For the record, Kevin Hanson is an excellent Building Official whose interests are only those of the City. His credentials allow him to not only do heating and mechanical inspections, but also, all Certified Chief B.O.-type inspections since he is a certified Chief B.O. He is entirely trustworthy and professional. Ron Julkowski is undoubtedly one of, if not the top Building Official in the State. When Ron takes a half day off, a Building Official that he trusts, with the enormous responsibilities of his work, is Kevin Hanson. We all know who it is that we believe in and who we trust as individuals. I know for certain that I trust Kevin Hanson. I don't know Tay Kersey. I would be glad to have you meet Kevin and I will be equally glad to share his credentials with you. I can tell you this, Tim Fowler has wanted the City to tell him to tear down his house ever since this incident happened. A good staff knows pitfalls, knows games people like to play, a good staff knows when to stay clear. It is not this staffs responsibility to determine who owes what on their mortgage, nor who gets paid what by their insurance company. It is this staffs responsibility to make certain that Building Codes are enforced and peoples lives are safe in the structures approved. The home at 415 63rd stands in a questionable state. It is not up to this City staff to provide engineering analysis that says whether the house stands or is demolished. However, the home cannot stand forever in this state of uncertainty. If it is to be repaired, privately commissioned engineering is required. If someone who has access to the inside of the home, has an interest, and is of the position that the home can be saved, he needs to get the engineering to support that position. If there is no engineering proof, the home eventually must come down. The City does not want a burned house standing in a state of disrepair for many reasons. A solution is what is required, whether that solution is to rebuild the home, or to have it demolished, is left to be seen. Though I have not been with Kevin on his field inspections, the beauty of having expert staff is that I don't need to be. They do their job and they do it right. If they don't, we deal with that issue too. And finally noone on our staff winks (at least on company time, doing company business). There are known winkers that come into our Building counter. Our staff knows that it is no secret that a wink is often linked to unsavory dealings. Kevin is not a winker and would be insulted. More importantly though, I will invite you to kick mine, Kevin's, or other staff members rear end when you rightfully determine that this is how we are we are doing business. Until then, we appreciate your trust. You are right that there are many stories in this big City. Some of the discussion/speculation out there is that of uninvolved, passively interested parties who like to have an opinion. Other speculation is of a more dangerous variety. That type can have Council members questioning staff motives. I've always appreciated your support of staff and your willingness to get to the bottom of issues. Billman has insurance payable to Billman in the neighborhood of $ 150K. It is my further understanding that Mr. Fowler had little or no insurance. The big problem, is does Billman take the balance that is owed on the Contract from the insurance and disappear? This is actually all that Billman is likely entitled to, and actually the reason he had insurance protection in the first place, to protect his financial interest in the property. However, that leaves the neighborhood with a fire damaged building, Mr.Fowler then the new Fee owner, and no funds available for anything. Mr.Kersey would like to help Mr. Fowler as best he can. They appear to be willing to reinvest the insurance proceeds into the home, and then allow Mr. and Mrs. Fowler to continue to make payments to them on the current balance owed. However, it sounds like a complete knock down and rebuild, including the two fireplaces, could easily cost more than the insurance proceeds of $ 150,000.00. Mr. Billman is not motivated to put additional funding into the property for Mr. Fowler's benefit. Mr. Fowler, according to rumors is pushing for the total knock down and rebuild. If that is truly his position, he (and the neighborhood) could end up with an empty lot, and the insurance company could save $ 50,000.00. 1 rent office space from Billman. Some of the above information may, in fact, be privileged information. I have received most of it from either neighborhood rumor, or over hearing discussions in the office next to me. This brings me to my reason for calling. Mr. Kersey has heard most of the neighborhood stories by and about Mr. Fowler. Additionally, Mr. Fowler appears to have several "friends" that are employed by the City Fire, Police, and others. I do not know what Kevin said, I do now what Mr. Kersey heard. Your version and his are quite similar. It is the way a phrase is turned that makes a difference. Mr. Kersey's interpretation was that the building MUST BE TORN DOWN, UNLESS HE CAN GET A STRUCTURAL ENGINEER TO CERTIFY THAT A PORTION MAY BE SAVED. While similar to the official City position, I believe that our position is rebuilding is possible, we require structural examination IF they wish to save any portion of the building. What caused concern on the part of Mr. Kersey, was an alleged "wink" from Kevin to Mr. Fowler while Kevin was stating that the house must come down. This may have been a poor time for a particle of dust to get into Kevin's eye, but based on Mr. Fowler's self proclaimed association with City employees, it caused concern for Mr. Kersey. Mr. Kersey approached me, and wondered if Kevin actually worked for the City and who he was. While I knew that Kevin did our heating and mechanical inspections, I was not aware of his involvement with this case. Hence the phone call to you. As it turned out, Kevin stopped at the pre -determined time, only to find Mr. Fowler and Rodney Billman, a Mr. Granger, no insurance adjuster. While there, Mr. Billman and Mr. Fowler began to argue about ownership of the house. Kevin left them to their private business. Kevin returned to the office and we called Fritz. Our staff has given the homeowners everything they need to know at this point. The next thing we expect to see happen is a plan from 415 (Fowlers), signed by a structural engineer. Without engineering verification of structural viability that home, and ability to rebuild, the