The building official shall be an ex officio member of and shall act as secretary to said board but shall have no vote on any matter before the board. The board of appeals shall be appointed by the governing body and shall hold office at its pleasure. The board shall adopt rules of procedure for conducting its business, and shall render all decisions and findings in writing to the appel- lant with a duplicate copy to the building official. 105.2 Limitations of Authority. The board of appeals shall have no authority relative to interpretation of the administrative provisions of this code nor shall the board be empowered to waive requirements of this code. SECTION 106 — PERMITS 106.1 Permits Required. Except as specified in Section 106.2, no building or structure regulated by this code shall be erected, constructed, enlarged, altered, repaired, moved, improved, re- moved, converted or demolished unless a separate permit for each building or structure has first been obtained from the building offi- cial. 106.2 Work Exempt from Permit. A building permit shall not be required for the following: 1. One-story detached accessory buildings used as tool and storage sheds, playhouses, and similar uses, provided the floor area does not exceed 120 square feet (11.15 m2). 2 Fences not over 6 feet (1829 mm) high. 3. Oil derricks. 4. Movable cases, counters and partitions not over 5 feet 9 inches (1753 mm) high. 5. Retaining walls that are not over 4 feet (1219 mm) in height measured from the bottom of the footing to the top of the wall, un- less supporting a surcharge or impounding Class I, II or III -A liq- uids. 6. Water tanks supported directly upon grade if the capacity does not exceed 5,000 gallons (18 927 L) and the ratio of height to diameter or width does not exceed 2:1. 7. Platforms, walks and driveways not more than 30 inches (762 mm) above grade and not over any basement or story below. 8. Painting, papering and similar finish work. 106.2 1997 UNIFORM BUILDING CODE 106.4.1 9. Temporary motion picture, television and theater stage sets and scenery. 10. Window awnings supported by an exterior wall of Group R, Division 3, and Group U Occupancies when projecting not more than 54 inches (1372 mm). 11. Prefabricated swimming pools accessory to a Group R, Di- vision 3 Occupancy in which the pool walls are entirely above the adjacent grade and if the capacity does not exceed 5,000 gallons (18 927 L). Unless otherwise exempted, separate plumbing, electrical and mechanical permits will be required for the above -exempted items. Exemption from the permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. 1063 Application for Permit. 1063.1 Application. To obtain a permit, the applicant shall first file an application therefor in writing on a form furnished by the code enforcement agency for that purpose. Every such application shall: 1. Identify and describe the work to be covered by the permit for which application is made. 2. Describe the land on which the proposed work is to be done by legal description, street address or similar description that will readily identify. and definitely locate the proposed building or work. 3. Indicate the use or occupancy for which the proposed work is intended. 4. Be accompanied by plans, diagrams, computations and specifications and other data as required in Section 106.3.2. 5. State the valuation of any new building or structure or any addition, remodeling or alteration to an existing building. 6. Be signed by the applicant, or the applicant's authorized agent. 7. Give such other data and information as may be required by the building official. 1063.2 Submittal documents. Plans, specifications, engineer- ing calculations, diagrams, soil investigation reports, special in- spection and structural observation programs and other data shall constitute the submittal documents and shall be submitted in one or more sets with each application for a permit. When such plans are not prepared by an architect or engineer, the building official may require the applicant submitting such plans or other data to demonstrate that state law does not require that the plans be pre- pared by a licensed architect or engineer. The building official may require plans, computations and specifications to be prepared and designed by an engineer or architect licensed by the state to practice as such even if not required by state law. EXCEPTION: The building official may waive the submission of plans, calculations, construction inspection requirements and other data if it is found that the nature of the work applied for is such that re- viewing of plans is not necessary to obtain compliance with this code. 10633 Information on plans and specifications. Plans and specifications shall be drawn to scale upon substantial paper or cloth and shall be of sufficient clarity to indicate the location, na- ture and extent of the work proposed and show in detail that it will conform to the provisions of this code and all relevant laws, ordi- nances, rules and regulations. Plans for buildings of other than Group R, Division 3 and Group U Occupancies shall indicate how required structural and fire - resistive integrity will be maintained where penetrations will be made for electrical, mechanical, plumbing and communication conduits, pipes and similar systems. 