MOTION by Councilman Schneider to direct the administration an City
Attorney's Office to prepare a report for the next meeting regardi actions
which may be taken to solve this problem. Seconded by Councilman arnette.
Upon a voice vote, all voting aye, Mayor Nee declared the mo on carried
unanimously.
Councilman Schneider stated he received calls frausever residents in the
area and hoped an agreement could be reached between Brickner and Mr.
Skinner which would eliminate the need for Mr. Skinner7o keep up the signs.
Mr. Newman stated one procedure would/wo
rge Mr. Skinner with
violation of the ordinance. He stated ttake a minimum of four
months knowing there are certain constitfenses. He stated the
ultimate result is Mr. Skinner could bordered to physically
remove the signs. Mr. Newnan stated ary action would take a
minimum of six months through the courts
Obuncilman Schneider stated it seems a most expedient way for the signs to
be removed is to have an agreement tween the two property owners, Mr.
Brickner and Mr. Skinner.
Mr. Qureshi, City Manager, st ed he has met separately with Mr. Brickner
and Mr. Skinner and tried o put forth a proposal that is fair to both
parties. Mr. Qureshi sta d Mr. Brickner accepted this proposal, and the
City is awaiting a respo from Mr. Skinner. M.r. Qureshi stated if Mr.
Skinner accepts the pr sal, there wouldn't be a need for any signage.
Mr. Jim McCulloch, 185 Heather Place, stated the code says Mr. Skinner is
in violation. H felt, if this was the case, the City should take some
action and the de enf or eed.
Mr. Newmann ated he is recommending no action be taken until the next
meeting the constitutional issues can be reviewed.
Mr. oulloch stated he would like a program by the next meeting to get this
mat,eer settled as quickly as possible.
Mayor Nee stated the code is basically for commerical signs. He stated this
is a sign of a different gender and that raises the question of whether or
not it is covered under the stark reality of the letter of the lava.
Ms. Meierbachtal stated they appreciated the Council's attention to help
solve this matter and would like to proceed with a solution no matter hos
long it takes.
WATER PROBIM - 1357 64TH AVENUE:
Mr. Joe Nelson, 1357 64th Avenue, appeared before the Council regarding the
water problem at his residence. Mr. Nelson stated he realizes this is the

wettest May on record, but he has an estimated $3,000 in damages to his
basement and felt the storm sewer system was a contributing factor as it has
became ineffective over the course of the past 30 years.
Mr. Nelson presented a drawing of holding ponds and the storm sewer system
in effect. Mr. Nelson stated water runs down Mississippi all the way from
Arthur Street, and the storm sewers on Creek Park Lane run across the park,
and end up in the holding area behind his home. He stated this holding
pond, over the last 30 years, has filled in and presently there is only an
area about 10 by 50 feet.
Mr. Nelson stated the City has given him assurances something would be done
by ditching or a drainage area going west to Old Central and then proceeding
south on Old Central to Moore Lake.
Mr. Qureshi, City Manager, stated at one time, there was discussion about a
storm sewer system for this area, however, because of the costs, most
residents didn't want to proceed and the project was dropped.
Mr. Qureshi felt if the City can obtain permission, there is a deep lot
north cf Mr. Nelson's property and a logical area where the City could do
some ditching to divert the water to the west, along Old Central, and put
culverts under paved driveways for the runoff to drain to Moore Lake. Mr.
Qureshi stated this wouldn't be a perfect solution because of the
shallowness of the depth from his hone to the lake which are both about the
same elevation.
Councilman Schneider stated Mr. Nelson questioned if this ponding area was
ever an official holding pond. Mr. Qureshi stated it was not and presented
1959 aerial drawings which shows a swampy area, but never in public
ownership or any type of control.
Mr. Nelson stated he had met with Mark Burch of the City's Engineering
Department, other members of the Engineering staff, and Councilman Schneider
and would like to thank then for their concern and help in attempting to
resolve this problem. He stated he would like support of the Council for an
expedient solution to this problem.
Mr. Qureshi stated permission would be needed before they can go on private
property to provide an outlet for this water. He stated any influence Mr.
Nelson may have to expedite the City's efforts would be appreciated.

notice and open the public . Seconded by Councilman Schneider. Upon
a voice vote, all voting aye, Nee declared the motion carried
unanimously and the public hearing opene :20 p.m.

