Mathis 1570 60th Ave. NE Fridley, MN 55432 July 25, 2002 To: The City of Fridley From: William and Carolynne Mathis Re: Variance request for home improvement We applied for a variance to complete an improvement to our home and the variance was not accepted due to a discrepancy in surveys completed in the past. We have had a new survey completed and now would like to re -submit the request for your consideration. We have an extremely small entryway. It is a tight and uncomfortable for people entering our home, with a close juxtaposition of door, stairs, and side walls. One cannot enter our home and go into the living room with ease. We want to improve this situation by bumping out the front of our house a bit to open up the entryway and make the entrance to our home less tight and uncomfortable, improving it greatly. The restriction on our lot is one of width, but we have a v_yr large lot. The addition is going on the front and will not in any way impinge on the side or put the front entry any closer to the street than that of our neighbors. Please refer to the survey to see the large size of our lot and to our builder's plans to see that the new addition will not affect the side of our home or lot. We received your application for a sign variance on August 9, 2002. This letter serves to inform you that your application is complete. Your variance application hearing, discussion, and action will take place at the City of Fridley Appeals Commission Meeting on August 28, 2002 at 7:30 PM in the City Council Chambers at 6431 University Avenue. The same statute allows the City to extend this time frame an additional 60 days if the petitioner is notified in writing that the additional time is necessary. This letter serves to inform you that the City is extending the 60 Day date in which the City must take final action on your item until November 21, 2002. In doing the background research on your property, many unanswered questions arose. The current survey (Mark Kemper -2002) and the old survey in your address file (Caswell Engineering -1964) do not match the official plat for the Van Cleaves addition, and neither the City nor Anoka County have any record of a lot split for your property. To clarify, there is no official record of your lot being given the approval to take 2' of Lot 4 and give up 4' of Lot 3, thus reducing your overall lot width to 73. City Staff advises that you work with your surveyor and Anoka County, the official recorders of all land use actions, to determine if the lot splits were improperly done or if Anoka County has simply failed to properly record the lot splits and show the proper dimensions on the County's Official Y2 Section Maps. City staff would further recommend that you consider formally withdrawing your application, in writing, until the questions on the lot split are answered. The City cannot properly act on your variance request until all of the questions on the lot split are answered. Therefore, your variance request will not receive a public hearing on Wednesday September 281. The public hearing will be rescheduled once a determination of the validity of the lot splits has been made. If these questions are not answered in time for the City to bring you through the variance process by November 21, 2002, the City will be forced to take formal action on your request. The formal action would most likely be denial, due to the lack of facts. Withdrawal of your request would allow you to resubmit your application once the questions on the lot split have been answered. During your research, if the lot splits were formally approved by the City and the County, your 73' wide lot would be considered "conforming" and the only variance you would need to expand your home would be to recognize the deficient side yard setback.