1063.4 Architect or engineer of record. 1063.4.1 General. When it is required that documents be pre- pared by an architect or engineer, the building official may require the owner to engage and designate on the building permit applica- tion an architect or engineer who shall act as the architect or engi- neer of record. If the circumstances require, the owner may designate a substitute architect or engineer of record who shall perform all of the duties required of the original architect or engi- neer of record. The building official shall be notified in writing by the owner if the architect or engineer of record is changed or is un- able to continue to perform the duties. The architect or engineer of record shall be responsible for re- viewing and coordinating all submittal documents prepared by others, including deferred submittal items, for compatibility with the design of the building. 1063.4.2 Deferred submittals. For the purposes of this section, deferred submittals are defined as those portions of the design that are not submitted at the time of the application and that are to be submitted to the building official within a specified period. Deferral of any submittal items shall have prior approval of the building official. The architect or engineer of record shall list the deferred submittals on the plans and shall submit the deferred sub- mittal documents for review by the building official. Submittal documents for deferred submittal items shall be sub- mitted to the architect or engineer of record who shall review them and forward them to the building official with a notation indicat- ing that the deferred submittal documents have been reviewed and that they have been found to be in general conformance with the design of the building. The deferred submittal items shall not be installed until their design and submittal documents have been ap- proved by the building official. 1063.5 Inspection and observation program. When speci inspection is required by Section 1701, the architect or engineer record shall prepare an inspection program that shall be submitt. to the building official for approval prior to issuance of the buil ing permit. The inspection program shall designate the portions the work that require special inspection and the name or names the individuals or firms who are to perform the special inspt tions, and indicate the duties of the special inspectors. The special inspector shall be employed by the owner, the en, neer or architect of record, or an agent of the owner, but not 1 contractor or any other person responsible for the work. When structural observation is required by Section 1702, the spection program shall name the individuals or firms who are perform structural observation and describe the stages of construction at which structural observation is to occur. The inspection program shall include samples of inspection re- ports and provide time limits for submission of reports. 106.4 Permits Issuance. 106.4.1 Issuance. The application, plans, specifications, com- putations and other data filed by an applicant for a permit shall be reviewed by the building official. Such plans may be reviewed by other departments of this jurisdiction to verify compliance with any applicable laws under their jurisdiction. If the building official finds that the work described in an application for a permit and the plans, specifications and other data filed therewith conform to the requirements of this code and other pertinent laws and ordinances, 1-3 In effect January 1, 2003. All electrical inspection fees are due and payable to the City of Fridley at 6431 University Avenue NE, Fridley, MN 55432, at or before commencement of the installation and shall be forwarded with the request for inspection. 2. Fee Schedule. Fees shall be paid according to the following schedule: State currharge of $_SO added to all permi f s_ (a) Minimum Fees. (1) Residential. The fee for the service and feeders in an apartment building shall be in accordance with 2b and 2c of the schedule and shall be added to the fee for circuits in individual apartments. The maximum fee for an apartment applies only to the circuits in the apartment. A two-family unit (duplex) maximum fee per unit as per single family dwelling. (3) The maximum number of 0 to 100 ampere circuits to be paid on any one athletic field lighting standard is ten. (4) The fee for mobile homes shall be in accordance with 2b and 2c of this fee schedule. (5) In addition to the above fees: (a) A charge of $2.00 will be made for each lighting standard. (b) A charge of $3.00 will be made for each traffic signal standard. Circuits originating within the standard will not be used when computing the fee. (6) In addition to the above