Fence in Public Right of
The Engineering Department recommends approval of the request
of Mr. Ramsdell, subject to the applicant signing the attached
agreement. Upon review of the site, it was noted that the roadway
is not travelled now and there are already barricades at each
end.
In considering this request by the Ramsdells', the Council
should be aware of the approval given to the Amborns' in October,
1972 (Minutes attached for reference). Their request was very
similar to the Ramsdells'.
There are existing sanitary and storm -sewer lines in place in
this right of way.

at that time wanted to build a double bungalow. Now, some of the people
are not in favor of this proposal either, the couple living next door are
very disturbed. He said he could not see why the Planning Commission tabled
this three times when there was a lot of objections and then decided to
approve it. He said this structure would be a lot larger than a double
bungalow. He thought this would require a rezoning as it would be in the
same catagory as hospitals and nursing homes. The City Engineer explained
that there is a provision in the ordinance covering R-1 for nursing homes,
clinics, hospitals, nurseries, churches, etc. up to 100 units and is under
the control of the Council through a special use permit process.
Mayor Liebl said this is on 69th g Central - what is the surrounding zoning?
The City Engineer said that there is industrial to the west and north,
directly to the east is R-1 and further to the east is multiple. Just to the
south is R-1, then.City property. This lot is located on Central Avenue which
Is a county road and 69th Avenue, a City street. Mayor Liebl asked if the
petitioner was present, with no response.
NOTION by Councilman Utter to table this item. Seconded by Councilman
Mittelstadt.
The City Attorney suggested that notices be sent out to both the petitioner
and the surrounding property owners notifying them that this item will again
be on the Agenda November 6th. He added that the Council shouldmake specific
findings if the request for a special use permit is denied. If the ordinance
says that such a use is permissible with a special use permit, then it is
denied, the Council has to have a good reason for denial, or the courts may
turn .the findings over.
THE VOTE UPON THE MOTION, being a voice vote, all ayes, Mayor Liebl declared
the motion carried unanimously.
REQUEST FOR A SPECIAL USE PERMIT, SP #72-13, BY GORDON G. SWENSON:
To construct a building to be used for repair shop, specializing i
brakes under City Code 45.101, B, 3 D, at 1010 Osborne Road.
MOTION by Councilman Breider to approve the request for a special use permit
by Gordon Swenson: §econded by Councilman Mittelstadt. Upon a voice vote,
all ayes, Mayor Liebl declared the motion carried unanimously.
REQUEST FOR A SPECIAL USE PERMIT, SP #72-14, BY ERNEST M. HARPER:
To construct a second garage to house one car & boat on Lot 2, Block

MOTION by Councilman Utter to approve the request by Ernest M. Harper. Seconded
by'Councilman Mittelstadt. Upon a voice vote, all ayes, Mayor Liebl declared

REQUEST FOR PERMISSION TO PUT A FENCE ACROSS AN EASEMENT BY ROBERT AMBORN:
Easement next to Lot 1, Block 4, City View Addition.
The City Engineer explained thet Mr. Ambqrri Wanted to put a fence across the
public easement. There Is a po$s4ility_.9r ygpating this easement, but it
could be fqund to be needed in the future. The City Attorney said that he could

". not see any problem with allowing the fence providing that he understands
that the easement could be needed in the future, and in that event, he would
be responsible for moving the fence and the costs involved. Allowing the
fence would be better than vacating, then finding that the easement is
needed at Some future date.
MOTION by Councilman Breider to allow Mr. Amborn to construct the fence pro-
viding that the City retains the right to use the easement if needed, and if
utilities need repair, Mr. Amborn will remove and repair the fence at his
expense. Seconded by Councilman Mittelstadt. Upon a voice vote, all ayes,
Mayor Liebl declared the motion carried unanimously.
MOTION by Councilman Breider to receive the Minutes of the Planning Commission

CONSIDERATION OF REPORT ON PHASING OUT OF LONGEVITY PAY FOR NON-UNION PERSONNEL.
,The City Manager -said that the City has had longevity pay for non-union
1personnel,and some of the union personnel.- This is an unnecessary cost for f
retention of employees and his suggestion was to phase out this program on
all employees hired after this date, with no effect on existing employees.
As far as the unions are concerned, this is a negotiable item.
MOTION by Councilman Breider to concur with the recommendation of the City
• Manager outlined in his memo dated October 13, 1972 to phase out this
program, with the understanding that this does not affect existing non-
union personnel. Seconded by Councilman Mittelstadt. Upon a voice vote, all
ayes, Mayor Liebl declared the motion carried unanimously.
CONSIDERATION OF CHANGE ORDER #4 - SW&SS PROJECT #102:
MOTION by Councilman Mittelsta4t to apprpve Change Order #4 for SW&SS #102
in the amount of Deduct $1,030.00. Seconded by �qq Dcilman Utter. Upon a