home will need to be demolished as well. Kevin also told them that the house will be rebuilt to all current codes. Per Section 102 of the 1997 Uniform Building Code, which states in part, any structure that constitutes a hazard to safety, or health, or public welfare by reason of disaster or damage, shall be considered unsafe. All unsafe buildings shall be declared a public nuisance and shall be abated by repair or demolition as referenced in the Dangerous Building Code. Section 302 of the Dangerous Building Code states that any building or structure which has any or all of the conditions or defects herein described shall be deemed a hazardous building, provided that such conditions or defects exist to the extent that the life, health, property or safety of the public or its occupants are endangered. Per Section 403 of the Dangerous Building Code, you are hereby ordered to demolish or repair the structure within 20 days after the City of Fridley Fire Investigation. All demolition shall be coordinated with Ralph Messer, City Fire Marshal, to assist with his fire investigation. This building has been posted as an unsafe building. Your house is a single family dwelling that is located next to a house that recently sustained a major explosion. It is evident that your house due to its close proximity to the scene of the accident sustained significant damage as a result of the explosion and fire damage that appears to have totally destroyed the house next door. The purpose for my visit was to inspect and assess the extent of both the obvious and possibly hidden structural damage resulting from the fire and explosion. The City of Fridley Building Inspector and the local Fire Department Inspector were also present at the house at the time of my inspection. My observations and recommendations. are summarized in this report. General Observations -It appears that the west side of the house sustained the greatest damage. This is the side of the house that faces the neighboring house which was the scene of the explosion. -The roof trusses over the main living area of the house are damaged beyond repair. Many of the roof trusses have a damaged or missing top chord member due to fire. This makes the roof trusses very susceptible to collapse under any additional snow loads. The west wall of the house appears to be out of plumb and has sustained visible impact damage from the explosion. This wall is bearing the floor and roof trusses along the west side of the house. The south wall of the house has sustained damage and appears to have racked noticeably out of plumb. - There is evidence of displacement at the exterior north wall of the house and in the attached. exterior deck. - The attached garage on the east side of the house appears to have slight dip in the roof ridge line. This will be costly and time consuming work and will expose the remaining intact structural wood framing to additional weathering and moisture damage, ie., mold growth, corrosion, warping and delamination of plywood, etc. The present condition of the damaged roof trusses can only be described as hazardous. Prior to any subsequent demolition work or other activity in the house in these areas, I would strongly recommend either complete removal of the roof trusses or extensive temporary shoring. The shoring would have to be designed to sustain a minimum snow load of 20 psf in addition to the dead load of the roof trusses. The exterior walls which are normally braced by the (intact) roof trusses would also need to be braced at the top laterally for wind loads. I would recommend a minimum wind design load of 40 mph for the lateral bracing, which is one-half of the normal 80 mph wind load design criteria of the State of Minnesota Building Code. I am not in the position of being able to declare the remaining structure as a total loss or as unsalvageable based on my initial observations only. This determination can only be made by your insurance company. As a Professional Engineer, based on my experience with residential wood construction, the extent of the visible damage, in my opinion, indicates to me that additional investigation is warranted in order to fully assess the structural integrity of this house. Your insurance company is fully aware that additional costs for demolition, temporary bracing and shoring, professional masonry fireplace/chimney inspection and testing, professional electrical, mechanical and plumbing system testing and inspection and final structural engineering inspections will be incurred. The cost of these items will undoubtedly weigh in their decision relative to the final repair costs or demolition and replacement cost of the house. On Sunday morning, January 6, 2002 at approximately 1:53 AM, Mr. Miller's house exploded and caught on fire. The explosion shook and moved my house off its foundation. My house was located at 415 63 Ave. NE the ensuing fire ignited my house and it is a total loss. My family escaped only with the clothes they were able to wear. Mr. Miller caused this loss by recklessly and illegally storing numerous liquefied propane tanks in his garage. At least eleven 401b tanks were noted by an investigator on or around the fire scene. This is a violation of the National Fire Code Standard #58, which only allows 21b LP stored inside a building. This clearly was an increased risk to the entire neighborhood. The city had been notified several times prior to the fire about the storage of these tanks, but elected to ignore the information. In addition, the Fridley Fire Department was also notified, and aware of the stored tanks. Mr. Miller was a very good friend with a full time fire department employee as well. The home, in which Mr. Miller resided in, was a duplex. I am yet to obtain the rental inspection report that is required of all rental units in Fridley. I'm asking you to accept this letter as formal notification of a liability claim. I intend to pursue a claim against you and expect to become whole again. Because of my circumstance, I would prefer not to have to retain an attorney. I can't afford the additional expense. 13y writing you this letter, I am trying to keep my expense down by dealing with you directly. If there is delay, however, I will have no alternative but to sue you. A suit in which the city will undoubtedly have to defend. It seems quite obvious I would win such a suit. I just need to get my family back on track, repair the damage the fire has caused and move on. I am currently in the process of rebuilding.
