The Council of the City of Frid-
ley do ordain as follows:
SECTION 1. For the vacation of
a street cescribed as follows:
All that part of Jefferson
Street lying between Block 2
and Block 3 of Oak Hill Addi-
tion, and lying north of the
south line of Block 2 extended
west and south of the north
line of Block 2 extended west.
All being in the plat of Oak
Hill Addition located in the
South half (SIM of Section 23,

BEFORE THE
BOARD OF APPEALS
TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN that the Board of Appeals of the City of Fridley
will meet in the Council Chamber of the City Hall at 7:30 P.M. on Tuesday,
March 27, 1973 to consider the following matter:
A request for a variance of Section 45.053, 1,
Fridley City Code, to reduce the minimum lot
area from 9,000 square feet to 8070 square feet
to allow the construction of a dwelling on all
that part of vacated Jefferson Street lying
between Block 2, and Block 3, of Oak Hill Addition,
and lying north of the south line of Block 2
extended west and south of the north line of Block 2
extended west, all being in the plat of Oak Hill
Addition, the same being 581 - 53rd Avenue N.E.,
Fridley, Minnesota. (Request by Mr. Irving Olund,
571 - 53rd Avenue N.E., Fridley, Minnesota.)
Anyone who desires to be heard with reference to the above matter may
be heard at this meeting.

A REQUEST FOR A VARIANCE OF SECTION 45.053, 1. FRIDLEY CITY CODE, TO REDUCE THE
MINIMUM LOT AREA FROM 9,000 SQUARE FEET TO 8070 SQUARE FEET TO ALLOW THE
CONSTRUCTION OF A DWELLING ON ALL THAT PART OF VACATED JEFFERSON STREET LYING
BETWEEN BLOCK 2, AND BLOCK 3, OF OAK HILL ADDITION, AND LYING NORTH OF THE SOUTH
LINE OF BLOCK 2, EXTENDED WEST AND SOUTH OF THE NORTH LINE OF BLOCK 2 EXTENDED
WEST, ALL BEING IN THE PLAT OF OAK HILL ADDITION, THE SAME BEING 581 - 53RD
AVENUE N.E., FRIDLEY, MINNESOTA. (REQUEST BY MR. IRVING OLUND, 571 - 53RD AVENUE
N.E., FRIDLEY, MINNESOTA.)
MOTION by Crowder to waive the reading of the public hearing notice.
Seconded by Wahlberg. Upon a voice vote, there being no nays, the motion
carried. ,
Mr. Irving Olund was present to present the request. He said that the property
in question was a vacated 60 foot street right of way. He owned the property
to the west and his garage was set 5 feet off of the property in question. The
property to the east had 20 feet from the property line to the garage. He said
that he would like to build a house with a detached garage and either move into
it or sell it because he can't afford to pay taxes for both lots.
Mr. Crowder asked who is primarily affected by this variance? Mr. Olund said
the neighbor to the east. He said that he tried to buy some land from him but
he wouldn't sell any. The neighbor vas aware of the appeal and had no objections.
Mr. Harju asked if anyone wanted to be heard on this matter.
Jim Baker, 564 - 53h Avenue N.E., said that he was the neighbor behind the lot
to the north. He said that he came only to find out what was happening and
how it would affect his property and that he had no objection to what was
proposed.
10TION by Crowder to close the public hearing.
Seconded by Wahlberg. Upon a voice vote, there being no nays, the motion
carried unanimously.
Mr. Harju said that this is not dissimilar to what has been brought to the
Board many times.
Mr. Crowder asked what are the variances being requested? Mr. Boardman said
they were: 1. Reduce area required from 9,000 square feet to 8070 square feet.
2. Reduce the lot width from 75 feet to 60 feet.
MOTION by Wahlberg to recommend to Council approval of the variances as
requested.
Seconded by Crowder. Upon a voice vote, there being no nays, the motion
carried.
ADJOURNMENT:
The meeting was adjourned by Acting Chairman Harju at 8:45 P.M.
