hugo Council took action to buy or condemn
Zaluckyj property in order to construct the outlet, but property owner's attorney has
refused to sell, and the City has not made progress in acquiring the property. Bernin
asked if RCWD would participate in the project along with the City and the citizens
around the Lake. The Board then noted that F00 already borne the expense of investiga-
tion of the downstream effects. Bernin asked for those total costs and a breakdown of
them. Willenbring will provide these to Bernin, along with the metered outlet figure.:

REPORT OF THE ADMINISTRATIVE ASSISTANT:
1. Billing Report was reviewed with the Managers, and receipt of USEPA Reimbursement
noted.

2. Sande will attend the CAC Meeting 4-2-86. There was discussion of the orientation
session requested by some of the CAC members, with decision that Sande and Petrangelo
beipreserrters. Sande suggested he obtain a list of questions the Committee wants
answered, and invite the CAC to have all members present on May 7. This would allow
Committee members to invite interested persons in their municipality to attend also.
It was not deemed necessary for the Accountant and the Attorney to attend. B.Moller
was requested to report back at 4-9-86 Regular Meeting on attendance for next CAC Meetinc
3. Torpe distributed copies of Metropolitan Council letter received 3-24-86, regarding
proposed NCR Ccmtem project in Blaine (upstream of Golden Lake), and containing a recom-
mendation directed both to the City of Blaine and the Rice Creek Watershed asking that
evaluation of water quality impacts on Golden Lake be made prior to permit issuance.
There was discussion of whether the District can require this of the developer, since
the District usually looks at sediments and erosion, and who should rightfully bear
the cost of water quality testing. Engineer Willenbring was directed to investigate
through discussion with Gardebring at Metro Council and Attorney Murray, and report back.
4. Torpe reported contact with Mr. Ed Steenberg, City of Circle Pines Councilmember,
who accepted the invitation to address the Board regarding aerator in Golden Lake
at the 4-9-86 Meeting.
0THER:
1. Cardinal noted a Conference for Water Management Organizations on 4-16-86 in
Brooklyn Park, designed to assist in preparation of 509 Plans. No Manager will attend.
2. Scott read an excerpt from CAC Minutes of 7-13-76 which state that Committee members
should be appointed for not more than 2 consecutive 3 -year terms, and that a one-year
furlough is taken after 6 years of service on the Committee.
3. Cardinal reported on the 3-24-86 meeting at Lino Lakes regarding Anoka County Ditch 22
He noted those present: Anoka County Engineer Ruud, Commissioner Tangfeld, Engineer
Willenbring, Petrangelo and himself, along with Lino Lakes Council and the citizens
interested in the project. PLMD representatives made it clear that the City of Lino
Lakes has not yet petitioned RCM for a project according to the Statute, and that RCWD
does not intend to pay for the entire project because of limited funds which will most
desirably be spread equitably throughout the 201 square miles of the District. They
further noted the considerable funds expended for engineering review up to this point.
4. Scott requested the Board look briefly at TGAF'AA's on the log, and discussed sev-
eral which remain tabled since January. The Board directed Eklin to watch these sites
closely for activity which is not authorized.
5. Petrangelo reported on his 3-25-86 meeting with the Mahtcmedi League of Women Voters
who invited an RCWD representative to acquaint them with the District, its background,
powers, and queries on water quality, and concerns for White Bear Lake.
With all Agenda items addressed, the meeting was declared adjourned at 10:35 PM. The
next Regular Meeting will be at Arden Hills City Hall, 7:30 PM on 4-9-86.

On Wednesday, April 23, 1986, I phoned Taylor Land Surveyors to
advise them that their plat survey was in error. I asked to have
someone come out to the house by April 25, 1986 to make the necessary
corrections so that the refinancing loan would take place as scheduled
that day. Mr. Rogers of that company advised me that they would not
be able to get the survey corrected by that time and that if I was not
satisfied with their survey that I could get someone else.
The survey done by ''aylor, was based on locating the front two irons
that mark the outer edge of the property bounded on the south side.
No attempt was ma.de.to locate the back two irons (markers) of the
north side of the property. (The dirt in the area of the NW corner
was not disturbed and the wood stake from Sept. 1979 remained in the
ground. The metal marker was down over a foot in the ground And was
unearthed by the,lSuburban Engineering Surveyors on their extensive survey
made on April 25, in the A.M. The NE. corner of the property falls on
a seuer cover. No mark appeared on the cover till Suburban placed a mark
on it.) The structure v
as drawn on the Taylor surey was made on the
imagination of the surveyors. Since the building is in the_ground for the
most �part, �it was necessary for pictures of the construction process
(before the house was covered up)and also for the surveyors to enter and
measure the inside of the structure for an accurate drawing. The survey
as was done by Suburban is the correct drawing based on the above info.
The drawing as shown by Taylor shows a -rectangular square structure, which
is not a true image of the building. This would indicate a Utility/ofc.
building of 7 ft. 4 in. by approx. 35 ft. The depth of the ofc. is approx.
12 ft. and the "true" width is 6 ft. 8". The width as shown on the plan
was chan wed per the engineering dept. of Fridley, before the structure
construction was begun, as the plan blue prints size of the room would
have beers an intrusion into the easement and would have had to had a
variance from Fridley and I believe they did not want to give a variance.
On this basis, please do not pay Taylor for the survey as it was not a
correct picture o the survey. Either deduct the $90.00 from the closing
fees or issue a check to me for reimbursement. If this is not done and
TAylor is paid for their incomplete, inaccurate work, then steps will be
taken to collect the mondy from them.

