Dropps : This letter is to confirm our telephone conversation of October 22, 1980. We were called to inspect foundation settlement at 1571 -61st Avenue N.E. by the owner, Mr. Tom Shelton, on October 21, 1980. I met with Mrs. Shelton at their home. As you will recall, about two years ago, we were called to inspect the saute thing as referenced to in our letter of November 20., 1918. Our inspection on October 21, 1980.indicates.that the foundation is continuing to move. and now appears to be more than just a cosmz:.tic problem Itis ou3: OP —don that the whole north wall and part of the west wall of the foundation must be replaced. However, before the replacement is made, we must determine the cause of the failure and take appropriate action to correct the soil problem. The expertise of a soils engineer should be made and his recommendations should be submitted to our office for our review. In addition to the foundation failure, it is now evident that it has also caused distortion in the back wall of the garage and also floor deflection. Therefore, these problems must also be repaired at the same time that the repair is made to the foundation. North N 55434 Re: Foundation on Attached Garage at 1571 - 61st Avenue N.E. Dear Mr. Dropps : On October 24, 1978 the City was called to inspect the north and west walls of the foundation on the attached garage at 1571 - 61st Avenue N.E. We met Mr. Shelton on the site and noted that the north wall, one course of blocks down from the top, had sometime in the past moved outward and did show some signs of settlement. We were told that you did attempt a repair on the wall in June of this year by mudding up the offset. It was soon after that the owner's painted this area. It was evident that more settlement has taken place since the June repair. The Crty met Mr. Shelton on the site on November 7, 1978 and on that day did dig down along the side of the foundation wall. This inspection did not reveal anything that was not already noted on October 24, 1978. It is our opinion that there is definite evidence of continuing foundation movement. The reason should be determined by a qualified soils engineer along with his recommendation for repair. The necessary repair should be made as soon as possible. On January 30, 1981 we made an inspection and did note that there are some cracks along the block'wall of the laundry room located on the east side of the home. Mrs. Shelton was informed that the cracks were not of the magnitude to constitute a structural problem at this time, however if the cracking has not subsided, and they indeed continue to grow, they then could be a problem. We advised her to call a soils engineering consultant to gain the opinion of an expert in this sort of problem. Target currently awns the parcel of property to the ea of Able Street and -5- is considering purchasing the large parcel of property to the west of Able Street. In so doing, they are interested in knowing if they are required to keep the street as a boundary, or if they can, in effect, incorporate that street into their development. Therefore, they have requested the City consider the vacation of Able Street between 73rd and the railroad tracks by Locke Park. Mr. Flora stated the Planning Commission was concerned about an alternate access from 73rd Avenue to Locke Park for use of those facilities by the residents of Melody Manor. Therefore, the Planning Commission recommended to the City Council approval, in principle, with the stipulation that before the vacation actually commences, there be an approved, improved access to Locke Park. Mr. Flora stated they have talked to the Target Corporation and based upon the ultimate use of the property, there could be an easement or road provided along the boundary line, but this depends on how the property is to be used. Mayor Nee stated the people in the audience might be interested to know that this would be taking out most of the land that is now in the inventory for the hazardous waste treatment facility. Staff has worked for about a year to get that land committed to a more acceptable use, and Target indicated an interest in doing that. A citizen in the audience stated he was interested in this item because he lived on Van Buren Street. He asked if Target did expand their warehouse, how did they propose to get all their trucks in and out of the area? Mr. Dick Brooks, Regional Real Estate Manager for Target, stated they have not oompleted their plans for expansion of the distribution center, but they have entered into an agreement to purchase the property. As far as how they would handle the trucks, they will probably handle then in a similar manner to what they are doing today, which is along 73rd Avenue on the frontage road. He was not able to comment fully because they have not completed their plans. A citizen in the audience asked if the City required landscaping along 73rd Avenue to screen the development from Melody Manor. Mr. Qureshi stated they have a standard that greenery has to be maintained along 73rd. There has to be a reasonable separation between the development and the residents. Mr. Qureshi stated that, as Mayor Nee had pointed out, 80 acres along 73rd Avenue have been designated by the Hazardous Waste Board for a preferred hazardous waste site. The City has been aggressively pursuing to get this land put to a better use. Luckily for the City, Target decided to expand in the community. They feel Target has been a good cooperative citizen of the oommunity. The City has a good working relationship with then, and they are sure Target will do everything reasonable to protect the adjoining neighborhood by preserving some type of green strip that already exists, or, -6- 5. Mr. Hill stated Mr. Simonson of Fridley's Fire Department represented the City at this school. He further stated the State would like to make a presentation to the Council on December 17 to obtain support for using Mr. Simonson as part of this hazardous material response team. Mr. Flora stated the reason for the request is to allow for a wider driveway as the existing driveway is too narrow for truck deliveries. He stated, in conjunction with the variance, Kurt Manufacturing would like to install a surmountable curb along the south property line to provide for the movement of trucks in and out of the lot to the south. Mr. Flora stated the adjoining property owners had no objection to the surmountable curb or the variance. Mr. Flora stated the Appeals Commission has recommended approval of the variance. He stated, however, the variance has not, as yet, gone to the Planning Commission, but because Kurt Manufacturing would like to complete -3- 2. for his property values and his family's privacy as neighbors have been propositioned by custaners of this house of prostitution. Its mere presence was an awkward contradiction to the morality in which he is trying to bring up his family. Mr. Kroll stated he would like to commend the City of Fridley for its public stand against this kind of establishment. The City of Fridley has enacted strict legislation regarding the operation of massage parlours, saunas, and like businesses. More recently, the City enacted an ordinance tof ine any business which has three or more convictions for prostitution or prostitution -related offenses on its premises within a two-year period as a nuisance to the community giving the City the right to close it down. Mr. Kroll staged that on Thursday, November 29, 1984, the City of Fridley Police Department made its first arrest of prostitution under this ordinance. He would like to thank the Police Department of the City of Fridley for its swift action in this matter. Nothing would please him more than for this blatant, illegal operation to leave Fridley. Dear Sirs: This letter is to make clear this department's requirements for the swimming pool construction at the above address. 1. As indicated, one (1) skimmer approved by the National Sanitation Foundation will be provided. 2. As indicated, two (2) inlets of approved design for fresh and/or repurified water will be provided. 3. As indicated, a main drain of approved construction will be provided. 4. The filter and pump shall be approved by the N.S.F. and be of sufficient capacity to provide a minimum turnover of at least two (2) times in 24 hours. This department recommends a turnover rate of 6 - 8 hours. 5. A deck of at least three (3) feet wide, measured from the pool waters edge, shall be provided which extends completely around all private residential pools. The diving area will be acceptable provided there is no overhead obstruction. 7. Fencing shall meet the following criteria: (a) The fencing shall prevent the entrance of children and be without hand or foot holds that would enable a person to climb over it. (b) The fencing shall be at least 6 feet high and entrances shall be equipped with self-closing and self -latching gates capable of being locked. (c) Self-closing and self -latching devices shall be placed at the top of the gate or otherwise inaccessible to small children.
