DESCRIPTION OF REQUEST:
Roger Serdahl has requested a 131 variance to allow a reduced rear yard
setback. The property is a double -fronted lot located at 409 57th Place
SUMMARY OF ISSUES:
Code Section 205.07.03.(D).(4).(b), states, "The setback for garages and
accessory buildings in the rear yard will be the same as for the front
yard".
A 30' x 20' house and a 20' x 16' free-standing garage currently exist
on site. Access to the existing garage is taken from 57 1/2 Avenue
N.E. The current proposal would provide a second, detached 12 x 22'
garage that would also take access from 57 1/2 Avenue N.E.
Staff discussed options that would consolidate the buildings on the
Serdahl property. Mr. Serdahl expressed an interest in building a
separate structure due to his desire to not disturb the asbestos siding
that exists on his home or existing garage. Staff has discussed this
issue with the City Building Official and individuals in the asbestos
clean-up industry. Staff determined there are disposal mechanisms that
would allow this property owner to remove the asbestos siding and
dispose of the siding in an environmentally conscious manner.
Staff believes there are numerous alternatives for either an attached or
detached garage structure on this site. Without consolidating structures
an addition such as the proposed will create visual clutter and create
a "compound" of structures near 57 1/2 street.
HARDSHIP STATEMENT:
In response to the reason for variance/hardship question, Mr. Serdahl has
responded with, [a desire to] "Preserve the back yard and better match
the existing garage".
RECOMMENDED ACTIONS:
Staff recommends denial of VAR #96-15 due to the existence of
alternatives that allow consolidation of structures and elimination of
a need for a variance on this site.

MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:33 P.M.
Mr. Hickok stated the request is for 409 - 57th Place N.E. to allow a reduced rear yard
setback from 35 feet to 22 feet. The property is a double fronted lot which is long and
narrow. 571/2 Street is to the north and 57th Place is to the south. Currently on the site
is an existing residential dwelling and existing garage measuring 16 feet x 20 feet. The
request proposes a second detached garage to be constructed measuring 12 feet x 22 feet
and using the same access drive as the existing garage. The proposed garage is located
between the house and the street, and creates something of a compound of structures on
the north edge of the property.
Mr. Hickok stated there are a number of garages that do exist along 57 1/2 Place. There
are some existing garages that have deficient setbacks. In evaluating the site, it was
determined that the proposal exacerbates the problem that already exists.
Mr. Hickok stated staffs recommendation is to deny the variance request because of the
numerous alternatives that exist. The site does slope downward from 57 1/2 to the
dwelling unit. Staff believes there is an opportunity for an attached garage with access off
57th Place which could also allow expansion of the living area. There are other garage
alternatives that would allow for a consolidated structure, such as a double garage, to
provide.the space necessary at a 35 -foot setback while still preserving some yard between
the house and the garage. Staff recommends denial of the variance request. Staff has
talked with the petitioner about the recommendation.
Ms. Beaulieu asked if it would be okay to have two separate distinct garages.
Mr. Hickok stated the City has had second accessory requests. There is also a special
use permit running simultaneously with this that would recognize a second accessory
building in excess of 240 square feet.
Dr. Vos asked the dimensions of the lot.
Mr. Hickok stated the lot is 40 feet x 120 feet.
Mr. Kuechle asked, if the petitioner were to consolidate the garages and put up another
in its place, would he still need a variance.

Mr. Hickok stated the petitioner could tear it down and set the garage back 35 feet. In the
hardship statement, the owner states he is hoping to preserve as much rear yard as
possible, but it is possible to construct at 35 feet and still have ample room for a yard.
Mr. Kuechle asked, if the petitioner built a consolidated garage in the same place, would
he need a variance.
Mr. Hickok stated yes.
Mr. Kuechle asked staff to indicate on the aerial map the location of the 35 foot setback.
Mr. Hickok stated the 35 -foot like would end just beyond the existing driveway. There is
a grade difference at that point which would require a few additional courses of concrete
block. This is not unusual and is a workable construction situation.
The petitioner was not present at the meeting to answer questions.
Mr. Kuechle stated he would like to discuss the request with the petitioner and asked for
a motion to table the request.
MOTION by Dr. Vos, seconded by Ms. Beaulieu, to table consideration of Variance
Request, VAR #96-15, until the next meeting.