On several occasions, I have spoken to you
about correcting problems that developed from your
employee's reroofing the front portion of our home.
Various minimal attempts by your employees to
resolve the situation merely worsened the situation.
The-Velux windows that were supposed to "open" were
even sealed shut.
For $JA QQ, City Wide Home Improvements
agreed to re -roof the front of the house according
to instructions that were also provided to your
employee, but which he did not follow. The shingles
and tar paper roofing by your employee were torn off
and "water shield" over the entire roof area, the
appropriate velux kit flashings were used, and 25
year shingles were applied with excellent results.
There was also considerable water damage to the
interior wood of the porch which didn't previously
exist. This additional problem must be dealt with.
Since dormers were removed by your employee, I
will agreeo resolve the interior water damage if
the $14,_V6 re -roofing cost is dealt with without
having to involve the courts and the Better Business
Bureau. I will expect payment in the next 3 weeks.

Dear Ms. Sammarco:
You called our office to report a problem with your home in that you are
experiencing a seepage problem through the wall/ceiling/roof system.
A field inspection was conducted on June 5, 1980 following a substantial
rain from.the morning of that day. It was noted that in almost every
room of the structure there was evidence of moisture leaking into the
living areas. It appears that it occurs near the ceiling in almost
all instances.
This is a result of the waterproofing failing to seal off water frcgd
entering the interior of the structure.
This office can not determine the exact cause of fault which is causing
the failure. No waterproof design was ever submitted for' our review
and no inspection was called for or made prior to backfilling.
Therefore, you and/or your applicator must correct the problem. Since
this process is new, an inspection by a third party may be necessary
to determine the correction method.
This correction must occur as soon as possible; certainly within
30 days.
Please let this office know what your intentions are in this matter.

RE: Inspection report on my property at 1307 52nd Ave. N.E., Fridley, MN.
According to Julie Jones you are the person that inspected my property.
As you recall, on December 4, 2008, you did an "inspection" of my
property. You laid a wooden stake on the property line between my
neighbor Townsley on the West side, then you laid a wooden stake on the
East side of my property. On December 12, 2008,1 asked for a copy of the
inspection and I was told that the inspection was not written down yet.
December 13, 2008, Ralph Mallowitz, who requested you inspect my
property was given a copy of the inspection instead of the inspection of my
property being given to me. Ralph Mallowitz then advise me that I would
have to pay him $700.00 for the "free" inspection you did of my property.
That's extortion. That inspection should be placed in my file in Fridley
Department of Building Inspections, instead of being given to Mr. Mallwitz.
Somehow, Ralph managed to convince the Fridley Police that your
inspection is a Land Survey. A real land survey has to be done by a licensed
Land Surveyor, not an unlicensed Fridley Inspector. I have proof that your
December 4, 2008 Inspection is not correct.
[Minnesota Statute 326.11 -Unauthorized practice, disciplinary action,
subd. 3: Cease and desist order against a person that is unauthorized to
practice land surveying. M.S. 326.11 subd. 6(a)- The board of land
surveyors may impose a civil penalty not to exceed $10,000.00 for each
violation by a person who commits an act or practice constituting the
unauthorized practice of land surveying. (b) The Board may impose a fee to
reimburse the board for all or part of the cost of the proceedings resulting in
disciplinary action, and the imposition of civil penalties. The Board may
include the costs, not limited to, the amount paid by the board for services
from the office of administrative hearings, attorney fees, court reporters,
witnesses, reproduction of records, board members' per diem compensation,
board staff time, and expense incurred by board members and staff.]
