On December 29, 1978 our office was called to inspect the existing
foundation at 60 - 62'i Way N.E. The purpose of said inspection was
to determine if it could withstand the additional live and dead loads
of the proposed second story for which you were granted a building
permit.
The conditions found were not favorable. The foundation is not acceptable;
it is not deep enough nor is it thick or wide enough. The center beam is
not large enough and there are several places where the ground has been
sufficiently removed from the inside to expose the bottom of the existing
footing. The result is that there is no support under several areas of
the footing.
This should have been brought to our attention at the time you applied for
your building permit, and if it had you would not have been granted the
permit. Therefore, please consider this letter a "Stop Work" order and
you are no longer authorized to commence the project for which you were
granted a building permit.
If you want to apply for a refund of the permit fee, please do so in

Dear Mr. Anderson:
We were called to inspect your existing foundation to determine if it
was adequate to support the proposed second story addition.
On December 29, 1978 we inspected your existing foundation and found
it to be inadequate to properly support your existing home. It is
not deep enough and is of insufficient cross-sections to support the
existing loads. The most severe problem is in the areas where the
ground has caved away from under it leaving the footing without any
support in several areas. The center beam is also of insufficient size
to span the lengths that it now is spanning.
These deficiencies must be corrected as soon as possible. If you
choose not to make them right away, you should somehow put in some
temporary support systems.

Dear Ms. Kloster:
This letter will serve as notification to you that as a result of the fire which occurred at your residence on
October 1, 1998, the building will be posted as unsafe and will have to be demolished. According to
Section 102 of the 1994 Uniform Building Code which states in part, ..Any structure that constitutes a
hazard to safety, health, or public welfare by reason of disaster or damage, shall be considered unsafe. All
unsafe buildings shall be declared a public nuisance and shall be abated by repair or demolition as referenced
in the Dangerous Building Code. According to Section 205.04.03.3D of the Fridley Zoning Code, "Whenever
a lawful nonconforming structure is damaged by fire, flood, explosion, earthquake, tornado, riot, or act of
God, it may be reconstructed and used if it is reconstructed within 12 months after such calamity, except
if the damage to the building or structure is fifty percent (50%) or more of its fair market value, as
determined by the City, in which case the reconstruction shall be for a use in accordance with the provisions
of this chapter".
The building itself is assessed at a value of $27,000.00 and the estimate for fire repairs is $25,000.00.
Therefore the City of Fridley will not allow the structure to be repaired but must be demolished.
If you desire to rebuild on this site, a variance must first be approved for lot area by the City Appeals
Commission. Other variances may be required depending on the type of dwelling that will be constructed.
The City of Fridley will allow you 20 days from the date of this letter to remove the structure (including
garage which cannot remain on the site without a principle building) and clean the site of all demolition
debris. A demolition permit will have to be applied for and the utilities must be disconnected at the property
line. We should also get a final reading, if possible, from the water meter and remove the meter from the
building.

Re: Physical Review And Content Inventory
On October 1, 1998 at 4:00 pm I reviewed the contents of a burned out single family home at 60 621/2
Way in Fridley MN. I could not enter the home because the doorways were filled with refuse piled four
to five feet high. I viewed the interior contents through windows that had been broken out by the Fire
Department earlier that day. I found the following:
Kitchen: plastic bags of garbage four feet deep. Made up of bottles, cans, paper, cardboard, and food
supplies.
Living Room: cardboard boxes, plastic bags, paper bags, filled with clothes and general refuse. The
ceiling had fallen in on top of everything making it difficult to see the contents.
The only recognizable furniture in the house was one lamp, one refrigerator, one mattress, one food

Garage: The roof was experiencing major leakage. There were many water stained cardboard boxes
with unknown contents. Other items included general garden tools, ladders ,bikes, mowers, fans,

Dear Ms. Kloster:
This letter will serve as notification to you that as a result of the fire which occurred at your residence on
October 1, 1998, the building will be posted as unsafe and will have to be demolished. According to
Section 102 of the 1994 Uniform Building Code which states in part, "..Any structure that constitutes a
hazard to safety, health, or public welfare by reason of disaster or damage, shall be considered unsafe. All
unsafe buildings shall be declared a public nuisance and shall be abated by repair or demolition as referenced
in the Dangerous Building Code. According to Section 205.04.03.3D of the Fridley Zoning Code, "Whenever
a lawful nonconforming structure is damaged by fire, flood, explosion, earthquake, tornado, riot, or act of
God, it may be reconstructed and used if it is reconstructed within 12 months after such calamity, except
if the damage to the building or structure is fifty percent (50%) or more of its fair market value, as
determined by the City, in which case the reconstruction shall be for a use in accordance with the provisions
of this chapter".
The building itself is assessed at a value of $27,000.00 and the estimate for fire repairs is $25,000.00.
Therefore the City of Fridley will not allow the structure to be repaired but must be demolished.
If you desire to rebuild on this site, a variance must first be approved for lot area by the City Appeals
Commission. Other variances may be required depending on the type of dwelling that will be constructed.
The City of Fridley will allow you 20 days from the date of this letter to remove the structure (including
garage which cannot remain on the site without a principle building) and clean the site of all demolition
debris. A demolition permit will have to be applied for and the utilities must be disconnected at the property
line. We should also get a final reading, if possible, from the water meter and remove the meter from the
building.

This will confirm our telephone conversation on October 19, 1998 wherein I indicated our
firm's representation of Illinois Farmers Insurance Company in regard to the above -
captioned fire loss.
This will further confirm that, during our phone conversation, I advised that the expert
retained on behalf of Illinois Farmers has determined that the fire was of incendiary origin
and that we are waiting for the incident report prepared by Assistant Fire Chief Richard
Larson to determine his opinions in regard to the origin and cause of the fire. I also
advised at that time that there may be a need for additional investigation of the fire scene,
including but not limited to, examination of the furnace located at the property.
Finally, this will confirm that we have received a copy of your letter of October 2, 1998
to the homeowner, Marilyn Kloster. As we discussed, you have allowed us up to an
additional one week for removal of the structure. This would give the homeowner until
Thursday, October 29, 1998 within which to comply with the City's requirement.
