The concern Mr. Harnish had was that he would have water standing in his yard due to raising of the curb. Ray Statler surveyed the yard to determine pre and post construction drainage patterns. Based on the survey elevations, the bituminous curb that was there prior to construction was higher than the existing yard resulting in poor drainage of their yard and ponding in the low spots. Mr. Harnish had stated that a portion of the curb was removed on the easterly end of his yard, which he felt let some of the water drain to the street. It is my understanding that it was initially proposed to provide some black dirt to fill in some of the low spots in the yard and to remove a small amount of topsoil in an area to provide positive drainage in an east/west direction. At the time, Mr. Harnish was not agreeable to this and wanted the yard filled and sodded. During our November 15th meeting, I discussed with Mr. Harnish the filling -of the low spots in his yard and removing a small amount of topsoil to provide drainage across his yard as previously occurred. I explained that we would try this approach as it should take care of any drainage concerns he may have. He stated he wanted the yard filled and sodded and was concerned that any grading may damage a tree in his yard. I explained that the grading would be minimal and done by hand, and should not damage the tree. At that point he said OK but still felt the yard should be filled and sodded Northwest Asphalt was scheduled to perform the work the next day, November 16. At approximately 10:30 am Mrs. Harnish called and directed us not to do any remedial work in their yard as they would not be satisfied unless it was filled and sodded. Burns, City Manager PW94-149 FROM: Scott Erickson, Asst Public Works Directory DATE: May 3, 1994 SUBJECT: 1349 53rd Avenue - Len Harnisch (Drainage Concerns) In the fall of 1993, 1 had spoken with Mr. & Mrs. Harnisch regarding yard drainage concerns they have relating to the overlay of 53rd Avenue (see attached letter). During the week of April 29, 1994, Mrs. Harnisch called and again asked us to meet with her and her husband regarding the yard grading. She had stated that they would like some top soil dropped off as they would like to do any leveling themselves and stated they would like to meet with the City to discuss the details. On May 3, 1994 at 11:00 am, I and Jon Thompson met with Mr. Harnisch in order to reach a solution to his concerns. Mr. Harnisch stated that he would expect over 75% of his yard to be regraded and sodded from the curb to his house. He was not receptive to his wife's original request for top soil and stated that if it were only top dressed, he would not be satisfied with the results. We have attempted on many occasions to provide reasonable solutions regarding his concerns to no avail. As we will soon be finishing the restoration of the 1993 street project, we are attempting to find a reasonable solution for their concerns. According to the 1991 Uniform Mechanical Code, a final inspection shall be conducted on the work authorized by this permit. As of this date, no inspection has been called for. The permit fee that was paid covers the inspection to make sure the work was completed according to the Code. We will keep your permit open for another 30 days and if we do not hear from you within this time to set up the inspection, we will mark the permit "no inspection called for" and take no further action.