AGREEMENT
THIS AGREEMENT entered into this day of 1973,
by and between hereinafter
designated as "Owners", and the City of Fridley, a municipal corporation,
County of Anoka, State of Minnesota, hereinafter referred to as the

WHEREAS, the Owners have requested that the City allow the place-
ment of fencing across the following described property:
That property lying between Lot 1, Block 5, City View and Lot
15, Block 6, City View, from 57th Avenue N.E. to 57th Place N.E.;
as shown on the attached map which is made part of this agreement, and;
WHEREAS, the Owners understand that the above described property
is a public right of way, and;

and storm sewer piping exists in the public right of way, and;

not presently open to through traffic.

SUBJECT: Complaint by Residents at 400 - 57th Place.
Action Request by Councilman Hamernik. Memo DS 524
I have investigated this complaint, and agree that
during heavy rains, the water would run over the driveway depres-
sion and into the yard.
There are a couple of solutions that I might suggest:
possibly a berm that would split the street from the driveway,
which would hold some water back. This might make it a little
more difficult to drive into the driveway. To the east is a de-
pression which runs between the houses, which would take water
off his driveway if he would make some slight alterations in his
yard --simply by lowering the grass area immediately adjacent to
the blacktop driveway. The latter, I believe, would take care of
theproblem.
Other than these suggestions, I can see no other solu-
tions. Please see attached pictures. .

the water when it rains heavily and the water runs into their driveway and
garage. Please look into the matter and take appropriate action.

the drainage problem. It appears with some minor grading of the sodded area,
the water can be directed away from the garage. Also note the picture
that indicates quite a depression east -of the garage which would hold
quite an amount of water and not cause any problems. The water enters
the garage not from the driveway opening,.but over the curbing when storms
occur in excess of the design of the system. I'm sure during this past
year, a couple of the storms were over the capacity..of the storm sewer
system.
The property owner has been advised of these ideas and will call back if
he needs any additional -help.

when we did 57th Place, water runs into his garage and the City was going
to do some corrective action and provide him with some sod.
Please look into the request and take appropriate action.

Mr. Ramsdale's entire driveway was paved by the City in 1977, after he complained
that water from the street was running into his. garage as a result of street im-
provements completed in 1976.
When the driveway improvement was done, a swale was incorporated into it which pre-
vents water from running from the street into his garage. In addition to the paving,
both sides of Mr. Ramsdale's driveway were sodded when the driveway improvement was
completed in 1977.
Mr. Ramsdale was advised by staff in 1978 to do some minor grading in his yard to
prevent water from running over his yard into his garage. This work has not been
completed and is still the reason Mr. Ramsdale has water in his garage. It is sug-
gested that Mr. Ramsdale complete the grading to help relieve his water problem at
his garage.

This is a summary of a meeting held on 11-17-10 @ 3:30 pm concerning a tree trimming
complaint received from Dan O'Neil who resides at 390 57th Place.
Individuals present at said meeting are
Mr. Bill burns — city manager
Ray Statler — engineer tech
Dan O'Neil - resident @ 390 57th Place
Glen Ramsdell — resident @ 400 57t` Place
After having a telephone conversation with Mr. O'Neill it was determined that the property in
question was unimproved right-of-way. Upon reviewing the building files for Mr. O'Neil and
Mr. Ramsdell there was and agreement found between the City of Fridley and the abutting
property owners dated 5-25-73. The document specifically stated that the abutting property
owners could fence the unimproved R/W, but would be responsible for the maintenance of said
area.
Upon having a telephone conversation with Mr. Ramsdell, he stated that he alone was using the
unimproved R/W and had offered to remove the trees 10-12 years earlier. At that time Mr.
O'Neill did not want the trees removed. Mr. Ramsdell moved his fence 2' east of the trees to
accommodate Mr. O'Neill (this was confirmed in the meeting).
Both parties contradicted each others statements throughout the meeting. Both parties did agree
that Mr. Ramsdell alone has benefited from the unimproved R/W. Mr. O'Neil made the
statement that he might hire an attorney to review the agreement or have the property line
surveyed. It was pointed out that taking either action would cost approximately the same amount
as to have the trees trimmed. Mr. Ramsdell was willing to split the cost for tree ramming but Mr.
O'Neil was not. Both parties requested financial help from the City. This was denied by Mr.
Burns.
Vacation of the R/W was discussed. Mr. Ramsdell said he would accept the property, but Mr.
O'Neill refused to accept any portion of the property, neither party was willing to contribute to
the cost of the vacation.
The meeting was adjourned at 4:00 pm with no resolution for the complaint.