fees, all transformers and generators for light, heat and power shall be computed separately at $5.00 per unit plus $3.00 per 10 Kilovolt amperes or fraction thereof. (7) In addition to the above fees, all transformers for signs and outline lighting shall be computed at $5.00 per unit. (8) In addition to the above fees (unless included in the maximum fee filed by the initial installer) remote control, signal circuits and circuits of less than 50 volts shall be computed at $6.00 per each ten openings or devices of each system plus $.50 for each opening. (d) For the review of plans and specifications of proposed installations, there shall be a minimum fee of $100.00, up to and including $30,000 of electrical estimate, plus 1/10 of 1% of any amount in excess of $30,000 to be paid by persons or firms requesting the review. (e) When a reinspection is necessary to determine whether unsafe conditions have been corrected and such conditions are not subject to an appeal pending before the Board or any court, a reinspection fee of $25.00 for residential and $30.00 for nonresidential, may be assessed in writing by the inspector. (f) For inspections not covered herein, or for requested special inspections or services, the fee shall be $32.00 per hour, including travel time, plus $.40 per mile traveled, plus the reasonable cost of equipment or material consumed. This section is also applicable to inspection of empty conduits and such other jobs as determined by the City. (g) For inspection of transient projects including but not limited to carnivals and circuses, the inspection fees shall be computed as follows: (1) Power supply units, according to 2b of the schedule. A like fee will be required on power supply units at each engagement during the season, except that a fee of $32.00 per hour will be charged for additional time spent by the inspector, if the power supply is not ready for inspection at the time and date specified on the request for inspection as required by law. (2) Rides, devices, or concessions, shall be inspected at their first appearance of the season and the inspection fee shall be $25.00 per unit. In addition to the fee for the power supply units, there shall be a general inspection for each engagement during the season at the hourly rate, with a two hour minimum. In addition to the above fees, inspections required on Saturdays, Sundays, holidays or after regular business hours will be at the hourly rate, including travel time. An owner of a migratory amusement enterprise shall notify the inspector and make application for inspection a minimum of 14 days before its engagement in Fridley. When the inspector is not notified at least 48 hours in advance, a charge of $100.00 will be made in addition to all required fees. (h) For purposes of interpretation of the provisions of this chapter, the most recently published edition of the National Electrical Code shall be prima facie evidence of the definitions, interpretations and scope of words and terms used in this chapter. (i) In addition to the above fees, the inspection fee for each separate inspection of a swimming pool shall be computed at $25.00. Reinforcing steel for swimming pools requires a rough -in inspection. 3. Minor Repair Work Defined. Minor repair work as used in MS 326.244 shall mean the adjustment or repair and replacement of wom or defective parts of electrical fixtures, switches, receptacles and other equipment provided that such minor ` . repairs are made in compliance with accepted standards of construction for safety to life and property as defined in MS 326.243 and do not require replacement of the wiring to them. The City's inspectors or agents may inspect any such minor repairs at the request of the owner or person making such repairs. 4. Condemnation of Hazardous Installations. When ordered: When an electrical inspector finds that a new installation or part of a new installation that is not energized is not in compliance with accepted standards of construction as required by MS 326.243 Safety Standards of the Minnesota Electrical Act, the inspector shall if the installation or the noncomplying part thereof is such as to seriously and proximately endanger human life and property if it was to be energized, order with the approval of the Building Inspector, immediate condemnation of the installation or noncomplying part. When the person responsible for making the installation condemned hereunder is notified, they shall promptly proceed to make the corrections cited in the condemnation order. 5. Disconnection of Hazardous Installation. When ordered: If while making an inspection, the electrical inspector finds that a new installation that is energized is not in compliance with accepted standards of construction as required by MS 326.243 Safety Standards of the Minnesota Electrical Act, the inspector shall, if the installation or the noncomplying part thereof is such as to seriously and proximately endanger human life and property, order immediate disconnection of the installation or noncomplying part. When the person responsible for making the installation ordered disconnected hereunder is notified, they shall promptly proceed to make the corrections cited in this disconnect order. 