Please be advised that as of this date the driveway in question has been replaced. (As a matter of fact, the driveway replace- ment was done on August 22nd prior to receipt of your corres- pondence.) The circumstances however, that led to the complaint from Mr. Zala included more 'than just the City of Fridley. The City had made arrangements with the general contractor to replace Mr. Zala's driveway a number of weeks ago, but due to certain commitments of the general contractor there was a delay in the replacement. There was never any doubt that the driveway would be replaced, it was just a matter of scheduling the replacement. I hope the above is an indication of correction of the problem. Colbert, Assistant City Engineer DATE: SUBJECT: September 15, 1977 ITEMS OF CONCERN AT PRE -COUNCIL MEETING OF SEPTEMBER 12 Of the three items that you mentioned to me, a follow up report indicates that: 1. The vacant lot at 1584 - 75th Avenue is presently in the torrens pro- ceedings to establish ownership. ` 3• Contact with the future property owner indicates that once the torrens proceedings are complete, he anticipates applying for a building per- mit within the next 4-6 weeks. Steve Olson, the Environmental Officer, reviewed the lot and it was determined that the weeds on this lot have been cut twice this year, which is all that is required under our Weed Control Ordinance. As far as the minor refuse and debris existing on the lot, no clean up order will be issued unless the condition gets worse or a building permit is not applied for before winter. The driveway restoration at 54 - Avenue/was performed to correct structural problems. This restoration was extended beyond that required, due to the existing section of his private driveway being in a substan- dard thickness. That is the reason for the non-uniform match lines. This additional work although not the responsibility of the city, was performed to ensure the home owner's satisfaction with the finished product. As for the small circular patch in the middle of the new restoration, this was performed at the expressed request and direction of the prop- erty owner upon completion of the driveway. Verbal response from him indicates that the job was performed to his satisfaction. Contact was made with the Minnesota Department of Transportation re- garding the finished landscaping performed behind the noise barrier by the east end of Cheri Lane. They indicated that they have been In twice to cut weeds and re -seed, but due to the property owners reluctance to perform normal maintenance to ensure proper turf estab- lishment, (mowing and watering) the seed never took hold. They also Indicated that they will be in one more time within the next week to ten days to again, re -seed the area. They feel that -this should satisfy any type of responsibility that the Highway Department would have towards their completion of the project. If the home owners do not cooperate in maintaining the work performed by the Highway Department, the satis- factory appearance cannot be guaranteed.
