Ms. Stromberg stated the petitioner is seeking a variance to reduce the required lot width from 75 feet to 73 feet to recognize an existing non -conformity due to the fact that a lot split wasn't properly recorded in 1962 at his residence, which is located at 158060 th Avenue. The recognition of this non -conformity is required prior to issuance of any building permits for this property. Ms. Stromberg stated that the summary of hardship submitted by the petitioner reads, that "the hardship is due to the fact that the developers, Van Cleave and Harstad of Window Park Realty, created lots in Block 1 at 73 feet, presented surveys for the lots and obtained building permits. The variance will not in any way alter the character of the neighborhood." Ms. Stromberg explained the Van Cleave's Addition was platted in 1959 with six single-family lots. In 1962, there was discussion by the previous property owners and the City, including the Planning Commission and Plats and Subdivisions Sub -Committee, regarding splitting of the lots to make an additional lot. Subsequently, the lot split took place by a handshake between the property owners and the change in legal descriptions was recorded at Anoka County. However, the lot split was never approved by the City Council or recorded as such. Since then, the petitioner has purchased the property. If the lot split had been approved by the City Council and properly recorded in 1962, the current variance request for lot width wouldn't be required. Ms. Stromberg stated that the City Attorney has advised that the best way to resolve this discrepancy would be to grant a variance for the property which would reduce the lot width requirement from 75 feet to 73 feet to recognize an existing non -conformity due to the fact that a lot split wasn't properly recorded in 1962. This hardship is unique to Block 1 of the Van Cleave's Addition and is in no way intended to set a precedent allowing future lot widths to be reduced to 73 feet. Ms. Stromberg stated the property is zoned R-1 Single Family as are all surrounding properties. The existing home is squared up to and fronts on 60th Avenue. The existing home and garage were built in 1963. A shed was constructed on the property in 1974 and there was an addition to the home constructed in 1978. Ms. Stromberg stated that the petitioner plans to construct a screened porch and open deck off the back of his home. This addition will meet all setback and lot coverage requirements. As was stated earlier, in order to construct an addition to this home, recognition of the lot width non -conformity is required prior to the petitioner applying for a building permit to add to his home. Ms. Stromberg stated the staff recommends approval of the lot width variance as the variance corrects an existing non -conformity. Ms. Stromberg stated staff recommends that if the variance is granted, the following stipulations be attached: 1. Petitioner shall obtain all necessary building permits prior to construction of an addition. 2. Additional shall meet all zoning code requirements, including but not limited to setbacks, height and lot coverage. 3. Addition shall be architecturally compatible with existing home and finished with complementary side and color scheme. John Bolich, Jr., petitioner, stated he was not happy about having to pay $250 fee for this variance process when he's obtained three building permits with no problem in the years he's owned the property. Dr. Vos explained this variance stays with the property which means when he's ready to sell the property; this will not be an issue in the title search. CITY OF FRIDLEY APPEALS COMMISSION MEETING. JUNE 23, 2004 Page 3 of 4 Mr. Bolich stated he was informed by the city building inspector that because of this non- conformity, if his existing home was destroyed, he would not be allowed to rebuild. Ms. Stromberg explained that with a 73 foot wide lot is non -conforming, therefore if something were to happen to the petitioner's home that would destroy it beyond 50%, the home would not be able to be rebuild. However, if the Appeals Commission grants the variance this evening, recognizing the non -conforming, the petitioner would be able to rebuild as the 73 lot width would be recognize as a conforming lot. Mr. Kuechle asked if the petitioner has any objection to the stipulations outlined by the City Staff. Mr. Bolich stated he will comply with the stipulations. MOTION by Ms. Jackson, seconded by Dr. Vos, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING CLOSED AT 7:40 P.M. Dr. Vos stated as he understands this situation, the lot split was recorded at Anoka County but didn't come through the City as a lot split. Ms. Stromberg replied that is correct. The petitioner has a pin number and a legal description, but the lot split was never approved by the City. Ms. Jackson stated the petitioner is trying to improve his property and that she has no objections to the variance. Chairperson Kuechle agreed stating this is an opportunity to clear up a situation that could cause problems in the future.
