Re: Building an Attached Garage at 110 - 63rd Way N.E.
Dear Mr. Barth:
This letter is in response to your question on November 1, 1985 regarding
the possibility of building a two car attached garage onto the east end of
your existing house.
A copy of your lot survey showing the proposed location of your residence
was used to determine the following; Your existing house is 26 feet from
the right of way of East River Road; the easterly 20 feet of that 26 feet
is a storm sewer easement that can not have a permanent structure built on
it.
The required side yard setback off from the East River Road property line
is 17.5 feet. Therefore, you would have to have the 20 foot easement
vacated and successfully obtain a variance for the side yard setback prior
to receiving a building permit for any attached garage. The City does
not have any utilities in this 20 foot easement, however the County or
the utility companies may have.
You could however attach a garage to the south side of your house or build
a detached garage in your rear yard.

Dear Mr. Ransom:
It was confirmed by an on-site inspection on July 12, 1984 that you were
maintaining your property in violation of Section 113, Refuse Disposal, and
Section 110, Public Nuisance, of the Fridley City Code.
The inspection found wheels, tires, a transmission, batteries, tree waste, a
hood, bricks, long weeds and grass, and other miscellaneous litter and debris
along the west property line and in the rear yard. This is presenting a
cluttered appearance, is a nuisance, and is a detractant to the neighborhood.
At this time, the City must require you to cut and maintain the long weeds
and grass and to dispose in a sanitary manner, all of the refuse and debris
found on your property. In addition, you must provide and maintain a
sufficient number of approved covered containers to store all refuse inside,
between collections, and have all refuse removed from your premises at least
once a week.
Finally, any accumulations of discarded material and refuse is declared to be
a public nuisance and is subject to abatement under Chapter 110 of the
Fridley City Code.
To determine compliance, a reinspection will be conducted on or about July
23, 1984. The City is confident in your cooperation and if this letter
creates any questions or problems, please feel free to contact me at
571-3450.
Failure to abate this violation may result in this matter being turned over
to the City Prosecutor for his legal consideration.

Dear Mr. Ransom:
It was confirmed by an on—site inspection on September 29, 1982 that you
were maintaining a blue Chevrolet Malibu, with no visible license
plates, on the above listed property in a Junked, street inoperable
condition.
Chapter 123 of the Fridley City Code requires that ell vehicles in the
City be currently licensed end in a street operable condition. An
alternative is to store said vehicles within a building or at an
approved location, e.g. a Licensed Junk yard.
Therefore, the City must require you to remove said vehicle from this
property or bring it into compliance with the City Codes by putting the
vehicle in a street operable condition, piecing it within the confines
of a building, or removing it to an approved location.
A reinspection will be conducted on or about October 12, 198;e to
determine compliance. We are confident in your cooperation and desire
to make Fridley a better community to Live in. If any questions or

LICENSE AGREEMENT
THIS AGREEMENT is made and entered into this b day of , 1992,
between the County of Anoka, a political subdivision of the State of M' esota, 325 East Main
Street, Anoka, Minnes to 55303, here' after referred to as the "County," and David E. Gustafson,
10 : 63 VAI ITY 3Y , hereinafter referred to as the
"Landowner."
WITNESSETH:
WHEREAS, the. Landowner is the owner of a certain parcel of land located in the City of
Fridley, County of Anoka, State of Minnesota, and legally described as Lot 1, Block 3, Eva Erickson
River Manor, Anoka County, Minnesota; and
WHEREAS, the Landowner desires to construct a garage on the southeast comer of said
parcel, which garage will encroach on the County's right-of-way and storm sewer easement for East
River Road.
NOW, THEREFORE, in consideration of the mutual promises herein contained, the parties
agree as follows:
L GRANT OF LICENSE, DESCRIPTION OF PREMISES
The County hereby grants to the Landowner a license to occupy and use, subject to all the
terms and conditions herein, property located in the City of Fridley, County of Anoka, State of
Minnesota, which is that portion of Lot 1, Block 3, Eva Erickson River Manor, which is depicted in
Exhibit A, which is attached hereto and incorporated herein by reference, and which is hereinafter
referred to as the "Premises."
II.
LIMITATION TO DESCRIBED PURPOSE
The Premises may be used by the Landowner solely for the purpose of constructing and
maintaining a garage for private use.
III. INDEMNIFICATION
Landowner agrees to hold harmless and defend the County, its officers, agents and employees,
from any and all liability and claims, including attorney's fees concerning, related to or resulting from
the use of the Premises and for all claims or damages to any party arisin* g from or relating to the use
of the described Premises under this License.
IV. COST OF CONSTRUCTION, INSTALLATION, REPAIR, MAINTENANCE AND
REMOVAL
The Landowner shall be solely responsible for the cost of constructing, repairing and
maintaining the garage. The Landowner shall, at its sole expense, remove the garage from the
premises if, in the County's sole judgment, the premises may be required for use as right-of-way,
repairing the storm sewer system currently constructed there or for any other public utility easement
purpose.

COUNTY OF ANOKA AGREEMENT
THIS AGREEMENT dated this day of Jdla 1992,
by and between the City of Fridley, a Munic pal Corporation
(hereinafter referred to as "Grantor") and David E. Gustafson and
Gail H. Gustafson, husband and wife, (hereinafter referred to as
"Grantee"); and
WHEREAS, the Grantee is the owner of Lot 1, Block 3, Eva Erickson
River Manor Addition, Anoka County, Minnesota; and
WHEREAS, the Grantor has a utility easement over the east 20 feet
of said property; and
WHEREAS, the Grantee has received a variance to place an accessory
structure which encroaches upon the easement held by the Grantor;
and
THEREFORE, it is agreed by and between the parties as follows:
1. The Grantor hereby agrees to permit the .placement of the
Grantee's accessory structure within the utility easement and
which accessory structure is owned by the Grantee on the above
described property.
2. That the Grantee acknowledges that the Grantor or the County
of Anoka may..from time to time.need to utilize the easement.
This may include, but is not limited to, certain construction
activity which may be necessary for the maintenance and repair
of the existing sewer line. The Grantee agrees to hold the
Grantor or the County of Anoka harmless for any damages which
may be incurred by the accessory structure due to the
Grantor's or the County of Anoka's exercise of its rights
within the easement area.
3. The Grantee further agrees that in consideration of the
Grantor permitting the subject accessory structure to remain
upon the easement that the Grantee agrees that they shall not
upgrade, expand, or make additions to the subject accessory
structure. The Grantee further agrees that they shall not
place any additional structures within the subject easement
area. Notwithstanding this language, the Grantee acknowledges
that they shall have an obligation to maintain the structure
in a reasonable fashion.
4. This agreement shall be binding upon both parties and upon
their assigns and transferees.