6. Corrections of Noncomplying Installations. When a noncomplying installation, whether energized or not, is not proximately dangerous to human life and property, the inspector shall issue a correction order, ordering the owner or contractor to make the installation comply with accepted standards of construction for safety to life and property, noting specifically what changes are required. The order of the inspector shall specify a date of not less than 10 nor more than 17 calendar days from the date of the order. 1991 UNIFORM MECHANICAL CODE 301-302 Chapter 3 PERMITS AND INSPECTIONS Permits Sec. 301. (a) Permits Required. Except as permitted in Subsection (b) of this section, no mechanical system regulated by this code shall be installed, altered, repaired, replaced or remodeled unless a separate mechanical permit for each separate building or structure has first been obtained from the building official. (b) Exempt Work. A mechanical permit shall not be required for the following: 1. A portable heating appliance, portable ventilating equipment, portable cooling unit or portable evaporative cooler. 2. A closed system of steam, hot or chilled water piping within heating or cooling equipment regulated by this code. 3. Replacement of any component part or assembly of an appliance which does not alter its original approval and complies with other applicable requirements of this code. 4. Refrigerating equipment which is part of the equipment for which a permit has been issued pursuant to the requirements of this code. 5. A unit refrigerating system. Exemption from the permit requirements of this code shall not be deemed to ant authorization for work to be done in violation of the provisions of this code or other laws or ordinances of this jurisdiction. Plans, engineering calculations, diagrams and other data shall be submitted in one or more sets with each application for a permit. When such plans are not prepared by an architect or engineer, the building x official may require any applicant submitting such plans or other data to demon- strate that state law does not require that the plans be prepared by an architect or k engineer. The following chapter of the code is adopted without change by the City: A. Chapter 1305.0020 Subpart 2: 33, Excavation and Grading 4. Organization and Enforcement. A. The organization of the Building Division and enforcement of the code shall be as established by Chapter 1 of the Uniform Building Code 1997 Edition. The Code shall be enforced within the incorporated limits of the City and extraterritorial limits permitted by Minnesota Statutes. B. The Building Inspection Division shall be the Building Code Department of the City of Fridley. The Administrative authority shall be a State Certified Building Official. (Minnesota Statute 16B.65) C. The City Manager shall be the Appointing Authority and designate the Building Official for the jurisdiction of Fridley. (Ref. 961) 206.02. CONFLICTS In the event of any conflict between the provisions of this Code adopted by the provisions of this Chapter and applicable provisions of State law, rules or regulations, the latter shall prevail. 206.03. TERNIITS AND FEES The issuance of permits, and collection of fees shall be as authorized in Minnesota Statute 16B.62 subdivision 1 and 16B.70 and as provided for in Chapter 1 of the 1997 Uniform Building Code and Minnesota rules parts 1305.0106 and 1305.0107. Section 107.3, is amended to read "...except on occupancy groups R-3 and U.1 ". (Ref. 90 1) 2. Violations and Penalties. A violation of the code is a misdemeanor (Minnesota Statute 16B.69) 3. The fee schedules shall be as follows: A. Plan Review Fees. (1) When a plan or other data are submitted for review, a plan review fee shall be paid at the time of submitting plans and specifications for review. (2) Where plans are incorporated or changed so as to require additional plan review an additional plan review fee shall be charged. (3) Applications for which no permit is issued within 180 days following the date of application shall expire by limitation and plans and other data submitted for review may thereafter be returned or destroyed. The building official may extend the time for action by the applicant once for a period not exceeding 180 days upon request by the applicant. (4) The plan review fee shall be 65 percent (65%) of the building permit fee and shall be credited to the building permit plan check fee if a permit is obtained within 180 days following the completion date of plan review. (Ref. 901) Minnesota Statutes 2002, 16B.62 Minnesota Statutes 2002, Table of Chanters Table of contents for Chapter 16B 16B.62 State Building Code; application. Subdivision 1. Municipal enforcement. The State Building Code applies statewide and supersedes the building code of any municipality. A