Dear Mr. Anderson: We were called to inspect your existing foundation to determine if it was adequate to support the proposed second story addition. On December 29, 1978 we inspected your existing foundation and found it to be inadequate to properly support your existing home. It is not deep enough and is of insufficient cross-sections to support the existing loads. The most severe problem is in the areas where the ground has caved away from under it leaving the footing without any support in several areas. The center beam is also of insufficient size to span the lengths that it now is spanning. These deficiencies must be corrected as soon as possible. According to Section 102 of the 1994 Uniform Building Code which states in part, ..Any structure that constitutes a hazard to safety, health, or public welfare by reason of disaster or damage, shall be considered unsafe. All unsafe buildings shall be declared a public nuisance and shall be abated by repair or demolition as referenced in the Dangerous Building Code. According to Section 205.04.03.3D of the Fridley Zoning Code, "Whenever a lawful nonconforming structure is damaged by fire, flood, explosion, earthquake, tornado, riot, or act of God, it may be reconstructed and used if it is reconstructed within 12 months after such calamity, except if the damage to the building or structure is fifty percent (50%) or more of its fair market value, as determined by the City, in which case the reconstruction shall be for a use in accordance with the provisions of this chapter". The building itself is assessed at a value of $27,000.00 and the estimate for fire repairs is $25,000.00. Therefore the City of Fridley will not allow the structure to be repaired but must be demolished. If you desire to rebuild on this site, a variance must first be approved for lot area by the City Appeals Commission. Other variances may be required depending on the type of dwelling that will be constructed. The City of Fridley will allow you 20 days from the date of this letter to remove the structure (including garage which cannot remain on the site without a principle building) and clean the site of all demolition debris. A demolition permit will have to be applied for and the utilities must be disconnected at the property line. I could not enter the home because the doorways were filled with refuse piled four to five feet high. I viewed the interior contents through windows that had been broken out by the Fire Department earlier that day. I found the following: Kitchen: plastic bags of garbage four feet deep. Made up of bottles, cans, paper, cardboard, and food supplies. Living Room: cardboard boxes, plastic bags, paper bags, filled with clothes and general refuse. The ceiling had fallen in on top of everything making it difficult to see the contents. The only recognizable furniture in the house was one lamp, one refrigerator, one mattress, one food cabinet, one clothes dresser, one window air conditioner, one bookshelf, and two folding chairs. Garage: The roof was experiencing major leakage. There were many water stained cardboard boxes with unknown contents. Other items included general garden tools, ladders ,bikes, mowers, fans, metal storage shelves, and bags of garbage. According to Section 205.04.03.3D of the Fridley Zoning Code, "Whenever a lawful nonconforming structure is damaged by fire, flood, explosion, earthquake, tornado, riot, or act of God, it may be reconstructed and used if it is reconstructed within 12 months after such calamity, except if the damage to the building or structure is fifty percent (50%) or more of its fair market value, as determined by the City, in which case the reconstruction shall be for a use in accordance with the provisions of this chapter". The building itself is assessed at a value of $27,000.00 and the estimate for fire repairs is $25,000.00. Therefore the City of Fridley will not allow the structure to be repaired but must be demolished. If you desire to rebuild on this site, a variance must first be approved for lot area by the City Appeals Commission. Other variances may be required depending on the type of dwelling that will be constructed. The City of Fridley will allow you 20 days from the date of this letter to remove the structure (including garage which cannot remain on the site without a principle building) and clean the site of all demolition debris. A demolition permit will have to be applied for and the utilities must be disconnected at the property line.
