As per request, staff has explored the possibilities of Mr. Broder splitting his property to create a new buildable lot to build an additional duplex. The area is zoned S-1, Hyde Park, which allows for only single family development. As I told Mr. Broder from the beginning of his inquiries his plan would require rezoning to R-2. The existing lot measures 136.44 feet along 58th Avenue N.E. and 135.36 feet alcnE 3rd Street N.E. Six feet of the vacated alley to the west is included in these dimensions. The total area of the parcel is approximately 16,426 square feet. As the existing and proposed structures are duplexes, if we proceed, it would seem appropriate to rezone the entire parcel to R-2. The new buildable lot would be 71.5 feet in width and approximately 9,652 square feet. The lot with the existing structure would be 64.94 feet in width and 8,776 square feet. The new lot is slightly larger; with 44 feet of buildable width along 56th Avenue to allow for the new construction requirements of two double garages (see layout). Variances created by the rezoning and lot split would include both lot areas from 10,000 square feet to 9,652 and 8,776 square feet for the proposed and existing duplexes respectively. A front yard variance for the existing duplex would be created by the change in front yard designation from 3rd Street N.E. to 56th Avenue N.E. This variance is from 35 feet to 15 feet. The attached drawing shows the existing garage on the proposed easterly lot. This garage provides two of the three required garage stalls for the existing structure. If this garage is not used as part of the proposed duplex layout, it should be removed. I cannot envision relocation of this garage onto the westerly lot as it would create an excessively long driveway if located on the southern end and would neither fit nor blend in well next to the existing garage on 58th Avenue N.B. The alley to the west has been vacated with six feet dedicated to this lot in 1961. The lot split I envisioned is one that would have the present building on the western 61.44 feet along 58th Avenue N.E. This new lot would be 8,316.52 square feet. S-1 minimum lot requirements are 60 feet of width and 7,500 square feet. The new east lot would be 75 feet along 58th Avenue N.E. and have a total area of 10,152 square feet thus enabling it to meet R-2 zoning requirements. The buildable area in the east lot is that portion of the lot that is 47.5 feet by 65.36 feet. The total area is 3,104 square feet (see attached annotated aerial). R-2 zoning requires that no more than 30% of the area of a lot shall be covered by a main building and any accessory buildings. Therefore, 3,045.6 square feet is the maximum area that could be dedicated to building usage. Recognizing however that the west lot has a high building density I would recommend that the east lot be used for a two story duplex with a tuckunder garage. Attached is an example of a 1,672 square foot two story duplex planned for 5586-88 Fillmore Street N.E. Each unit has a potential of 1,140 square feet of living space. There is 836 square feet of living space on the first floor and 304 square feet of space in the basement that is not allocated for utility space or garage space. To the east, across 3rd Street, is Frank's Used Cars. Mr. Broder is requesting a variance of the fence height allowed in the front yard from four feet to seven feet. The fence would provide screening from Frank's Used Cars. ANALYSIS The parcel is located at the intersection of 3rd Street and 58th Avenue. The parcel contains a duplex with an attached garage with access to 58th Avenue, as well as a detached garage with access to 3rd Street. There is also a second curb cut onto 58th Avenue (see attached). Both street frontages are used for access, and the frontages are within 10% (135.36' versus 136.441). Mr. Broder, who resides in the southern half of the duplex, feels that the 3rd Street frontage is his front yard. Staff concurs with this determination since his house faces 3rd Street and he also has vehicular access from 3rd Street. There is no hardship to justify granting the variance; however, Frank's Used Cars is not an aesthetically pleasing site. Mr. Broder could install a four foot high fence and plant boulevard or small trees five or ten feet on center to provide screening while not violating the code. He also has the option of planting an evergreen hedge. These options would not solve the problem immediately, but would also not violate the code. Given our recent discussion on corner lots, we wanted to receive input from the Appeals Commission prior to receiving Mr. Broder's application. CONSIDERATION OF AN INFORMAL REOUEST BY MEYER _BRODER FOR A VARIANCE IN ALLOWED FENCE HEIGHT: Pursuant to Section 205.04.06.(7) of the Fridley City Code to increase the height of a fence in the front yard from 4 feet to 7 feet on Lots 1, 2, and 3, Block 27, Hyde Park, the same being 278 - 58th Avenue N.E. Ms. McPherson stated this informal request came about from a telephone call received by Steven Barg, Code Enforcement Officer. Currently on the lot there is a duplex, a garage which accesses 58th Avenue, and a garage that accesses 3rd Street. Mr. Broder lives in half of the duplex, and his front window faces Frank's Used Cars. Ms. McPherson stated Mr. Broder asked Mr. Barg if it was possible for him to install a 7 ft. or 8 ft. fence in his front yard. Staff's interpretation is that both street frontages are within one foot of each other, and both could be considered front yards. Staff agrees with Mr. Broder that 3rd Street is his front yard. Staff told Mr. Broder he would have to apply for a variance, but that perhaps it would be better to informally get a feeling on the success of such a variance from the Commission. Ms. Savage stated she would rather have the petitioner go through the variance process than have the Commission make an informal decision. Mr. Barna stated there is no reason for anyone to stockade the street side of a lot. He stated he is very irritated that Anoka County allowed people along East River Road to put up 7 ft. fences on the street side of their yards. He stated a 7 ft. fence does not belong in the front yard. Dr. Vos stated it would be best for Mr. Brody to go through the variance process. That way the property owners and the owner of Frank's Used Cars are notified of the request. Mr. Sherek stated that despite the opinions of the Commission members, these opinions should not be relayed to Mr. Brody without going through the formal process and notifying the neighbors. APPEALS COMMISSION MEETING, JULY 18, 1989 PAGE 9 Ms. McPherson stated staff will inform Mr. Brody that he will have to apply for a variance if he wishes to pursue this. 5. Ms. McPherson stated asu ey was done of front yards and required rear yard setbacks on corse lots in R-1 districts in other cities. With the exception of Brook yn Center and Bloomington, most of the cities maintain a more rest r'ctive rear yard setback than Fridley. If the ordinance was to bea pted, many of the variances the City has had within the last three onths would not have been required. Also, in looking at past rear kard setback variances, many of them have been approved by Council. Ms. McPherson stated staff is re ommending an ordinance amendment to reduce the required rear yard s tback on corner lots to ten feet for living space and five feet fo attached accessory uses. This would allow the defined rear yard t function either as a rear yard or as a side yard, contingent upo which frontage the structure faces. So, essentially there would e a front yard of 35 feet, a front side yard of 17 1/2 feet, and t o remaining side yards at 10 feet each. If there is a garage, th n one of the two remaining side yards would be 5 feet. Mr. Barna stated that in some instances n corner lots, especially with larger houses, the proposed chan could give people the opportunity to have more of the lot cove d. Ms. McPherson stated the 25% maximum lot c verage requirement for the principal building and all accessor buildings would not change. Mr. Barna stated that, technically, with the p oposed setbacks, it almost gives people permission to exceed th 250 lot coverage. They will have to be very careful in the wordi g of the ordinance change that one part of the code does not viola a another part of the code. Ms. McPherson stated it should not. What theV re doing by proposing this ordinance change is allowing a buil 'ng to encroach closer than it can right now, but the 25% lot cover a requirement would still have to be met. The purpose of updati the code in this manner is to alleviate the problem of trying to 'nterpret the previous interpretations of the Zoning Code. Ms. Dacy stated between now and the Planning Commissi n meeting, staff will evaluate different existing situations on c rner lots to determine the separation between houses.