municipality must not by ordinance or through development agreement require building code provisions regulating components or systems of any residential structure that are different from any provision of the State Building Code. A municipality may, with the approval of the state building official, adopt an ordinance that is more restrictive than the State Building Code where geological conditions warrant a more restrictive ordinance. A municipality may appeal the disapproval of a more restrictive ordinance to the commissioner. An appeal under this subdivision is subject to the schedule, fee, procedures, cost provisions, and appeal rights set out in section 16B.67. The State Building Code does not apply to agricultural buildings except with respect to state inspections required or rulemaking authorized by sections 103F.141, 216C.19, subdivision 8, and 326.244. All municipalities shall adopt and enforce the State Building Code with respect to new construction within their respective jurisdictions. If a city has adopted or is enforcing the State Building Code on June 3, 1977, or determines by ordinance after that date to undertake enforcement, it shall enforce the code within the city. A city may by ordinance extend the enforcement of the code to contiguous unincorporated territory not more than two miles distant from its corporate limits in any direction. Where two or more noncontiguous cities which have elected to enforce the code have boundaries less than four miles apart, each is authorized to enforce the code on its side of a line equidistant between them. Once enforcement authority is extended extraterritorially by ordinance, the authority may continue to be exercised in the designated territory even though another city less than four miles distant later elects to enforce the code. After the extension, the city may enforce the code in the designated area to the same extent as if the property were situated within its corporate limits. A city which, on June 3, 1977, had not adopted the code may not commence enforcement of the code within or outside of its jurisdiction until it has provided written notice to the commissioner, the county auditor, and the town clerk of each town in which it intends to enforce the code. A public hearing on the proposed enforcement must be held not less than 30 days after the notice has been provided. Enforcement of the code by the city outside of its jurisdiction commences on the first day of January in the year following the notice and hearing. Municipalities may provide for the issuance of permits, inspection, and enforcement within their jurisdictions by means which are convenient, and lawful, including by means of contracts with other municipalities pursuant to section 471.59, h4://www.revisor.leg.state.mn.us/stats/16B/62.html Page 1 of 2 3/31/2003 . Minnesota Statutes 2002, 16B.62 and with qualified individuals. The other municipalities or qualified individuals may be reimbursed by retention or remission of some or all of the building permit fee collected or by other means. In areas of the state where inspection and enforcement is unavailable from qualified employees of municipalities, the commissioner shall train and designate individuals available to carry out inspection and enforcement on a fee basis. Nothing in this section prohibits a municipality from adopting ordinances relating to zoning, subdivision, or planning unless the ordinance conflicts with a provision of the State Building Code that regulates components or systems of any residential structure. Subd. 2. Enforcement by state building official. If the commissioner determines that a municipality is not properly administering and enforcing the State Building Code as provided in section 16B.71, the commissioner may have the administration and enforcement in the involved municipality undertaken by the state building official. The commissioner shall notify the affected municipality in writing immediately upon making the determination, and the municipality may challenge the determination as a contested case before the commissioner pursuant to the Administrative Procedure Act. In municipalities not properly administering and enforcing the State Building Code, and in municipalities who determine not to administer and enforce the State Building Code, the commissioner shall have administration and enforcement undertaken by the state building official or by another inspector certified by the state. In carrying out administration and enforcement under this subdivision, the commissioner shall apply any optional provision of the State Building Code adopted by the municipality. A municipality adopting any optional code provision shall notify the state building official within 30 days of its adoption. The commissioner shall determine appropriate fees to be charged for the administration and enforcement service rendered. Any cost to the state arising from the state administration and enforcement of the State Building Code shall be borne by the subject municipality.
