Dear Sirs:
I am writing this letter in reguard to my home at 555 57th Ave.
N.E. Fridley, Minnesota. We bought this house from Vern Donnay Reality
new in April 1970, we moved into the house in September 1970 and paid
$6 29,865.00 full purchase price.
Within ten days we completed a list of all repairs and replacements
due, and mailed a copy to Vern Donnay Reality main office and was told
these repairs would be completed within one year. Granted most of these
repairs have been made and most of them satisfactorily. The walls in
the recreation room, the wall going to the lower level, the living room
walls and a wall in the kitchen still show where they have been patched
on almost all of the studs. When Mr. Clark was out with Mr. Madison
from Vern Donnays office he made the suggestion of repainting in hopes
of correcting the problem, due to the fact I wanted to change colors
in the recreation I painted the walls with three coats of paint with
no luck, since then Vern Donnay Reality repainted the walls and they
still have not improved. When I painted the walls I did so with the
permission of Mr. Madison and at my expence, I feel due to the fact
that this house was new it should look like it, and so should the
workmanship.
I am also unhappy about my cathedral ceiling in the living room,
it got a crack in it and was repaired and now'looks like patch work.
It also has a stain from moisture on one part of the ceiling because
they failed to put a vent above the closet joining the living room.
The walls in the closet were stained also, they were repainted by
Vern Donnay Reality then, why won't they paint my ceiling? Mr. Madison
said they would not paint to cover their patch work or the moisture
stain. I feel due to the two complaints on the ceiling in the living
room they should repaint at their expence.
I do not release Vern Donnay Reality on the above complaints and
intend to hold my position until these repairs have been made
satisfactorily.

There is a long term disagreement between the home owner at
555 57th Avenue N.E „ Mr. & Mrs. David Haugen, and Vern Donnay
Realty.
The final two items of disagreement concern the interior
decorating and are not code violations. One is the texture of
a ceiling repair not matching the rest of the ceiling, the other
being that the wall paint has not covered the studs to the point
where they can not be detected when one is aware that they are
there.
Since neither item is a code violation, the City Staff cannot
find any method to enforce further Donnay action. However, the
home owner could seek other legal action through the courts.

RE: Status Report On House at 555 57th Avenue N.E.
There is a long term disagreement between the home owner at
555 57th Avenue N.E., Mr. & Mrs. David Haugen, and Vern Donnay
Realty.
The final two items of disagreement concern the interior
decorating and are not code violations. One is the texture of
a ceiling repair not matching the rest of the ceiling, the other
being that the wall paint has not covered the studs to the point
where they can not be detected when one is aware that they are
there.
Since neither item is a code violation, the City Staff cannot
find any method to enforce further Donnay action. However, the
home owner could seek other legal action through the courts.

The City Manager explained to the Council that these appointments have been
recommended for approval by the Staff. The first lady, Pat Ellis, will be
replacing Juel Mercer as Council Secretary as she is transferring into the
Engineering Department to take the place of Hazel O'Brian, who is retiring,
as the Secretary to the City Engineer. He then introduced Pat Ellis to the
Council and said that she is a very well qualified secretary. Mr. Herbert
Zimmerman is number one on the Civil Service list and will, replace Norman
Pomerleau.
MOTION by Councilman Utter to concur in the foregoing appointments. Seconded
by Councilman Mittelstadt. Upon a voice vote, all ayes, Mayor Liebl dec-
lared the motion carried unanimously.
CLAIMS:
MOTION by Councilman Mittelstadt to approve payment of General Claims #30130
thru #30279 and Liquor Claims #7203 thru #7243. Seconded by Councilman Utter.