Mr. Bums, City Manager, reported that bids were opened on March 17, 2004. The low
bidder is Ron Kassa Construction of Elko, Minnesota in the amount of $71,000. The
work includes remedial sidewalk repair, replacement of concrete street panels, and
repair and replacement of concrete curbing destroyed by utility repairs, and
reconstruction of driveway entrances. Staff recommends that the bid be awarded to
Ron Kassa Construction in the amount of $71,000.

Mr. Bums, City Manager, explained that the City is constructing the extension of
Woodside Court as part of the Theilman plat that was approved last year. All costs will
be paid by the current developer, Jeffrey Cruz. Staff recommends Council's approval.

9. Approve Change Order #1 for the 2004 sanitary and storm sewer lining
project
Mr. Bums, City Manager, stated the City's contract for the 7e Avenue sanitary sewer
lining project is suggesting we line the entire'638 feet of 36 inch sanitary sewer linelon
75th Avenue rather than do a combination of joint sealing and lining as previously
planned. The Public Works Director recommends we spend an additional $24,505 to
make this change. The continuous lining is being offered at a good price and will
provide a smoother interior and more permanent solution. Staff recommends Council's
approval of the change order.
10. Approve amendment to License Agreement between the City of Fridley and
Joseph and Linda Nelson,1357 — 60 Avenue NE (Ward 2).
Mr. Bums, City Manager, stated in 1997, the City approved a license agreement with
the Nelsons that allows them to install and maintain an irrigation system and driveway
that encroaches on a City easement. The attorney representing the Nelsons in their
negotiations to sell their property has found a discrepancy in the legal description of the
easement which clouds the title to the property. The motion before Council corrects that

In 1997, the City approved a License Agreement to Joseph and Linda Nelson, 1337 64"' Ave
NE, allowing them to install and maintain an irrigation system and a driveway in an area
encroaching on a City easement. The Nelson's are now in negotiations to sell their property
and the Title Attorney has found a discrepancy in the legal description of the easement which
clouds the title. The attorney has proposed the attached Amendment to License Agreement to
resolve this problem.
The City Attorney, Community Development Director and myself have reviewed the amendment
and agree that this correction is in the best interest of the City and the property owners.
Recommend the City Council approve the attached Amendment to License Agreement so we
can have it recorded at Anoka County on this property.

AMENDMENT TO LICENSE AGREEMENT
THIS AGREEMENT, dated this _ day of March, 2004, by and between the City of Fridley, a municipal
corporation (hereinafter referred to as "the City") and Joseph J. Nelson and Linda P. Nelson, husband and wife
(herenafter referred to as "Nelsons'.
WHEREAS, the Nelsons are owners of the west 75 feet of the east 109 feet of Lot 20, Block 1, Spring Valley
Additlon, Anoka, Minnesota (hereinafter referred to as the "Subject Property"); and
WHEREAS, the City and the Nelsons previously entered into a License Agreement dated July 16, 1997, and
recorded with the Anoka County Recorder of Deeds as document no. 1293081 granting a license for
maintonanco of a lawn irrigation system (hereinafter referred to as the "License Agreement"): and
WHEREAS, that agreement erroneously described an utility and road easement reserved by the City as a 34
foot street easement over the entire width of said property; and
WHEREAS, the correct legal description of the City's utility and road easement is set forth In a document dated
February 22, 1974, recorded with the Anoka County Recorder of heeds as document no, 405434 as follows:

All that part of Lot 20, Block 1, Spring Valley Addition lying southerly and easterly of the following
described line: Beginning at the northeast comer of Lot 20, Block 1; thence west along the north line of
said Lot 20 a distance of 34 feet, thence south along a line parallel wRh the 34 feet west of the oast the
of said Lot 20 a distance of 115 feet thence deflect to the right along a line in a southwesterly direction
to its point of intersection with the south line of Lot 20, said point being 44 feet west of the southeast
Comer of said Lot 20.
All lying in the south had of Section 13, Township 30, Range 24, City of Fridley, County of Anoka. State
of Minnesota.
NOW THEREFORE, it is agreed between the parties as follows.
The parties agree that description of the Easement held by the City of Fridley set forth In the License
Agreement was for descriptive purpa9es only, and the License Agreement was not intended to, and does not
expand, reduce, or otherwise modify the �rtd granted and legally described In the Easement created by
document dated February 22, 1974, recorded with the Anoka County Recorder of Deeds as document no.
