WHEREAS, Amborns own property located at 405 -57th Place Northeast, Fridley, Anoka County, Minnesota, legally described as: Lots 1 and 2, Block 4, City View Addition; and WHEREAS, the City holds a thirty-three (331) foot right-of-way dedicated on the plat which lies west of and adjacent to the Amborn property; and WHEREAS, the Amborns are interested in constructing an additional garage on their property; and WHEREAS, the City is interested in assisting the Amborns in their construction by giving the Amborns permission to construct an asphalt driveway over the eastern one-half (1/2) of the City's thirty-three (331) foot easement adjacent to the western boundary line of the Amborn property. NOW, THEREFORE, it is hereby agreed that the City of Fridley shall at its discretion allow Robert Amborn and Kathleen Amborn to maintain a driveway upon the eastern one-half (1/2) of its thirty-three (331) foot easement lying adjacent to and immediately west of the following described property: Lots 1 and 2, Block 4, City View Addition, Anoka County, Minnesota. IT IS FURTHER AGREED that Robert Amborn and Kathleen Amborn shall maintain the driveway, including repairing any disturbance by reason of maintenance, repair or improvements necessary on the City's right-of-way and that they, their heirs, successors or assigns will be responsible for the cost of said driveway.
