MOTION by Ms. Jackson, seconded by Mr. Jones, to approve the September 13, 2000,
Appeals Commission meeting minutes as presented.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED
THE MOTION CARRIED UNANIMOUSLY.
1. PUBLIC HEARING: VARIANCE REQUEST. VAR #00-26. BY DESIGN
RENOVATIONS, INC:
Per Section 205.07.03.0 of the Fridley Zoning Code, to increase the lot coverage
from 25% to 25.6%: and
Per Section 205.07.03.D.(2).(a) of the Fridley Zoning code, to reduce the side
yard setback between living area and the side property line from 10 feet to 5 feet;
To allow the construction of an addition on Lot 20, Block 10, Donnay's Lakeview
Manor Addition, generally located at 510 57th Avenue.
MOTION by Mr. Jones, seconded by Mr. Tynjala, to waive the reading and open the
public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED
THE MOTION CARRIED AND THE PUBLIC HEARING OPENED AT 7:31 P.M.
Mr. Hickok stated that the house was built in 1956 and placed on a lot with a five foot
setback. The lot between this house and the corner lot was partially used for street
right-of-way with the remaining lot abandoned. This creates an additional 42 feet by
135 feet on the disputed side of the house. The house would be designed to meet
handicap requirements with this improvement. The petitioner is seeking variances to
recognize an existing element about the home, thereby allowing an expansion and
increasing the accessibility at the property.

Mr. Hickok stated there is another lot between the edge of their house and the roadway.
A major portion of that was used for right-of-way when the 7t�' street improvements were
made. The residual portion of that lot remains and functions somewhat as a side yard
for the petitioner's property. The living quarters are staying the same. A new roof is
going on with a different roof pitch and some updates to modernize the exterior such as
new siding, window treatments, and the garage will now be attached. Some
enhancements to allow handicap accessibility will provide a sheltered ramp.
Mr. Hickok stated the City has granted similar variances in the past. At 369 Hugo
Street, the side yard setback was reduced to five feet. In 1995, the lot coverage was
increased to 28% at 7301 Lyric Lane. Staff has no recommendation except for one
stipulation if the Appeals Commission approves the variances.
Ms. Jackson asked who owned the land west to the lot line.
Mr. Hickok stated he believed that is City right-of-way.
The petitioner, Mr. Christensen, stated that it is right-of-way that has been left and
abandoned.
Ms. Jackson asked if the homeowners maintained it.
Mr. Hickok stated that it is like a boulevard in front of a house.
Mr. Tynjala asked if the lot could be developed.
Mr. Hickok stated it is substandard in width.
Mr. Tynjala asked if the increase in size is because the garage is significantly bigger.
Mr. Hickok stated that, yes, because the garage is bigger and the fact that it is attached
has caused additional coverage area.
Mr. Jones asked if decks counted in lot coverage.
Mr. Hickok stated they do not, only if a deck has roof over it.
Mike Chevrette, owner of 510 57t' Avenue, stated that they are not only planning on
adding a garage, but the existing west wall will be an addition.
Mr. Christensen stated that they are maintaining the same west setback given, but they
are just squaring the house off.
Mr. Kuechle asked about the section of land to the west.
Mr. Chevrette stated that area is a beautiful garden and has a wood fence that is six
feet high with chain link on the north side.
Mr. Kuechle asked about the width of the lot.

Mr. Christensen stated that there is about 34 feet left. The City abandoned the land
years ago because it had no use for it. The Chevrettes thought they owned it until
recently.
Mr. Chevrette stated that they are hoping to be as good of neighbors as they can being
located by Medtronic. Hopefully, this remodeling will add more beautification. The
entire interior is also being gutted in order to make it more accessible for himself.
MOTION by Mr. Tynjala, seconded by Ms. Jackson, to close the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED
THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:47 P.M.
Ms. Jackson stated she had no problem with this and felt it was a good plan.
Mr. Kuechle stated that the increase in lot size is very minor and the five foot setback
already exists. The neighboring lot being 34 feet wide means that it is not buildable and
will stay that way. He would recommend approval.
Mr. Tynjala concurred. It will be a very nice project.
Mr. Jones also agreed. He did not see a problem with extending that side of the house
on that side. He would vote for approval.
MOTION by Ms. Jackson, seconded by Mr. Tynjala, to approve Variance Request, VAR
#00-26, with the following stipulation:
1. The petitioner shall obtain all necessary building permits.

variance, VAR #00-26, to increase the lot coverage from 25% to 25.6% and to reduce the side
yard setback between the living area and side property line from 10 feet to 5 feet, to allow the
construction of an addition on Lot 20, Block 10, Donnay's Lakeview Manor Addition, generally
located at 510 5r Avenue, with the following stipulation:
1. The petitioner shall obtain all necessary building permits.

you cannot begin construction during this time, you must submit a letter requesting an

REQUEST
Petitioner is seeking to reduce the required sideyard setback, for living area, from 10' to 5' to

ANALYSIS
The lot is rectangularly shaped, with the home being "squared up" to and fronting on 57th Street.
The existing home was built in 1956. An addition was constructed in 1980. The addition would
not encroach closer to the lot lines than the current home already does. The increase in lot
coverage will not be noticeable. City staff has received no comments from neighboring property
owners.
RECOMMENDATIONS
City Staff has no recommendation, as similar variances have been granted in the past.

ARGUEMENTS FOR GRANTING VARIANCE
510 57TH AVE NE FRIDLEY MN.
1. House was built in 1956 and placed on the lot with a 5 foot setback. This became a
given for us 44 years later.
2. Lot between this house and corner lot was partially used for a street right of way with
the remaining lot abandoned. This creates an additional 42 feet by 135 feet on the
disputed side of the house.
3. By allowing a continuous extension of the house on the street side we will be able to
enhance the exterior street appearance and appearance to the new Medtronic entrance.
This will also allow the interior of the house to be designed to meet the handicap
needs of the owner.
Summary of Scope of Work:
• Existing garage, decks outbuildings will be removed
• House designed with a roof pitch, new siding, windows and exterior components to
bring the house into a more current style.
• Appearance will encourage other home owners on the block to enhance the
appearance of there properties.
• House and garage will be attached to give a more uniform appearance.
• Decks, ramps, and walkways will be redone to enhance the exterior appearance of the
property.
• Most important house will be designed to meet the handicap requirements of the
owner to allow them to remain in the community.