CONSIDERATION OF APPROVAL OF VERN DONNAY CONTRACTOR'S LICENSE:
Mayor Liebl called upon Mrs. Dave Haugen in the audience, who has had some
complaints against Vern Donnay Construction Company's workmanship.
Mrs. Dave Haugen, 555 57th Avenue N.E., said they have had their house for
about two years and their cathedral ceiling is cracking. Vern Donnay Cons-
truction came out and patched it but the patch shows. There is also a
moisture stain in the entryway in the ceiling. The walls in the closet
were stained also because they failed to put a vent above the closet. The
Company put in the vent, but they still have the stains. Where the taping
was done over the studs, the nails and tape show and although they have
painted over it, and so has Vern Donnay Construction, the joints still show.
The first time she painted it, it was upon the recommendation of Darrel
Clark, the second time Vern Donnay did it, but the nails still look like
they are sticking out of the wall. She said if she were to go into a home
thinking of buying it, the first things she would look at are the ceilings
and the walls.
The City Engineer explained that the problem here is not with any Code
violations, but with workmanship. They have corrected everything they must
to.meet the Code and there is nothing more the City can enforce. This is
more of a dispute between the builder and the home owner,
The City Attorney advised that if the dispute iS in the quality of workman-
ship, the Council should not get itself into the position of acting as a
judge and jury. For a very nominal fee, the matter can be settled by a
judge in conciliation court, if the problem cannot be resolved between the
two parties.
M#ycr Ligbl said that the City Council has the right tp refuse a license if
a company is not doing a good job, but there must be a very good reason. Mrs'.
Haugen said that they did Come out and put in a larger furnace. The City
Engineer said yes, they took.care of all the Code violations and these are
complaints on the quality of the work. Vern Donnay now wants to build two

MOTION by Councilman Mittelstadt to adopt Resolution #137-1972 with the above
change as suggested by the City Manager. Seconded by Councilman Utter.
Upon a voice vote, all ayes, Mayor Liebl declared the motion carried

CONSIDERATION OF A REQUEST BY EDINA REALTY, INC. FOR BUYING OF TAX FORFEIT
The City Engineer said that on Page 11A is a map showing the location of the
Skywood apartments and the tax forfeit land in question. They want to
improve their parking facilities and he understood there were some time limit
problems.
The City Attorney said that there were some problems with the proposal of
Edina Realty. They would like the City to buy the tax forfeit lands then
sell it to them for the same price, however, there are provisions in the
Charter setting out certain procedures for disposing of any surplus real
estate. Another problem with this is if the City were to start picking up
tax forfeit lots, then reselling them to people requesting them, this would
be circumventing the bidding procedure the State requires the County to go
through.
Mayor Liebl agreed and said the City is not in the real estate business,
although he realiged that this apartment complex did need more parking
space. He asked if this lot is one covered in the resolution the Council
just passed that will be sold at the public auction very soon. The Finance
Director said yes, it is the first one listed. Mayor Liebl informed the
gentleman from Edina Realty that the Council has already acted to release
that lot, so there is nothing the Council could do now anyhow. The City
Attorney added that he would be better advised to act through the County
when they become available. Before the City could do anything, the lot would
have to be declared surplus property by ordinance and published and this
would take considerable time.
The gentleman from Edina Realty said that the reason he made this request
was on the suggestion of Mr. LeFebvre, County Auditor. He met with him and
because Fridley1had not released the tax forfeit lots, he could do nothing.
He said the lot;has been used for some time and in discussing their parking
problems with tke City Hall Staff, they have found that they do not even
own the lot, and they cannot expand upon land they do not own. He said that
since the lots have been released, he will work through the County Auditor.
The City Attorney added that he was sure they could use the lot until they
purchased jt through the auction and no one would mind.

Subject: Obstructions in the Public Rights -of -Way
Dear Resident
During our preparations for the upcoming snow plowing season, our maintenance personnel inspect each
of their routes to mark certain trouble areas such as curving roads and obstructions in the right-of-way.
During this inspection it was noted that your property has a constructed obstruction that may pose a
hazard to snow plow operations including both equipment and/or the operators.
Please note that obstructions built within the right-of-way are a violation of City Code. These obstructions
may be retaining walls, fences, planters, or mailbox structures other than a standard box on a standard
wood, metal or plastic post.
While our personnel make every effort to avoid standard mailboxes and other objects, damage can occur
if the object is not visible due to piled snow or other sight obstructions. It is the property owner's
responsibility to mark such objects so as to allow the plow operator to determine its location from within
their vehicles during plowing operations. This marking may consist of a long rod or similar marker
attached to the object or in the ground immediately adjacent to the object. The City will not be
responsible for damage to any such object in the right-of-way in violation of City Code. No exceptions will
be made for existing structures.
In the event a standard mailbox or standard mailbox post is damaged by a direct hit by a City plow, our
Street Operations Supervisor shall inspect the damage and make a determination as to the extend of the
damage and a recommendation for compensation. Compensation shall be limited to the cost to replace
