SUBJECT: Possible Illegal Duplex/541 - 53 1/2 Avenue N.E.
Recently I received a complaint concerning the operation of a two-
family dwelling unit in an R-1 (Single Family) district at the
above address. A visual inspection revealed that this does appear
to be a duplex, since there is a separate entrance with its own
mailbox at the southwest corner of the building.
Upon checking with the Fire Department, who is responsible for all
rental housing inspections, I learned that we have had previous
involvement at this address. In 1986, after receiving a tenant
complaint, a Fire Department official inspected the property and
mandated improvements. As part of this process, the property owner
was required to obtain a City license to operate rental housing.
He subsequently did so, and the site was officially licensed by the
City as a two-family dwelling unit. The property owner has
continued to purchase an annual license for this duplex each year
since 1986.
The Fire Department was apparently unaware of the zoning designa-
tion of this property, since*a duplex should not be allowed in an
R-1 district. Does the property owner's interaction with the Fire
Department, including maintaining an annual rental license,
constitute City authorization for such use; or is the property
owner still expected to check with the appropriate department for
other considerations? Can the City now stop such use at this time?

On August 3, 1990, you indicated that Counci z gs inquired
as to the status of this code violation. You stated that
Councilman Billings has three questions:
1. Is the property zoned R-1, Single Family?
2. Is there a conflict between what the Section 8 housing liaison
is requiring and how we enforce our policies on mother-in-law
apartments?
3. Why is the Fire Department issuing a rental license for a
rental unit if it is in violation of our policies on illegal
duplexes?
Steve Barg has been working with the property owner, Tom and Pat
Olin, regarding the illegal duplex. In fact, he has sent a letter
dated June 18, 1990 (see attached) advising the owner that they
must discontinue operation of this dwelling as a two family
dwelling unit. Because tenants are currently residing in both
units, we advised the property owner to correct the situation on
or before December 31, 1990. One of the parties living in one unit
is receiving Section 8 assistance; however, Pat Wolfe advised us
that the owner advised her that she was evicting the Section 8
tenant for disturbing the neighbors with loud parties.
To answer Councilman Billings' question:
1. The property is zoned R-1, Single Family.
2. HUD requirements dictate that one unit must be separate from
another unit. This has been defined as providing a dead bolt
lock on the living area door. In this situation, this
requirement would be in conflict with the interior door policy

that we have been enforcing since 1988. In order to comply
with that requirement, there would not be a door into the
living area which is located in the basement of this dwelling.
3. Chapter 220 of the City Code requires that property owners
having rental property must first obtain a license to do so.
This property was issued a license in 1986 as a result of a
complaint by a tenant regarding a construction issue of the
unit. Upon inspection by the Fire Department, it was
discovered that the unit did not meet the fire codes in
regards to the bedroom window exits and that there was no
bathroom window or vent fan. Compliance to these requirements
were completed and a rental license was issued.
The rental license procedure which is currently enforced does
not provide for a review process by the Planning office in
regards to zoning compliance. We need to correct this
problem. The Fire Department should not have to be made
responsible for zoning issues as well.
This case raises additional issues about building safety if
a mother-in-law or accessory apartment would be permitted.
Smoke detection equipment, bathroom windows or ventilation,
and bedroom window egress should be provided for.
Another issue which is not clearly addressed is whether or not
owners should apply for a rental license if they are renting
a guest room as provided in the zoning ordinance in the R-1
district. Chapter 220 is unclear on this issue.
In summary, while this matter is being resolved in that staff has
determined that the dwelling does not meet our interior door policy
and is an illegal duplex, and whereas we are aware that the owner
is taking action to evict one of the parties, other larger issues
need to be addressed:
1. Zoning review process of rental licenses
2. Building safety requirements for legal accessory apartments,
and how to enforce those requirements
3. Rectify code inconsistencies

above referenced location. While I an aware that you have a current rental
license for this use, the Fridley Zoning Code prohibits the operation of a
two family dwelling unit in an R-1 (Single Family) district. I have enclosed
a copy of the dwelling unit definition for your review.
It is necessary that you take one of the following actions to bring this
residence into compliance within the next six months:
1. Discontinue operating the property as a two family dwelling unit.
2. Make alterations to meet Code requirements by creating a situation
whereby at least one party has access to the entire residence.
(For example, removing an interior door may eliminate the "two
separate dwelling unit" problem addressed by the Code.) Should you
choose this option, please make sure that you are in compliance
with the enclosed regulations concerning guest room rental.
It is expected that you make the necessary arrangements to correct this
situation on or before December 31, 1990. Please feel free to call me at