Mr. Hickok stated the variance request is to reduce a setback from 35 feet to 22 feet. The
property is located between 57th Place and 57 1/2 Avenue. The lot is 40 feet wide and is
a double -fronted lot. The petitioner has asked for a variance to allow construction of a
second garage on the site. Currently on the site is a single family home and a 20 foot x 16
foot detached garage which is to the back. The proposal is to construct a second 22 foot

by 12 foot detached garage perpendicular to the existing garage and 22 feet from the
property line. The hardship statement by the petitioner states there is a desire to preserve
as much of the back yard space as possible and to better match the existing garage.
Mr. Hickok stated that in evaluating the request, staff believed that it makes more sense
to consolidate the additional garage stall with the existing garage. The petitioner was
concerned about the asbestos siding on the existing garage. Staff talked to the building
official and others in the industry. It was determined there are environmentally safe ways
to replace the siding. Because of that, staff recommends the petitioner consider
consolidation for this site. There are a number of garages that exist along the same
frontage area that have less than a 35 foot setback. Staff believes that the addition of
another garage would create a compound appearance along that street frontage. Although
the existing structures are substandard in their setbacks, staff would hope that over time
as the units are reconstructed, the appropriate setback would be achieved. If there was
not a consolidation, putting the garage at the proper setback would minimize somewhat
that clustered effect of the units.
Mr. Hickok stated another issue is that the home, by today's minimum footprint requirement
of 10,020 square feet, is substandard in terms of square footage. A garage attached to
the rear of the home could provide an opportunity to provide additional square feet of living
space above the garage and provide an opportunity to consolidate the garages.
Mr. Hickok stated staff has recommended denial of the request.
Ms. Savage asked what the Planning Commission had decided regarding the request for
a special use permit.
Mr. Hickok stated the petitioner was riot present at the Planning Commission meeting so
the Planning Commission tabled the request.
Dr. Vos stated one of staffs suggestions was to expand the existing garage into a two -stall
garage. Would this still require a variance because of the location of the existing garage?
Mr. Hickok stated, yes. Staff believes this would improve the dilemma of the compound
effect of the garages.
Dr. Vos stated that if the petitioner wanted to set the garage back 35 feet, it would be only
3 feet from the house.
Mr. Hickok stated that is correct.
Mr. Kuechle asked if there were restrictions on the size of the garage that can be built in
relation to the size of the house.

Mr. Hickok stated, yes. The size of the garage cannot exceed the main floor area of the
house. Consolidated accessory buildings cannot exceed 1,400 square feet.
Ms. Savage asked if there was prohibition for a second detached garage.
Mr. Hickok stated it is not unusual to have two detached garages on a residential site.
What is unusual about this variance request is the combination of two garages with narrow
lot dimensions. The narrow lot with two garages and the juxtaposition of the garages
compounds the problem.
Ms. Savage stated she did not see two detached garages as aesthetically pleasing but
asked if it was possible under the code.
Mr. Hickok stated it is possible under the code.
Mr. Serdahl stated he had nothing to add.
Mr. Kuechle asked the petitioner what he thought of the idea of consolidating the garages.
Mr. Serdahl stated he had no desire to have anything but a single garage due to the age
of the existing garage. With the location of where everything is, it is not possible to put a
car into it. It is not worth it as far as he is concerned.
MOTION by Ms. Savage, seconded by Dr. Vos, to close the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:42 P.M.
Ms. Savage stated the property looks very small and crowded, and she does not see the
feasibility of a second detached garage. It seems like there are other alternatives to
accomplish what the petitioner needs to accomplish. Given the fact of the crowding
situation and the alternatives, she would not be able to recommend approval.
Mr. Kuechle concurred. He stated there could be some adjustment in getting close to 22
feet in order to retain some yard. In the case where the petitioner is basically putting two
single -car garages there, for some additional money the petitioner could get a double
garage, get the desired space, and have a minimum impact on the property. He would
recommend denial.
Dr. Vos agreed. There are so many alternatives. Not all of them may be desirable to the
petitioner. The hardship for an existing garage being enlarged would be more favorable

than to approve a second nonconforming single garage. He would vote for denial of this
request.

on a double fronted lot from 35 feet to 22 feet on Lot 3, Block 4, City View Addition, the
